Administrative Law in Two Hours

  • This video moves quickly through an entire undergraduate Administrative Law course in (just over) two hours. The focus is Australian Commonwealth level administrative law, but the materials work just as well for the states and territories, and they should be at least helpful for most overseas systems derived from English common law.
    The video commences with a rationale for administrative law, before discussing the common law writs of certiorari, mandamus, prohibition and habeas corpus. We then discuss natural justice at some length, before looking in some detail at the statutory scheme for challenging decisions (under the Administrative Decisions (Judicial Review) Act 1977. That takes up much of the video. Finally, we look at mechanisms and institutions for review, including statements of reasons, freedom of information, internal review, the Administrative Appeals Tribunal, the Federal Court and the Ombudsman.

    I have been sitting looking at my admin law final assessement overwhelmed and confused after a very intense semester examining it. I stumbled upon Anthony's lecture and a light went off and it all started making sense. I have following his simple, yet concise, breakdown of the ADJR to do my review section.     Thumbs up on this one. It is an achievement just being able to make a presentation that good. Ask anyone who went to a college and had to do that. I spent 2 years after leaving school sitting through hundreds of hours of business and law lectures. I checked up on court proceedures and I have been involved in several legal cases concerning money. The first judge I encountered was winging it. My solicitor threatened him with hab corp and he changed his mind on the spot. I have been to three colleges and it is always the same, History; language and law. He explains the language in my opinion very well.

      You're most welcome! I don't really have a reading list of secondary sources, other than the cases cited in the video, and any of the standard administrative law textbooks.     Hi Anthony, love the videos as I am going into year 1 of uni and have been watching all the 2 hours videos. My question is, the cases you are referring to are not going to apply to the United Kingdom, or will they? I understand our jurisdictions are quite similar. Thanks so much 👍

      Hi Abdul, lots of the cases cited are UK cases. And certainly the earlier material, about the common law methods such as certiorari, mandamus, etc, will be relevant to the UK. However the ADJR Act obviously doesn't apply in the UK. This will still be a helpful video, but mostly in terms of general concepts rather than specifics. Very best of luck with your studies!

      Hi Sasha,
      The material on constitutional law will be completely different, because Australia has a written constitution and the UK does not. For Admin, the principles are identical in each country, particularly around issues such as mandamus, certiorari, prohibition and natural justice. However I don't know if the UK has an equivalent to the AD(JR) Act. So proceed with caution :)

    @ ~0:20 you got that right. Administrative law is a "priestly" subject. It is the domain of the eunuchs, scribes, clerks, bureaucrats, and priest actually ruling over We the People. Guess what and ponder this, here in Los Enados Unidos (presently English for The United Sates,) and especially here in Pennsylvania, We the People have a right to trials by jury.
    The notion that glorified clerks dressed in a robes can judge me on anything whatsoever is an anathema to me and contrary to my rights enshrined under the both the Pennsylvania and federal constitutions. Anywho

    Al-Kateb is now over ruled by the Highcourt in NZYQ of 2023 where the Highcourt departed from is Al-Kateb decision and determined that unless the Commonwealth is actively looking for another country for a detainee to be removed too, it is Unconstitutional to keep them in immigration detention.

      That's almost correct; the HCA actually ruled in NZYQ that the specific provisions in the Migration Act were beyond the constitutional power of the Commonwealth Government in circumstances where there was no real prospect of the person being removed.
      However in this video, al-Kateb was not cited on the question of constitutionality of the provision; it was cited to show the enduring importance of habeas corpus. And given that the applicants in NZYQ were released on a writ of habeas corpus, NZYQ really just enhances the point I was making by citing al-Kateb.
      You'll appreciate I hope that an immense amount of work goes into these two hour videos, so I can't amend them every time the High Court changes its mind about stuff :-) Hopefully people will note the upload date and understand that the video represents the law as I understood it at that date.
