    I bought a property that was "grandfathered" as a non-conforming house on a small lot. The restrictions were that I could not tear it down and rebuild or add to it but I could repair the house that was already there. So I repaired the house and lived in it for 5 years. Then I bought a piece of property from the neighbor and added it to my deed. The township said this satisfied my request to build on the property since it was now a legal lot size. So I built another house for myself and rented the original house. Twenty-five years later the township said I was not allowed to have two houses on one lot. Upon appeal they allowed me to separate the two properties back to their original boundaries. My new house is on the new piece of property that was added to the original and the old house is on its original piece of property. I think they chose this route because they cannot prevent me from using the original grandfathered-in property as it was being used originally. Usage rights for non-conforming property that was conforming at the time of its inception/creation continues to retain its right of use throughout property transfers/sales.

      Thanks for the comment! Sounds like your experience is somewhat of a change in admin with the city but I agree and have had similar experiences. I have a property now that is non-conforming and I wanted to change the driveway to make it more accessible and was denied a permit. I was told I could not make any changes to the property. Maybe I will try again in a few years.

      If you need to add to the property or change it somehow in order to comply with a different law (such as making the property ADA accessible) then they must allow the change. That's the angle I would take. Good luck. @@pinefinancial

    I need a bit of help! I’m almost at close on a property that is a legal non conforming grandfathered property. This wasn’t disclosed by the owners. The appraisal disclosed it. Now I’m scared. It’s a 700 sq foot house on an 8700 sq ft property. I cannot add an addition out or even to remodel the outside for an over hang. I cannot even add a shed for storage .. I *was* planning on buying and living in it until the upgrades were made, but now I think I can Airbnb it as turn key and maybe just add a deck. I’m kinda scared of making this plunge.

      Oh No! Glad you found out before closing! Appraisers usually call the city or county to confirm the status and zoning of a property. But it might make you feel better to hear it directly. Call the city or county and confirm the zoning and that your property is legal non conforming and grandfathered. When you are on the website and/or the phone with them, you should be able to ask what you can and cannot do to the property. That way you will be prepared for the remodeling you can do and the permitting process. The more you know about the zoning etc, the less scared you should be with moving forward.

    Hello!
    In the video I believe I heard it said that if you buy a multifamily that's zoned for a single family home, you could still rent both units out? And you you just need to worry then about other factors such as the driveway situation you mentioned? I had assumed if it was a multi family not zoned for it then you wouldnt be able to so just wanted to clarify.

      Hey Kid Freshie! Thanks for the kind feedback! Kevin is kind of a Noob and doesn’t have much to share but we keep him around casue he is the only person we know that can grow a full beard in just 2 hours! The video was a few years old and Kevin has learned a few things since then, if we re-shot the video, what would be 1 or 2 things you would want to get out of the new video?
