    I would think that 'rule of law' were as vulnerable to corporate as to state monopoly. Power corrupts regardless of how it was achieved.

    I'm a little shocked to hear the entire panel devolve into fretting over global warming. First, I assumed that one facet of the liberal vision was an inate optimism. Excluding Niall who is an avowed pessimist, why was nobody willing to say "given sufficient freedom to act we will find a way forward." Planning cannot anticipate innovation. That's the whole point. If we are to believe the worst case scenarios for CO2 induced warming, then we already have a "baked-in" change of x degrees that we just have to deal with. What that means in terms of sea level rise is literally anyone's guess. But to say that we don't already have the technology to deal with it is not correct. We already deal with tidal fluctuations of a couple meters. The sea has been rising for millennia. Some cities like Venice and Jakarta are sinking faster than the seas are rising. Atoll islands are happily building more coral at the impressive rate of one centimeter a year. Bangladesh has always flooded; that's what you get for establishing your cultivation on a massive river delta. Latin Americans are not fleeing from crop failures but rather political failures. Case in point: nobody leaves Costa Rica. Everyone leaves Venezuela. And one final point since China is the big climate bogey man. They are playing us through this crisis in a fool proof way: they agree to CO2 caps with the caveat that we can't criticize their internal, and possibly even external, affairs. Then they effortlessly plan their production targets around our international dictats for x technology that is absolutely required to "solve" the (supposed) climate problem. And as the cherry on top, they laugh at the stupidity of us voluntary relinquishing our energy independence. See: Biden cancelling pipelines and fracking leases. Bravo

    Question for Mr Ferguson to explain the apparent contradiction between his early Smith quote; "every piece has a principle of motion of its own altogether different from that which the legislature might choose to impress upon it." and his later advocacy for the "rule of law" Isn't the rule of law merely an attempt by the legislature to impress a principle of motion? Even If one limits his rule of law to property rights, the absence of property rights in China as he refers to is undoubtedly pursuant to the rule of law. Redistributive government programs are also violation of property rights under the "rule of law." Is the "rule of law" the issue or the nature of those rules.

    That thing about planning is so true. That is why large economies like Apple, Amazon, Google etc do not plan but have markets inside them to make all the logistic decisions. Like the good old trading floor..people screaming from all sides as to how many semiconductors to order for the next year..

    Interesting discussion gents, thank you.
    Although Harold seemed to rather misjudge the moment with his monologue - which tended to move the presentation from a fascinating lay understanding of Smith’s degree of prescience and relevance today, to something approaching a technical critique of a narrowly defined Doctoral thesis.
    Rather a shame, I thought.

    The colloquial definition of socialism for most non-conservative Americans, is government sponsored and or regulated education, healthcare, transportation, energy, water - the basic necessities of life, that one can not easily provide for themselves. This is what I think most common non-conservative Americans think of when they hear socialism. They see candidates who call themselves socialist, and who fight to expand the scope of this, and so they relate to them as a socialist. These candidate speak nothing of control the means of production. They see candidate speak to specific areas that government subsidy would improve their lives. They don't see any elected or viable candidates, saying anything more than this. The common person does not care what the academic definition of socialism is. It only applies in a classroom. This argument is in some ways similar to the stupid argument some Black people make over the word racism, as if they are also lecturing in a college classroom. Most Black people don't even care, what a particular definition of racism may be or has come to be. They see it as discrimination, prejudice, and bigotry. Even if all of us won't admit it, we all know that it is true. Obviously, we all have blinders on, over something.

      @@alharrison1038 Well, it will happen one day. I am confident. It took China 40 years to shorten the economic gap between US and China, it might take another 40 years for Chinese to be able really to walk out of "Party is the Law".
      I am optimistic, it will take shorter time than we can talk about. Look at the attitude towards law profession in China, Courts and Lawyers are more respected than in the past. During my time in China, elite students usually did not want to study law. We chose STEM at university. Party has been the law. You did not think you could achieve anything in that situation. Westerners usually do not have the patience. Chinese have patience. If our generation can not achieve it, the next generation, they will.

    You may want to consider Islamic principles of economics;
    1. The individual and the State are bound by rules that they both adher to volontarely and feels and assumes the responsibilte to defend them. The State or public interest authorities have no right to make those fundamental rules. They have the same and equal responsibility as an individual of upholding the same rules and principles.
    2. The individual human beign is not meant be a selfish consumer pursuing his individual satisfaction without regard to the satsfaction of his fellow citizens or the general public good
    3. Economic distribution is not considered a burden but a an individual and collective satisfaction
    4. Money should not be cosidered as real good or service that can earn money by the passage of time only. The only use for money is the the measure of the price, the payment of debt, and investment in the economic activity that is not considered harmful for humans, animals and the universe. Therefore, no interest on money. Savers can only invest their money, and be exposed to market risk, no guaranteed interest on loans.
    5. Disputes are resolved by a mediator or judge who is recognized in the community as a honest, competent, and impartial person.

    The fact that a political party is in a leading position does not mean that there is no rule of law. The prerequisite for a political party to continue to maintain its leading position is to govern the country according to law, introduce new policies, and constantly improve its own governance system and capabilities. Unlike Western parties that represent the interests of capital, capitalist society is capital It decides everything. The so-called democracy is only formalism. In fact, nothing can be changed.

    "No rule of law in China". Is a rather meaningless statement. The Rule of Law is coded and maintained (in theory by the UN of which China is an important member that supports and adheres to its Laws. The US and Israel more than any other regimes, do not always adhere to the UN rulings and continually vito proposals on issues that outlaw their exploitation, abuse, general war mongering, and pillaging across the world. The Washington plutocrates have invented their Rules Based Order which they introduced to surplant the UN Rule of Law. The US plutocrates make the rules and enforce them while when making said rules they include rules that exempt the US from the rules. China, Russia etc. do not accept these rules especially when they violate UN Laws/directives.
    It is surprising that Washington is not broadcasting to the world that it has less crime than China because it has imprisoned 7 times as many of its peoples per capita than China.
    Crime is big source of revenue for Washington that rakes in the best part of $200billion/pa in fines and bail charges, not to mention the profits from prisoners working for a few cents an hour. No slave labour or human rights abuses there?
