      Yeah, it's the same with those ridiculous 1A "auditors" who keep repeating "I'm being calm and respectful" while ignoring everything they're told, insisting that they know all the laws and that they can do whatever they want, all while having a camera literally right in someone's face. It's disgusting behavior. Just because you're not yelling doesn't mean you're being respectful. They're all a-holes

    • @kanaric

      Judges probably have good reason to try to avoid that. Like one reason I can think of is it adds more court dates and these places are already understaffed they probably try to avoid that at all costs. Unless you are giving someone contempt immediately or they are starting to cut into the day's time already. Some judges probably get hit by sunken cost fallacy at some point but this guy I don't think allows that to happen. Once a certain time hits he cuts them off then proceeds. Once they get their court date they fuck themselves into more jail anyways.

Then the judge should have said have a nice day, bro.

      Yes. Contempt of Court charges are not used often enough, and there is no better way to establish jurisdiction and authority in situations where an uncooperative defendant is acting erratically and not following the Court´s orders. I know the claim that these add to the time in court and time to process the cases, but I say tough. Clearing cases probably should not be the guiding imperative in many situations-making a defendant know who´s in charge in a courtroom, with no ambiguity about it-probably should be more important than simply running them through the system with a fine and no jail time, and having the defendant learning nothing at all. Just my opinions here.

      Honestly, think it shows how patient and respectful and caring a lot of judges are and can be. We see judges like Judge Perkins and Judge Simpson give these guys multiple chances and have them be rude and obnoxious in their courtroom, but the judges keep their composure throughout the entire ordeal and do their best to keep things calm. They may get stearn and raise their vibes voices at these guys and they won't let them get completely out of control or run their courtroom, but the amount of patience these judges show is remarkable. I wouldn't waste any time throwing any of these guys in contempt if court.

      I’ve seen it firsthand a bunch of times. It’s super frustrating to the point that I, being there with my own traffic tickets and problems to deal with, feel like standing up and helping the other defendant through it myself.
      I know you’ve likely seen it here and there, so it isn’t a unique example but once I saw a guy who refused to answer something like “do you understand the charge as I’ve explained it” and it was simply a reduced charge from speeding (which would have points on the license) to “failure to obey a traffic control device” which doesn’t necessarily come with points.
      He was being given a great deal but he angry’d his way into a full fine and points.
      Frustrating because everyone knew that he _did_ understand the charge. He just wanted everything to go away because of his very good reason for speeding. He wouldn’t STFU for two seconds, got loud and agitated and physically animated, pounding his hands on the front of the judges desk area and “clap-talking” syllables out. (👏NO👏I👏DO👏NOT etcetera)
      Dude could have paid like $50+25 and gone on with his life but he FAFO himself into handcuffs and a county cell for a couple days wait to face the full charge again.

    • @rbarnea
      @rbarnea Месяц назад

      @Aerik, There are article 1 judges. These are adjudicators who sit on tribunals where the adjudicative power derives from Article 1 and not Article 3.
      Examples: all US courts for the uniformed services, patent trial and appeals board, court of federal claims, US Tax court, and bankruptcy courts.
      None of that matters for this idiotic defendant though. His case is a city case. And the judge here has jurisdiction under state law-including the state law that allows municipal corporations to have their own courts. So his jurisdiction likely comes from both the laws of Michigan and the laws of the city of Detroit. (I don’t practice in Michigan, but the concept of states allowing cities their own courts of limited jurisdiction is commonplace.)
