    Perfect example why the judge doesn't let people just babble on and evade questions. She has to cut people off because liars will double talk and dance around the questions.

    So glad she went into recess and didn’t make a snap judgement cuz the plaintiffs were about to lose that case! 😅 That’s $4200 down the drain. Thankfully they got a lifeline.

      Agreed! I feel like she knew they rightfully deserved it and tried to steer them in the right direction to get the evidence they needed and then she started digging in other places that could also potentially help them, so that there was something she could hang her hat on to be able to rule in their favour. It goes to show that no matter how she feels about a person or a case, she will only ever rule on the facts/evidence, even if she has to go digging for herself! She even gave the defendant a chance to prove that the plaintiffs didn’t pay $4200, because she doesn’t want anyone walking away with more than they are entitled to.

      Had the dealer done everything that was required by PA law, they could have resold the vehicle legally, but they didn't
      It always amazes me that a buyer would pay the down payment in cash instead of by check or money order, not too bright

      I agree with you. Everyone else only wanted to hate the shady car salesman and place no blame of the buyers too. They refused to even answer their phone, but still wanted their money back.

      Exactly. The answer to Harvey's question would be that most dealerships won't let you take the car until after financing has been secured. (I didn't even know there were places like this that let you take the car before you even know if you can pay for it.) For those that will, whether you can undo the deal depends on what's in the contract. What is so difficult about that answer?

    His error was his karma. If he had not skewed the law saying “after 10 days he can sell abandoned property” he was on the verge of winning the case. The judge did her due diligence. Though she the courts in recess to give the plaintiffs a chance to get the documents from the lender, I think she was more interested in verifying the defendants claim of being able to sell the vehicle after 10 days.

      I mean idk if he's just full of greed, stupid or both ! But all he had to do was wait 2 more days and he would've won but now he has to cough up almost 5 grand. But at the same time, its also his karma for being dishonest to the judge and trying to pull a fast one over on the clients. 🤷‍♂️.

      @@King82005 No it was more complicated than that- the local state law seems to require formal applications by the car-yard including notifications to the buyer who left the yard with the truck.

      That's a key skill in being a car salesman, I've dealt with them and their lies before and got caught up in it which is why I will never ever deal with a dealership again.

    They target bad credit people because they know they are desperate and often poor, so they can give them bad cars and not pay the consequences. The plaintiff wanted the car, so why would he return it after securing a loan? Lying to the judge also proves how honest they are to their own clients.

    Daaaammmmnnnnnn I was feeling really bad for the plaintiff because i thought they effed up and lost that big chunk of money…. But then JM did her due diligence… the plaintiffs should be HELLLLLAAA grateful to her!!! If it werent for her going the extra mile they wouldve been screwed

      First off, never buy new or used from a new dealership.
      Second, if he has bad credit the financing he could get, would be jacked sky high.

      And i said, "never buy new or used from a NEW dealership". Meaning one focusing on the sales of new cars.
      You never buy brand new no matter what though, that's just a waste of money.

    Whewww, they're LUCKY! It's the plaintiff's burden of proof but the judge did it for them. That dealer is pretty scummy keeping their full $4200 considering they sold the car a week later, I'm sure for the full amount.

      Actually, he did horribly. Here's why: 1. The defendant says that all vehicles have a 90 day warranty, "The brother the plaintifff [sic]" says, it was sold to us "AS IS". Dumb!!! 2. Judge tells "The brother the plaintifff [sic]" to get proof that they did not receive financing, "The brother the plaintifff [sic]" presents evidence that they DID receive finance but VOLUNTARILY withdrew the financing when they surrendered the vehicle. Dumb!!!
      So, "The brother the plaintifff [sic]" did not have "his facts lined up" and did not do "pretty good". I don't think you understand how he won the case. The judge herself stated that the defendant was going to win this case until THE DEFENDANT chose to do some shady illegal acts, like selling the vehicle within some made up time period, and lying about cash vs. rebate (I've bought multiple vehicles and they don't get that part wrong).
      The plaintiff didn't win this case, the defendant lost this case.

    The judge wanted to give the defendant time to provide proof so that the plaintiffs wouldn’t get a “windfall”, but he literally stood there and told a HUGE lie in an effort to undercut their actual downpayment by *$3,450!* That’s on top of the lies that he’d *already* told before court went into recess! He doesn’t deserve any special consideration. He’s a liar! Period!

    Same thing with me the bank told me they weren't going to approve tbe loan but the dealership did some back alley deal and got it approved DONT TRUST BANKS OR DEALERSHIPS when buying a car they are shady and don't have your intrest at heart. Give The dealers as hard of a time as you want to get what you want and whats best for you because if they want they will make it work!!

    Plaintiff is shady tho.
    He drove it off the lot, found out he didn’t like it, complained about repairs, while they were fixing repairs, he found something else he liked and backed out of the deal. Shoulda only got at least just half back to teach a lesson.

    At 4:35 The defendant was so fast when he explained that 'sometimes they don't have time to do the inspection', WHAT? so he sells a car WITHOUT an inspection, so he is selling potentially dangerous and/or faulty cars. To which he had said that the warranty doesn't kick in for about a week. So he saves money by selling a car with no inspection, and probably doesn't pay for the warranty, hoping that the customer doesn't have a problem and again saves himself some more money. HE IS A CROOK...

      The Plaintiffs also LIED to get out of the deal, when they said they could Not get financing. But everyone hates used car salesman, so we only recognize one set of liars.

    Defendant is a dirtbag , tried to steal the plaintiffs $4200 . Even if the plaintiffs backed out because of remorse, the defendant would only be allowed to keep the damages for breach of contract, which is nothing because he resold the truck 8 days later.
    Businesses who treat customers that way don’t last long. He’ll be out of business soon.

    Car dealers that work with bad credit lie about cash downpayment all the time. The bank wants to know the customer put down a percentage. The car dealer lies and said he got that amount in cash when he really did not. This guy got caught and did not want to admit to filing fradulant docs with the bank. LOL So he had to eat the lie and give them 4K

    Ok, so just to explain how buy here pay here car lots work. They will buy a car usually at an auto auction that they'll pay usually $800-$1000 for.
    They clean it up, maybe do a tune up at most. By the time it's all said and done they'll have maybe $1100 or so in the car.
    They'll ask for a $2000 down payment. They've already usually doubled their money before you've even driven it off the lot.
    If you make your payments, great. They'll get four or five times their money out of it.
    If you don't make your payments that's even better. They'll repo the car. If you can pay all the fees and pay them all your back payments you can get the car back.
    If not, they clean it up, put it back out on the lot and sell it to someone else for another two thousand down payment and start the process all over again.
    I know of at least on trans am that a local lot purchased at auction for $600. They sold it fourteen different times with a $1500 dollar down payment each time. With the monthly payments they got out of it rough guess would be somewhere between 30,000 to 35,000 for a $600 car.
