    Each cop should pay a fine for false detention (not the taxpayers) then they would learn the laws

      Every suit won should be paid by ten percent from each officer present. If it doesn't total one hundred percent the rest can come from the citizens.

      @@frankvandalen6524 Why should I foot the bill for their incompetence? Is it not my tax dollars that paid for the crappy training in the first place? So I should pay for them to be poorly trained, and then pay again when their poor training is poorly executed? That makes very little sense to me. In my industry I can be held personally liable for acts of bad faith and certain transgressions. They'll sue ME, not my company. I carry 100% of that financial burden. In my job, the absolute worst possible mistake won't come anywhere close to escalating to a point of someone dying. But I still risk taking that liability on personally should I make certain mistakes. The penalty for violating someone's constitutional rights should probably rise above the penalty for failing to issue a settlement within deadlines. But it doesn't.

    They stop and detain you unlawfully while pulling a weapon on you. That somehow translate to them helping you. You really can't make up this level of aggressive stupidity.

      It's common police behavior when police arrive in groups there's always some who want to (out cop) the other cops. That involves purging/handling issues with the gun.

      Or for sure somebody should check to see if he officially declared in a written statement that he drew his weapon which he's supposed to and then if he didn't they need to go over all of his records of any of the incidents he's had and throw out anything that's suspicious and maybe look in the firing him . Once they pull their gun they get to do a bunch of paperwork if he didn't and that department does nothing about it I would look at the police Chiefs. We need more good cops in our country not John Wayne's

      Just Remember That, If you are black and or a minority and you are stopped by the police at night where there are no witnesses around, Standing Up For Your Rights, Could Very Well Get You Killed Or Beat To Death, Raped, Or Come Up Missing.

      Literally just watched a video of a cop doing exactly that. He stood there for an eternity demanding ID from a guy to see if he's legal to get into his car and drive.

      There was no reason for the officer that had his hand on the taser. However I blame the news for all the hype they have and putting fear in the people which causes these type of reactions. When we call people to be honest and moral maybe we can handle this a lot better. Everybody wants to be a rockstar with somebody has to wash the dishes

      Frankly speaking, I am curious if the citizen should have been legally "in the clear" to engage the hostile threat, or alert the cops to the situation and then charge them with some form of criminal negligence if they didn't act in the course of interdiction on the citizen's behalf.

    Sir, I want to thank you. You helped me survive an encounter with the police.
    I was in my vehicle watching a movie on my phone. Two cops approached me and asked me to ID. I responded with the question of what law am I suspected of breaking? The cop said none. So, I said I’m confused. I asked him if he was a law enforcement officer sworn to uphold the law? He said yes. So I replied, ok, you just that you don’t suspect me of breaking a law. I don’t understand why you are even talking to me. He replied, have a nice day and did the walk of shame.
    Anyway thank you for educating me you are a stealy eyed missile man.

      Ok, honest question here:
      The cop could have reasonable suspicion of open carry without a fishing license, right? If I understand it correctly, open carrying without a license is a crime in Florida? I mean, otherwise everyone could just open carry with or without licenses willy nilly, defeating the purpose of that law.

I do feel that open carry is somewhat different than driving a car though, since the former only allowed in certain specific circumstances, but I see your point. I guess seeing someone who looks like a minor driving a car is reason to stop them, that would be a more reasonable analogy, no?

      @@sipjedekat8525 that's up to the officers discretion, but it's also possible if you brought the issue to civil court the judge/prosecution may see the young person and think she doesn't look to young and therefore don't find it reasonable suspicion, I think it could go either way.

    I understand that you need a fishing license to engage in the act of fishing, but for these police officers to detain these people in order to get a member of the fishing authority to confirm that they do have a fishing license, while they're traveling to fishing....is the equivalent of a fish and game warden detaining them on a parking garage elevator to wait for the police arrive to determine if they have a valid license to drive a vehicle.

      In Texas, Fish and Game are fully licensed police officers and do not need a city cop, sheriff… etc… to check your drivers license…. Or give traffic tickets or make arrests. However, the opposite isnt true… only a game officer can check ur fishing and hunting requirements…. Dont know bout Florida. But I agree with ur point.

      @@Fr33manTV I don't feel TAF did anything wrong. Odd opinion. Being agitated doesn't make him a threat. Being agitated isn't illegal. He knows he did nothing wrong by law so he stood his ground and had some attitude about it. So what? Keep in mind, he isn't law enforcement. He has absolutely no reason to be professional or nice about things. They do. They have a policy they must follow and laws they are meant to uphold. No law was being upheld here. They were trying to violate each persons rights. They are the ones committing crimes.

      @@HowardCountyObserver Have you ever heard the expression, "You can chew gum in church?" Not breaking the law is the bare minimum standard for conducting oneself in the world. There are thins you can do but shouldn't, like mouthing off to people you dislike.
      Basic rules of etiquette. If he had followed the golden rule, he could have asserted his rights with class and kindness.

    8:49 "I cannot verify that it's valid or not." -- He is trying to shift the burden of proof from him having to show that the license is invalid (i.e. that an offence is being committed) to the man he stopped having to prove that it is valid (i.e. that he is innocent).

      So when you’re carrying a weapon but you’re also wearing a helmet and what appears to be body gear I can guarantee you cops will do their job to investigate just as if you’re driving down the road and you’ll see somebody holding a weapon or carrying a weapon on their body and with body gear we wanna make sure that everybody is OK so POLICE yes we’re going to make contact with you and have a friendly conversation with you just to make sure everything is OK. You may not like it, but when you know you’re out there doing this purposely to test the cops tying them up when they may have other calls to attend to but you want to be in Cooperative instead of letting them know what you’re doing these are police officers were doing their job if they didn’t make contact and make sure they would be doing the job they’re not there because they wanna bother you or her rescue. They are doing their job. Shootings, including mass shootings occur frequently so you could understand even more reason why cops will do what they have to do to protect people again you have a gun open carry or not POLICE can make contact with you.

      Complaints may work, but suing will not until qualified immunity is gone because the cops don't lose the money tax payers do. When you sue the cop still gets paid by the taxpayers and the suit is paid by the taxpayers. Hats off to the states that have ended qualified immunity,but this will be a problem until it's ended everywhere. It's high time armed state sanctioned agents of extortion and violence carry the burden of paying for they're activities instead of the taxpayers.

      So when you’re carrying a weapon but you’re also wearing a helmet and what appears to be body gear I can guarantee you cops will do their job to investigate just as if you’re driving down the road and you’ll see somebody holding a weapon or carrying a weapon on their body and with body gear we wanna make sure that everybody is OK so POLICE yes we’re going to make contact with you and have a friendly conversation with you just to make sure everything is OK. You may not like it, but when you know you’re out there doing this purposely to test the cops tying them up when they may have other calls to attend to but you want to be in Cooperative instead of letting them know what you’re doing these are police officers were doing their job if they didn’t make contact and make sure they would be doing the job they’re not there because they wanna bother you or her rescue. They are doing their job. Shootings, including mass shootings occur frequently so you could understand even more reason why cops will do what they have to do to protect people again you have a gun open carry or not POLICE can make contact with you.

      Learning at a young age about law would be great, except sadly too many young people are scared of police by their actions not what was taught. I say all "officers" need to have at least an Associate's Degree in Criminal justice instead of just a diploma and no felonies. If they want to get promoted, get a bachelor's degree and so on.
      Nurses have to do it to become doctors, and so many other professions do as well, but the people we come in contact with the most are more uneducated than the people they swore to protect.

      @@daver9643 they have to have a reasonable, articulable suspicion of a crime having occurred, currently occurring, or about to occur.
      The right to keep and bear arms is to not be infringed. That's literally the 2nd Amendment. Even St George Tucker has a quote attributed to him that American men would not even think about leaving home without a rifle or musket as much as European fine gentlemen of the time did the same with swords.
      Sorry that the Second Amendment seems to bother you and cops, but the free exercise of rights isn't a crime- Deprivation of Rights Under Color of Law is, though. See 18 U.S. Code § 242.

    He sees the guns, but he also sees the fishing rods.
    So why does his cowardly buddy have his gun out?
    Then the cop tries to go a different route and ask for a fishing license. For what purpose? To see if you’re ‘over limit’? There’s no fish, and until you are actively fishing , you do not need a fishing license.
    (I leave me car, pull out my fishing gear and gun, walk to the pier. Lots of piers have bait & tackle shops, where I can buy a fishing license. You don’t need a fish license to walk to your fishing hole.)
    Even calling out fish & game, fish and game has no right to demand a fishing license just because I have a fishing rod while walking. I could have just bought a fishing rod at Walmart, it may be a gift for someone, I may not even like to fish. So why would I need a fish license. Unless I’m actively fishing.

    Wow, I grew up with “Leave it to Beaver”!!!!! I was taught and believed that the system works. I was taught to honor and respect police officers. They were never wrong!!!
    Until I was beat up by a 3rd degree brown belt karate instructor, they were 300lbs. and I was half that. There was an unloaded single shot shotgun on a kitchen counter aimed at a blender. I’ve never had a ticket but when the instructor grabbed the unloaded weapon, beat the crap out of me, pointed the gun at me and my children, and called the cops, I was arrested because I didn’t know any of this. 10 years in prison even when my daughter told the jury she never felt threatened until their “Mother” grabbed the gun and pointed it at everyone!!!!
    Now my life is over with. We live in a horrible time and I can’t protect my new wife. Thank GOD I have 2 viscous dogs at home, but how what about when we leave the house????!
    I never thought the system was so injustice. Thanks again for all your hard work!!!!!!!!

      Wow 10 years in prison for doing nothing.? You must have had a jury trial so I'm guessing the prosecutor in the 12 jurors were all terribly mistaken as to what happened. And reading through your story I guess your wife was 300 lb and a third degree brown belt in karate. Either you totally got shafted, or there's more to the story.

      @@sur-real3416 That is sad to call someone out like that when they just said something that was never asked. Is a guilty person going to go to court without ever being charged and say "I robbed a bank"? You must be a cop, or have a lifetime supply of boot polish.
      When you have major charges on you, it is the prosecutor's job to scare you into taking a plea. MOST court cases end in pleas because prosecution and court appointed attorneys are there to dissuade you from being free.

    At least 6 cops standing around harassing these law abiding citizens. Either this city is grossly overstaffed (since these officers obviously have nothing better to do) or some poor citizen who needs police assistance is going without help because half a dozen officers are needed for this imminently dangerous situation involving peaceful, armed fishermen. I support good cops and believe in supporting them 100% but these officers are an embarrassment to the profession. They should know this law by now. They've all been warned in training about 1st and 2nd amendment auditors.

      So when you’re carrying a weapon but you’re also wearing a helmet and what appears to be body gear I can guarantee you cops will do their job to investigate just as if you’re driving down the road and you’ll see somebody holding a weapon or carrying a weapon on their body and with body gear we wanna make sure that everybody is OK so POLICE yes we’re going to make contact with you and have a friendly conversation with you just to make sure everything is OK. You may not like it, but when you know you’re out there doing this purposely to test the cops tying them up when they may have other calls to attend to but you want to be in Cooperative instead of letting them know what you’re doing these are police officers were doing their job if they didn’t make contact and make sure they would be doing the job they’re not there because they wanna bother you or her rescue. They are doing their job. Shootings, including mass shootings occur frequently so you could understand even more reason why cops will do what they have to do to protect people again you have a gun open carry or not POLICE can make contact with you.

      @@daver9643 This whole pile of nonsense flies out the window when it stopped being more than 2 cops. When it became more than a 1 minute conversation. When they drew their gun on them. When they called another agency in to do something that agency had no legal authority to do if they even got there. The reality is @TessaJoy is wrong when they say they were warned in training, they weren't, cops study constitutional law for 1 weekend out of the 3 month academy. They literally don't know your rights. Nobody is required to just be cooperative when they're asking you surrender constitutionally protected rights.

      In some states, if your shirt pulls up when you reach for something on the top shelf, and someone sees it, that is considered brandishing.

      @@MattU4970 Do you have a link to that case? It's not brandishing anywhere I know about. (However, you might be thinking of a different crime. If you are not allowed to open carry, but are carrying concealed, and your gun "prints" on your clothes or it becomes exposed, that could be illegally open carrying. For brandishing, there has to be a threatening gesture. So deliberately flashing your gun, for example. Or un-holstering your gun and putting your hand on it. This cop is illegally brandishing. They don't get to do that either just because they are cops.)

    Thank you so much for highlighting that last part of the requirement for detaining an individual as a detainment is an arrest by law. Reasonable Articulable Suspicion of a CRIME. It is actually RASC but everyone tends to leave out the last letter which is where the claim of ignorance and I didn't know I wasn't allowed to do that come from. By purposely leaving out the last part in training the plausible deniability is allowed as most are too afraid of people with firearms on their hips, with bonds that allow them to use the firearm in public, to assert the authority over the public servants that they lawfully have.

      @@HowardCountyObserver That is a question worth introspection. The Magna Carter is what is the foundation for the United States Constitution for America as there was already the States, they just weren't united. After doing away with a Monarchy which is really just a dictatorship that sounds better, the same rights that the King had were given to everyone i.e. "Life, Liberty and the pursuit of happiness." That is Sovereignty (the power to control ones self without interference) and why the men and women of land are Sovereigns. That is how we get governments.
      If you want to trade with someone who has the same power and position as you, it is necessary to come to an agreement of how things should be done. If there are a lot of people well that's where government is created. That power to do anything as a government is only there because the people together allow it. That is why they are public and cannot be private.
      That same power has been skewed, reshaped, and morphed into a fictional character. There has been a push by people placed in positions to do the peoples will to circumvent the people because of, "expedite the process" which takes the people out of the control position and leaves no oversight. By law, EVERY COURT CASE MUST HAVE JURISDICTION PROVEN BEFORE IT CAN SEE ANY LEGAL PROCESS. The right to even have any say so in the matter must have evidence.
      The legal standard is an injured party for Common Law or broken contract/agreement (injury to a party) for Admiralty Maritime Law. Only one is for the people, the other is for business i.e. Private or Public.
      We have let the business of state actions become the norm for everyday life. That slow implemention of the business we own together into everything without making sure to keep the people educated on what those who you employ can and or can't do has allowed them to do whatever they want. So I don't think it is so much so laziness as it is planned superiority. Most of our nations ques are taken from England which is a Monarchy even though that is exactly what we don't want. England still control a lot of what we think is right at a social level to include our Television programs paid for or not. We fought to break away only to become the same much like some children don't want to be like their parents only to end up almost exactly the same.

It is a part of America. In our laziness, we exclude the U.S. part and go around calling ourselves this when everyone in the Americas is an American. Named in 1507. The land across the sea. What is important we often forget. We are U.S. Americans. Yet we have to slap the America sticker on everything we see and touch. I find it disgraceful. We all have our rights and can call this country whatever we like. I prefer the truth, myself.
      Anyway, what you said is spot on. We copied the very thing we ran away from. History shows us that. The fact so many choose not to see it means it will be repeated.

      @@HowardCountyObserver I mostly agree with your assertion, but I take issue with one portion. The territory of the Americas that is claimed by the United States is just the States. When it Constitution was created it incorporated the States that were now united into one essential business goal while maintaining their independent personal goals. They would all live under one superior supervisor set of rules(laws) to keep everything running smoothly.
      Yes it is lazy to just say, "America" when it's actually, "The United States" as the America includes Canada, Central and South America since it is all one land mass. We are only in control of one section and not even the largest portion. To be an American citizen, since that is the corporate name, relegates that individual to a servant status of the government making it and anyone who works for it, your superior. A mere citizen is the lowest level of employee one can be. It's the reason, "qualified immunity" works because that employee is your supervisor.
      We are not merely, "United States Americans" though as to say that would negate the who reason for the Boson Tea Party, the Revolutionary War, heck even leaving England. Every man, woman and child is an individual who has no elegance to other outside of the bonds they create. The liberty maintains the freedoms. "A man is his own King with no one to rule but himself." I forget the case law that made reference to this point but their can't be be no United States without States united and their can be no States without the men and women who dwell on the territory willing to agree to be a part of it. Constitutions are just social contracts and everyone, "....has the infinite right to contract" or to not contact. That is either Hale v Henkel or Simms v Ahern can't recall at the moment.
      Sorry for my rant. I tend to get a little enthusiastic when discussing the law. But like I previously stated, we hurt ourselves when we do rush to do things out of "convenience" rather than do it properly.

      They’re going to remain silent in regards to the cops questions. They use their 1st amendment right to point out the stupidity and ignorance of the cops. When you understand how to judiciously use your right to silence it’s not hard to understand

    Thank you Abiyah! I really do love your videos, please keep posting them on RUclips, because it's what cops have been doing this for along time. I have been saying what the police have been doing is wrong and when I have been saying it I'd get told to be quiet. But being quiet to me means that I am following their rules which to me I didn't follow their program because speaking up to them is against the law. If you don't follow their program you end up facing the consequences. Abiyah I think you are doing such a great job at what your doing informing people's rights. Please keep it up because I enjoy watching them. I feel that you should also get into law school, I feel you would be good at it. This is what I'm feeling about what you're career is looking at, I have a lot of spiritual gifts and this is what I'm picking up on, I can sense it just by watching your videos.     Every law enforcement officer there needs to be in prison for life without the possibility of parole and there are two victims need to be awarded their pensions. This punishment is fair and just for any public official who swears an oath to uphold and defend the Constitution of the United States of America and then turns around and violates someone's rights.
