    I listed a Prada leather briefcase last year. A week later I got a vero. Ebay told me Prada had just joined the vero program. Terrible timing. What was annoying is Prada sent a reasoning note and it said the item was authentic, they just didn't want their items being sold. What's annoying is obviously others are still selling their brand. I don't get why eBay doesn't have an automated warning pop up when you try and list a vero item. Surely it can't be that hard to implement.

      Until we have laws protecting the consumer at the US Federal level that clearly says we are allowed to resell items we purchased (genuine of course) we are at the mercy of these companies. The car companies lost the battle in the late 50's and then again with right to repair laws in the 70's when they tried to stop used cars from being sold. Now clothing brands need to be faced with the same laws.

      Too bad we can’t all afford to fight these businesses. When you. It something, it belongs to you legally. You can keep it, give it away, throw it away. Or sell it. There was a similar issue with extreme couponers not being able to sell laundry detergent, etc. the Supreme Court declared once you buy it, it’s yours to do with as you wish.

      I don't understand why brands are allowed to do this when you are literally doing nothing illegal. If sellers took them to court they would have nothing to stand on. I guarantee these brands don't go to companies like TheRealReal or ThredUp and try to pull that.

      @@Rock_Bill_Kaa There are laws - 1) First Sale Doctrine 2) The Lanham Act. For eBay - they just dont want to be involved in anything. They dont want to spend 1 cent dealing with/defending ANY seller - big or small. There are WAY more companies that are aggressive then those mentioned - Casio, Kenwood, Sony, JBL, Nikon and many more. They (mostly) abuse the program to kick sellers off - without regard. They know they can bleed you dry - even if you are in the right - so they throw their weight around as they please. eBay knows this and looks the other way. Most times theres money in he background (the brands open stores on eBay) in return or at least promise to NOT sue them - if they do as they tell them to. Ive gone up against VERO many times (seller since 1998) and Ive never actually been sued - though in most cases - I had to remove to curtail the listings.
      Vero and eBay are bullies when it comes to this issue, period

    years ago I listed some handbags that were made out of seatbelts, apparently a brand called Harvey's also made a "seatbelt bag" they veroed my listing even though it was a totally different brand, I relisted with the words "nylon woven strap bag" and they veroed in again, its the only appeal I ever won with ebay I argued that this company did not in any way own the words nylon woven strap and it was not their brands bag so they shouldn't be able to claim another companies property. Ebay actuallly agreed with me.

    I had a listing taken down due to complaint from Grunt Style a few months ago. Fortunately, there was no suspension from eBay involved. I had 4 of their t-shirts listed, but they only took the one down for some reason. Ended up removing the others out of caution, especially since the value is so low, it was not worth the risk.

    I've never had a vero as a newer seller... but literally WHILE WATCHING YOUR VIDEO I got a VRO email from eBay. That is an eerie coincidence!

    Just my humble opinion here… there is a marked increase in the reselling market and more people are buying used for whatever reasons they might have. This takes away from the new clothing market profit margin and the difference is being noticed by these companies. So their way to combat this is to hit where it hurts with a big company like eBay who will bend to their will to avoid lawsuits and since poop rolls downhill all us little guys are caught in the avalanche. JMHO

      This guy was not a little guy on Ebay. Making 1.8 mil is not little. It's just that he was doing risky transactions with no paperwork to support that million $ income.

      I agree. It's not just in clothing though. All of these bigger corporations/businesses out there have noticed for sure. People have become really successful in alot of different areas online but the insanity of these businesses thinking they own descriptive words or any words for that matter other than their businesses name/trademark blows my mind. To me them being able to own words to the point that they can take legal action against you for using them to resell is some hard core gatekeeping imo

    A year or so ago, I sold a Hermes tie to a buyer. He got and then claimed it being fake. He based his claim on one RUclips video and ebay sided with him. I asked him to return the item and he said I had to pay him for the postage. I am an overseas seller and refused. I contacted ebay about this and they still sided with the buyer. I suspect he hoodwinked ebay and got a free tie.

    You mentioned two of mine back to back. I was warned while listing that I couldn't use "Velcro" unless it was the actual brand. I was also warned while listing another item that I could not use the term "Onesie" unless it was Gerber brand. For the two items, it was suggested I use "hook and loop" and "bodysuit/one piece," which I did.

    Allbirds shoes had a big vero thing, I think last year. Everything was removed from ebay even if it was authentic and a lot of resellers were mad. I only sell them on poshmark. Really a shame, because you would think a sustainable brand would want to keep their stuff out of landfills.

    Patagonia Capilene Cool Daily shirts too. There was a voluntary recall for them because the 50+ UPF rating was actually more like 15-30 UPF, or something like that.

    Be sure to hide your sold listings to prevent getting hit later. There are companies that check active and sold listings once a quarter as I found out when 3M hit me with a VERO for using velcro a few weeks after I had already sold the hat.

    Can confirm water filters, got a VeRO deleted listing for refrigerator water filters after it had been up a few weeks. Electrolux, apparently... I think they may have made the filter but haven't been able to connect them yet.

    Picked up a vero for selling Levi’s nwt jeans. The order shipped to Europe and there is apparently an issue with that.

      I have mine set where I can sell it but 0 overseas selling I set it where I cannot sell to anyone overseas

    it is my understanding that HP printer ink is only problematic if you sell it with international options available
    evidently there is some type of contract that means it is not to be sold in Europe

    I had an HP ink listing removed. I think it was for using Hewlett Packard in the listing. I ended up relisting just using HP compatible ink and it sold. I will always shy away from selling their ink again.

      Same. I’ve sold tons of ink and hp is the only oem that I’ve received a vero. I’ve ended up using offerup with good success on ink in general

    I sell tons of Gore-Tex and as long as you have the tag in a photo, you should be fine. Never had a single problem for years with them. I never sell TNF with tags, I always remove the tags and sell them as NWOT. I do have problems with TNF NWT. Been asked for an invoice from eBay to verify I have not stolen the jacket.

      Does a receipt from an REI count as an invoice? Do you also take tags off of Patagonia NWT?

      @@toadevergreen2561 I take tags (NWT) off of several brands, Patagonia, being just one of them. The difference is really just ~ 25% maybe. Instead of making $30 on a shirt, I might make $23. Receipts do NOT count as an invoice, it is a receipt. You need to have an invoice as a wholesaler, store or authorized retailer and a relationship with that manufacture to resell the item for below the MSRP if there is one.

    When I first started listing DVDs I got a vero for p90x. I had no idea at the time you could get a vero for a legit preowned product. Needless to say I havent listed that again.

    I think we're all a bit spooked. I did have a Grunt T on, so went and took it down. I saw that the ones listed are by an "Authorized Grunt Dealer" so I think you're right on with this one. Thank you.

    @13:34 You spoke of not being allowed to sell medical devices on eBay. Here is a quote from their policy on that. "Medical devices that require a prescription can't be sold on eBay. Listings for other medical devices must follow our policy." Their policy is not that harsh.

    I tried to sell an old collection of Cuban postage stamps, and eBay was not having it because of the embargo. These stamps probably pre-dated the embargo, but the listing was flagged nonetheless, and I still have the collection somewhere.

    The issue of ebay suspending an account permanently with no comment why, or recourse, scares me. I hear stories of this happening for small, medium, new or old sellers.

    Crazy timing on the video, considering that Daily Refinement just got a lifetime suspension for selling high priced shoes. That was total BS, but that's what we have to deal with when bowing to the whims of a monster company like Ebay.

      In all fairness, he wasn't banned for VeRO violations. He was banned because he couldn't provide invoices for $1.8 million in super high end and rare sneakers. I can actually understand eBay's reasoning there.

    Just to add to the list. Some of the automated hand towel companies are actively going after your listing if you use their brand name. Had a Vero for a commercial one 2 years ago

    I recently had issues with listing Polo Harrington bomber jackets. As harrington could not be used. It was weird considering I have listed and sold hundreds.

    Namebrand plumbing parts like Sharkbite and Pex which is a real bummer because they are expensive and if you are a diy person you'll have a lot of them left over after a big project.

    Vero has gotten a lot of people lately. It's hard to know every single thing that you can get in trouble for, since there seems to be some gray areas. I got a VERO for chicos once. I was shocked.

    Wow this just happened to me. Levi's did this to me because I had something going overseas. I guess I have 3 days off to concentrate on Mercari and Marketplace now. Heads up Don't sell Levi's 541 overseas keep them domestic.

    Here's the thing about VERO: it's a program that eBay created to avoid legal liability for allowing the unauthorized use of manufacturer's IP or trademarks. When Congress created the law allowing online platforms to be sued for this unauthorized use they gave the online platforms a way out to avoid liabiliity: if a manufacturer approaches the online platform the offending item must be removed immediately no questions asked. Hence, why eBay created VERO. The problem is the manufacturer doesn't have to prove anything they just have to contact eBay and say, "this item is fake or violates our IP, get rid of it or else."
    And literally any manufacturer can do it, for any item, at any time, no matter what it is. And just about every company of any size has a legal department and that legal department has legal interns whose whole job is to scour the internet looking for fakes and unauthorized usage. Guess what one of their favorite sites to search is? Consequently, there is no definitive list because any company can do it, at any time, for any reason. Every reseller is a salmon swimming upstream with grizzlies prowling all over the river.

      That is how I feel with eBay. I like to do things the right way. I make sure I sell genuine pre-owned items. I took pictures of tags and brands of clothes. I realized that I can veroed or sued for trademark infringement.

    Promise Nike had a hand in the Daily Refinement ban. I think he was happy to sign a NDA because they had something on him.

      The NDA was not related to his ban. He got a break on fees by being a high-volume seller and he signed an NDA not to disclose his terms. All this was way before the incident.

      People have not listened to any of his videos. The NDA had everything to do with special fees with selling he received. It had NOTHING to do with the ban at all. Honestly he should have not mentioned any NDA because everyone heard that and ran with all false assumptions.

    I got 2 veros. One for a cabin air filter by saying that it was good for a Nissan (I got the info from another listing for an identical filter) and the 2nd vero was for poker chips that had jack Daniel’s on the box. I didn’t get suspended but eBay removed my listings

    One of My first ten litings was a knock off white diamonds perfume and it got taken down just after 2 sells..I did not relist it even tho I had a few left from the dollar tree store

    Don't sell Levi's NWT with international shipping or GSP enabled. I had multiple listings taken down and had to re-list them with a separate shipping policy.

    The youtuber Meghan Stark (who does motorcycle content and sells her own merch on her own website) got a copyright claim against her in the form of a Cease and Desist from DuPont, because she had long sold keychains and t-shirts branded with one of her slogans, "Coffee & Kevlar" (She sort of does this "Cafe Racer" aesthetic so she went for the motorcycle gear/jacket and coffee thing hard)
    Anyway she was forced to stop selling her Coffee & Kevlar items. All that to say - DuPont protects Kevlar with tooth and nail. And the reason is simply that it's used in law enforcement gear to stop bullets, so they don't want the brand name being tarnished or misused. It kind of makes sense.

      I have heard that for some of the really big luxury brands, the selling platform (ebay, etc) just complies, and leaves it to you to dispute it with the brand. Most resellers cannot afford to fight it out, or are too intimidated to, so they just don't. So even if you may technically be allowed, some of them are starting to make it difficult.

      They can. However, for many years there has been a seller named Tabberone that has been taking on some of the companies on the basis of first sale doctrine. Very interesting following their updates through the years.

    I accidently bought a Cards against Humanity game that was fake. I had no idea they made counterfeit card games. And I also just bought some fake Keen mens sandals. They looked almost exactly like the genuine Keen sandals. I still have a lot to learn.

    Vero’s are the reason why I started selling on poshmark. I only sell general merchandise on eBay but it’s stressing to think about my account getting shut down or suspended so poshmark is my backup. Only selling online until I have enough money to buy a franchise.

    I think this is an important topic that no one likes to really discuss because it's the not so fun parts to reselling. I'm in need of returning a fake supreme pair of shorts which I knew was too good to be true, but still purchased it at the time. I think any brand that's a MLM also go after resellers. I'm happy selling more rare or bread and butter brands.

    I understand the higher end clothing brands. They offer guarantees and warranties that we, as resellers, can't offer. I've heard Lululemon will replace your item but if you buy it from a reseller, the item can't be replaces. I would think the car parts would be like the medical products. If something goes wrong with the car part then that could be bad. It's getting kind of scary to sell.

Any time you purchase products from an Authorized Dealer and then attempt to resell those products, you have caused a breach of the contract between The North Face and its Dealer.

      This is odd, if the dealer doesn't want to breach their contract with North Face, then they shouldn't sell to resellers. If you purchase from a dealer, how can you (as the purchaser/reseller) have any role in the contract between NF and the dealer? It seems they're blaming you for "causing" the dealer choosing to breach their contract. This seems absurd!!

      Yeah... it's my understanding that they protect the Kevlar brand so aggressively to avoid any confusion or misuse, as it's basically a life or death issue, being heavily used in things like bulletproof vests used by law enforcement and miiltary.

      You can use the word "Lined" in the title and most buyers will know that it means Kevlar.

      armored is a way to address it , but the motorcycle 🏍 clothing that uses it has a Kevlar tag just like goretex but if you use in a title DuPont will have it taken down fast like 24 hours or less

    Omg I didn't think about not copying the description from the site.
    I had a mercari listing taken down due to intellectual property for a Y2K purse an I had a picture of a magnet snap with a patent # but I have no idea why, I changed the title on other listing. An yes mercari threatened to shut my account down if I listed this item.

      I've quit copying descriptions from sites completely! Mercari warned me on a Thrive Causemetics eyeliner and took it down. I had used 2 stock photos in addition to mine and part of their description. Very scary for a newbie lol
