    The deadline to file a pedestrian accident lawsuit in Florida really means what is the statute of limitations for filing such a claim. If a pedestrian is struck in Florida by a motor vehicle and is injured, the pedestrian has to commence a lawsuit within four years from the date of the accident. Commencing a lawsuit just simply means filing a one- or two-page lawsuit, which is called a complaint, in court. The case does not have to be over in four years. It just has to be begun in four years. Now, if the pedestrian is killed in that motor vehicle accident, let's say killed right at the scene, there is a two-year statute of limitations in what's called wrongful death statutes in Florida. A lawsuit must be brought by the decedents estate within two years from the date of that accident.
