    The thing is whenever we see a police men we don't feel confident, we fear them. Although they are public servant to protect us but the image of police in our mindset is not trustworthy.

      It's different in America and other developed countries because of the stringent laws and better equipment for evidence such as body and dash cams. Corruption is almost zero and law is very flexible.

    Being a Lawyer I know that police have wide powers to arrest and to frame. So unless and until they exercise those powers sparingly and in a right manner they is no stopping of such incidences!!

    Sir one important question!!! We see day by day atrocities being committed by police on common people on the pretext of following orders from superiors.
    Do we, as common citizens have the right to hit back police individuals in our self defence in case they are physically assaulting us?

      If they are trying to give grevious attack on you, standard is 20 days hospital help is required to you. Then you are allowed to hit back under private defence.

    Great video as always, Amish Bhai please make a video on the incident that you discussed in Vinamra's podcast about the guy who asked the doctor for coffee date in which instead of rejecting directly she got him beaten by hospital staff as well as by her husband and police took him to the police station and lawyer took couple of lakhs for bail in a bailable offense this is a very common situation guys get into. what are the remedies the person have in this position against the Doctor, Her husband and hospital staff.

    Great. The police story through out India is same. A prudent man can't rend the situation and circumstances around him. Like a way injustice is growing very fast. I think present laws are insufficient against police acts or police are misusing the law. We as a common man can't fight against system. ...

      We asba command man should fight to change the law. For ex. Stealing by a common man attracts 6 months jail, it should be double atleast for those in power. It is surprising that law makers delibrately made such laws to protect those in power

    This is a really good information.
    Here we Indians consider ourselves very intelligent and talk about global warning, regional/international politics, war and crime. But we definitely don't have any knowledge at all about our Juridical system and how it works.
    We daily see news about some civilians getting man-handled, beaten, falsely accused. We think nothing similar will come to our way if behave like good law abiding citizens. Then when we get into these situations; Then Instead of seeking legal advice from lawyers, many pay bribes to officers and fall in their trap. This should Stop!

      However,
      (a) He seems to have a wide experience dealing with the police as part of his career.
      (b) In this video he mentions he has several friends who are in the police department and that he understands the pressure under which they need to work.

    Just another ground level advice - Whatsoever be the situation.. "WHATSOEVERRR" , never ever dream of physically or verbally abusing a police. They are pure goons and doing such may cost your life. I'm happy to hear that this person came out alive with just 1 year in prison and only 20k as bribe.

      exactly what i wanted to say. most American states have made it mandatory for cops to have a bodycam 24/7 when on duty. i doubt itll ever happen in india since police r the most corrupted body of this country. i feel like police in this country r completely useless, they dont do shit other than commit crimes

      Even if they have body cams, do you actually think they'll display info that criticizes them. If you get assaulted by a police officer, preferably, that video recorded on the body cam will stay with the police and go nowhere near the court or public. It's best you invest for a high end body cam for yourself, preferably a spy cam in the shape of a button on your shirt, along with a microphone will greatly cement your evidence. And never announce that you have recorded evidence during your first contact with the court regarding a complaint against said abusive officer. It's best you test the water first, if you observe that the procedure is going to be objective then bring out your recorded evidence, if not then lay low for a while and then anonymously release the video into the internet and observe what happens then, in India, justice is gained only if you have well established connections or your case has gained the attention and support of the " massive " public, your public support should be massive or it'll be easy for the system to kill the momentum for your justice . So don't go anywhere expecting you'll be served right, play smart and stay alive.

    Hi Amish. I am a great fan of yours, you very soft spoken which so much of clarity in your English language speech, very factual and transparent in any given topic of advice to your viewer's. I have had a lot of bitter experience of these cops. But they have never succeeded in their malicious, cos I always sycke these criminal in uniforms. Some of them have always asked me to compromise. I have said an innocent guy should compromise for what. I will come out clean from the law. And there you ask me for a compromise. I will take you and your I. O. to the cleaners.

    In the second case which you mentioned that the person gave Rs 20000 to the police. Is it a good idea to have a voice/video recording of the incident of giving money? Will it be helpful later in the bail application or in court hearing?

      It's not. If they catch you they'll beat you and arrest your unborn children as well. And even if you're not caught, you showing to a judge the video will
      A. Not get your relative bail
      B. Antagonise the judge who might direct the police to investigate the corrupt cop as well as you

      @@AmishLegal BTW, is the person not already under investigation? So , if the judge directs to investigate corrupt cop, so be it. If you are already inside jail for breaking lockdown, are you not fighting the system already? Fight it boldly then. The first rule of thumb in dealing with any public authority is- " MAKE AS MANY AUDIO/ VIDEO OF YOUR ALL INCIDENTS OF INTERACTION WITH THE POLICE/ ANY GOVT AUTHORITY. Audio/ video always and always make your cases strong. Never bow down to a bully. If you are already sufferering, then give these corrupt cops a lesson of a lifetime. Also, put those audio/ video on social media. make that corrupt cop famous. Let him reap his karma as well.

    Well you make sense....as per me anyone giving police exams should be appointed as constables or SI because...when you see our current system all the highly qualified and good people become ips...and the constables working on the ground are poorly trained...civil servants should be appointed as constables...if not constables atleast as SIs....

    I wonder how the public will react when it is policewomen dealing with criminals. I would imagine some can cope, others assaulted. Policewomen are human beings and have gone through the motions like policemen, training, health and safety, law, etc.

    The master Rule is as follows - any confrontation, discussion, negotiation with police should be recorded on your camera - before recording state out loud and clear that you are recording, this is being transmitted live, you are within your rights to record a public official in a public place /discourse and nobody has the right to touch you or take your phone.
    This does not mean anything - but might save your life or jail time or a costs that come with judicial system

    I don't think anyone with right mind wants to become a civil servent. The only people I have seen becoming constables or SIs are those who have a poor financial background and just soly want employment and job security.

      Well you make sense....as per me anyone giving police exams should be appointed as constables or SI because...when you see our current system all the highly qualified and good people become ips...and the constables working on the ground are poorly trained...civil servants should be appointed as constables...if not constables atleast as SIs....

    Police don't get respect for their own fault. Corruption is another problem.
    That's why we feel much safer & respectful with army/crpf officers.
