    The entire encounter was videoed by the dash cam and badge cam, yet they have been "investigating" the incident for 2 months. It usually takes a cop about 30 seconds to decide that one of us proles has done wrong, cuff us and haul us off to jail.

      I am but taking up for his stupid mistakes that should be dealt with but a parking lot is not outside of police authority.

      I never mentioned stop signs.
      I also mentioned that she might have meant that “most traffic laws don’t apply in parking lots”.
      Stop signs are included in most traffic laws.
      Since you seem inclined to want to discuss the subject, a person running a stop sign in a parking lot, speeding, etc., with additional facts, can justify a detention or even an arrest under Texas law.
      Merely cutting across a lot and the lined lanes or ignoring the stop signs? The police have no such authority in Texas. A blanket statement that traffic laws don’t apply or the police have no authority is completely incorrect.

      @@tvc1848parking lot is 100% outside their traffic law jurisdiction. If you think a cop has jurisdiction in a private parking lot, then you’re arguing that a cop can ticket you for backing out of your driveway because you accidentally tapped your wife’s car or just moved your car to the side without signaling. That’s not how it works. And private is private. There’s not distinction between residence and business. Unless the business files a claim, he has zero jurisdiction to issue traffic citations for traffic violations in a private lot.

    They better put him through some very extensive retraining and psychological evaluations because this is EXACTLY the kind of guy who abuses his power and stomps all over the constitutional rights of those he's sworn to protect and serve. This is the guy that not only gives the whole department a bad name but gives police in general a bad name. This guy is one incident away from full-blown police brutality. If you can't swallow your pride and back down when you may be wrong, or at the very least just give the ticket and walk away professionally, and allow the guy to challenge it in court, then you don't deserve a badge and a gun. I once had a police officer pull me over for speeding. I was speeding. About 4 miles an hour over the speed limit, and I just wasn't paying attention. However, he was coming from the opposite direction and as soon as I saw him, I instinctively looked at my speedometer and that's when I realized I was speeding. So I was prepared to get pulled over and ticketed as soon as I saw him make a U-turn and put on his lights. When he walked up to my window he was super polite and professional and he asked if I knew why he pulled me over. I said I wasn't sure (never admit anything folks). He told me he clocked me going 15 mph over the speed limit. I was so surprised, that I did something I have never done before and I said, "Sir, I don't mean any disrespect and I have never questioned an officer before, but when I saw you coming, I instinctively glanced at my speedometer and saw that I was speeding but I was only going 4 mph over the speed limit". I was really nervous about doing that, but there was no way he clocked me correctly and I couldn't just sit there and not say anything. He said, "ok, give me just a second". He took my license and insurance back to his car and came back with a warning. He reminded me to drive safely and said have a nice day. I was so pleasantly surprised at the interaction! He didn't get offended, he didn't argue, and he wasn't all incensed that I would dare to question his take on events. And he actually gave me the benefit of the doubt when he checked my record and saw that it was clean and I didn't have other tickets or a history of speeding. He could have ticketed me for speeding still, but I was sure thankful he didn't! This is how officers should be. You're not the final and unquestionable authority on all things. You work for me and the rest of the taxpayers. Don't be an a$$.

      See thats the problem, why do it?? Learn to be patient, ppl out there showing they kids that same trash attitude. U really only get like 30seconds ahead by doing that, I've had ppl do that infront of me just for me to fund them at the next red light. And when ppl do it they speed through that parking lot.

    Buc-ee is private property. Unless some one called or he had pursuit into the parking lot, the officer has no jurisdiction on the property.

      Are you sure he has no jurisdiction on private property? What if the officer witnessed a shoplifting inside the store as he was making his way to use the restroom? Or an intoxicated person getting into their vehicle and attempt to drive out of the parking lot? If he witnesses an assault does he not have the jurisdiction, and authority, to intervene? Any sort of crimes committed on that piece of private property can’t be ignored by the officer so therefore he does have jurisdiction. State laws don’t end where private property begins. The property owner doesn’t have to summon police for them to be able to act upon a crime/infraction they witness.

    Its not about the ticket getting dismissed, it’s about how law enforcement do not get or have consequences when they violate the law. Law enforcement are trained professionals and should know the law or get out if the profession. If i was a blackbelt and I killed someone in self defense, I would end up in jail in a heartbeat until my court date. Law enforcement must be held accountable each and every time and stop using taxpayer money to pay for their crimes.

    Awesome! Seen this encounter on Audit the Audit and a couple of other channels. Given the perspective seen from this video I would have been way more "confrontational" than the victim of arrest/ illegal detainment. I've had worse encounters/ close calls on privately owned parking lots and never felt myself or another party needing even a warning, much less what happened in this encounter. Also keep in mind a "traffic control device" is only a legal term that applies to public roads, not private property

Noncompliance to an officer’s instructions is a warning to the officer that this person that he doesn’t know could be a felon, have a warrant, or is on parol.       No, I heard what this crazy officer had to say and it was RIDICULOUS.
      He LIED about what happened (it was on video IF you even looked at it).
      Yeah......he doesn't KNOW a lot. That doesn't mean everyone who doesn't bow down and lick his boots has a warrant ! And being on parol doesn't change the fact that they were on PRIVATE PROPERTY .....on a big parking lot that was largely empty. NO near accident almost happened. This guy complied with the officer but did not agree with his LIES...... That is why he arrested him, fool.....

Texas Municipal Police Association (TMPA) "notified the decision was being appealed", on 9.02.2023. Chief Cravens says "we are committed to rigorously defending this decision to ensure that our department maintains the integrity and transparency you expect and deserve". TMPA has +30,000 members and about 788 municipal police departments. Where you at Texans?

    There is nothing wrong with taking time b4 issuing charges IF POLICE OFFERED THE SAME FOR EVERYONE. The behavior of this officer and the delay in charging their officer shows us how dangerous police are to feeedom when stroking their ego is more important than their oath and obligation to the law.

    Officer made an official report that was false, arrestable offense...yet he remains free. Months later still under investigation.. he should be decertified, fired,arrested and jailed . Official misconduct, breach of public trust, false reporting, false arrest, 2 rights violations of this guys civil rights, free speech to address his grievance with a government official and unlawful seizure of his person. Officer did what he was trained and obviously does on a regular basis to the citizens of the state and tbose that pass thru. Chief should be held accountable as well...goes to show not many honest heroes in the job there and most places these days.

    The officers that write tickets that are dismissed should also be dismissed from their positions and not allowed to apply with another corrupt incompetent police force. Maybe they'll stop issuing bogus tickets just to tie up the legal system and teach a citizen the power of corrupt authority.

    I've had multiple interactions with cops like this ever since I was 15.
    I've never seen anything more fragile or bloated than a police officer's ago, trained to escalate non-threatening situations and always doubling down on being wrong instead of ever admitting fault.

      And if you read further down any enforcement on any private property has to be agreed to by the property owner petitioning for it.

    This happens often. Citizens need to realize that most intelligent people do not become street officers. Although they are very much needed, people need to understand their basic rights and be prepared to deal with the officers that lack common sense.

    Cutting through a gas station under the vehicle code section he tried to cite him on requires you to cut into the gas station and immediately out the other side there is one key element to that statute and that is when you exit the other side if you come to a complete stop it is perfectly legal.

    From what I understand in Texas cops can't give you a ticket in parking lots or shopping center parking lots due to the fact they are private properties. This is the main reason cops won't come take a incident report when you get a door ding or a hit bumper if someone reversed into your vehicle.

    It’s very difficult for officers to understand these concepts because they get indoctrinated with fear. Their training stems from everything being a safety concern for them with it being played out in scenarios to the point of life or death. This then translates to the shift and demand for all things “tactical” as it implements to practice on the street as they engage in their duties. The law enforcement culture that exists today wants desperately for their job to resemble a special forces operator in a paramilitary environment state side. This is part of the problem. Just look at their duty vests with multiple magazines available when their own history of police shootings don’t support a second magazine as shootings are low round exchanges as evidenced historically. That’s proven statistical data that is readily available. The law enforcement apologists will only want to point out the very very few exceptions to that, I’m aware. Beyond that, Little to essentially zero training is geared towards conflict deescalation, at best it’s touched on by introducing terminology at minimum. However even if those aforementioned areas were cleaned up in practice and training, it still would take a fundamental paradigm shift first and foremost of understanding that they are representatives of the government at large that is non sentient. Officers unfortunately take everything personal and have a “we must always have what we deem and perceive as control to win each encounter”. That’s the root of all these problems. It’s ran and treated like a business. It’s about showing activity and making arrests even when the entire department or division knows full well most arrests get plea deals or the prosecutors refuse to prosecute if probable cause is weak. Doesn’t matter because the initial statistics have been tallied to the score sheet. Officers need more training and more instruction and way more time in the academy before hitting the street, but they need to show warm bodies in uniform and present to the largely ignorant public that they are committed to “fighting crime”. The law enforcement community should be addressing these poor training standards and correcting the core issues but instead they’ve bought into the rhetoric that “nobody likes us or respects us and our lives are in CONSTANT jeopardy”. Most line of duty deaths could’ve been prevented but that statement is too harsh for these soft ego driven folks to hear. Law enforcement is its own worst enemy but they are too indoctrinated to look in the mirror, they’d rather point blame at a guy holding them accountable as the government representatives they are for infringing on his constitutional rights they should have as priority for all of us and themselves.

      Being a Cop is being in combat, ask all the Dead Police officers around the country. But it doesn’t stop then from storming a drug house loaded with drugs and weapons, saving a child’s life at a car accident, going into a burning building to make sure everyone is out. Some deliver babies, help the elderly living alone and afraid, don’t hesitate to enter a robbery in progress, or an erratic drunk who is threatening people on the street! Is’t it much safer to hide in your home and complain, until you hear someone breaking your window to ransack your safe haven?

Cop doesn’t even make the top 10 list of most dangerous jobs. FIREMEN have a dangerous job. Cops don’t. Combat is reserved for those that fight on the frontlines in the military. Not for revenue collectors who’s job centers around writing tickets.

      When you’re taught to be a hammer - everything looks like a nail. The number one cause of death in the line of duty is CAR ACCIDENTS. They use poor judgement and speed through red light intersections and engage in high speed chases when they shouldn’t. The hate cops feel from everyone in this country they brought on themselves.

    PRIVATE parking lot is the key word.
    He turned into the parking lot and had a purpose to STOP and get gas.
    He didn't just cut the parking lot to keep on driving.
    In a parking lot that is private traffic violations don't exist.
    Not had it been an accident like rolling a stop sign and causing a accident it would have been him at fault but again not a ticket for running a stop sign.
    Know you laws people.
    Private property is not state or federal roads.
