  • In this video, I walk you through how much money workers' compensation allows for Stipulation with Request for Award settlements. I share a chart with 1%PD to 100% PD values for max earners for dates of injuries 2014 to 2023. I reveal the rate of payment of these awards. We also cover Life Pensions which are applicable for people with permanent disability of 70%PD to 99% PD.

    In other words when Filing for Worker’s Comp. You the injured worker is screwed you lose everything and don’t get compensated for nothing and still can’t do the job you used to do or make the money you used to make. Don’t get me wrong you put out great videos a lot of good information

      The last time california workers come had anything to do with reform was When Arnold Schwarzenegger was in office.
      And that is the payout you still get today. Think about it is that fair

    Your videos have helped me a lot in understanding the whole workers comp process…I was stressed with a ton of anxiety because I was clueless…
    I wish I knew you before I grabbed a law firm contact from random online search…Most of these firms out there don’t keep their Clients in-touch and informed about the process…A ton of us (injured workers) are out there with Attorneys but we are clueless about what’s going on in our cases…
    Let’s say your MMI report is out, can you continue working with the employer with the modified restrictions until the C&R is approved??

    California here, My case has reached a point where my lawyer tell I have to leave my medical future open or get a monetary settlement.
    My second surgery has been denied by the insurance based on independent doctor report, states doctor said I need a surgery and primary doctor said I need a second back spine surgery as well a second opinion doctor said also.
    Permanent disability beneficies advances has ended. If I get a settlement and close my case, and in few years after I seek medical treatment I have to inform medi-cal I got a monetary settlement? (I know they got a report if I get money) What is my legal obligation or responsibility if I seek medical services in the future from a medical insurance whether it is a public or private medical insurance? My lawyer is not helping with that question. Please I will take this as mere informative from you.

      In general, once you settle, you don't tell anyone else about it. It's not taxable income.
      Except two things, if you are eligible for Medicare or will be in 30 months at the time of settlement, you must inform them. Whole can of worms there.
      And if you are receiving need based benefits that require income knowledge to qualify. If that is MediCal then you may not qualify next time they certify you. But that's more a MediCal question not work comp. That's probably why your attorney couldn't answer. I would call their office and ask them.

      @@GonzalezLawEmpower Thank you so much for what you are doing, with this very informative matter. I have inform Medical about my settlement and they say it wont affect my public benefits, at same time medical told me I need to inform the insurance my injury was at work and got a settlement from workers' comp. But my medical insurance no answer my phone calls to express my question if I have to pay or co-pay for my future medical needs in this case a very expensive back spine surgery. Thank you so much.     Hi mam i am from india, i injured wn i am working in iraq LOGCAP V program with vectrus company, my insurance is not paying anything, i quit my job, i was contacted one of lawer from us he fild case 4 months back, but still i didn't recieve any thing, wn i am asking my lawyer he is telling u r insurance company is not responding, i am working with DOL, can u suggeste me best way to get my case settle..

    Wait now I'm confused my friend had a never to fusion and she got 150,000 on her settlement I have an ongoing case and my doctor told me I am 11% with my lumbar laminectomy with future surgery we're still waiting for the report of the state doctor so you're trying to tell me that morning going to get $9,000 after all I been thru 😢

      11% WPI or PD? This is stipulation settlement only. If you settled via Compromise and Release, you would get PD plus the value of future medical.

    Heyy Gonzalez,
    We need help! My mom, who's in her late 60's, in California injured her back at work while lifting a patient without a back support belt. Her case manager informed her that if she filed for workers' comp, she'd receive $5k. She's concerned this might not be enough to support herself. We're unsure if the case manager is giving her this information to benefit the company or if it's genuinely accurate. Also, if she files for workers' comp, will she still be able to work at her second job? And could this impact her overall employment status?

    My qme rated me at 100% torn ACL an wrongfully termination they offered future medical treatments an a voucher thats all i know of now i wonder what a case like that can settle for

      Are you sure it was 100% industrial ie referring to the apportionment and not the impairment? Or maybe lower extremity impairment instead of whole person impairment. IF you had your leg amputated, it would not be 100%, so I don't see your knee alone could possibly be 100% PD.

    So I crushed my finger at work causing it to be broken so after 7 months of it not healing I was recommended to have surgery on it to where the took the peace of bone out and some nerves because I had formed neuromas so I have had over 24 therapy sessions and now my therapist said I most likely have permanent nerve damage this is been going on for over 2years now so what do you think my outcome is going to be? And will I be compensated for all this

      That sounds horrible. I'm sorry.
      Sounds like you will probably have some permanent disability. The doctors will value the amount using the AMA guides. Might use loss of grip strength or another metric.

    Are temporary disability payments also credited to the insurance company and deducted from your settlement or award? Or is it only the Permanente disability advances?

      TTD is not credited unless there is a duplication or overpayment. I have a video on these types of credits.

      For max earner, 70 to 99 percent you get the amount on the chart paid out biweekly until done. Then the smaller life pension amount begins. For 💯 , you get your TTD rate for life.

      No, the amount of permanent disability depends on how much you have recovered. If you recover completely, you may not have any award. My video next week will explain in detail.
