Woman Busted for DWI after Sleeping in Liquor Store Parking Lot

- Around 6:40 PM on August 1, 2023, Patrolman Erick Finley with the Sparta Township Police Department responded to a report of an unresponsive female sleeping inside a 2007 Ford Explorer in the parking lot of ShopRite’s liquor store. He arrived on scene and made contact with the woman in the driver’s seat. He was able to awaken the woman after knocking on her window, but she seemed disoriented and unaware of her surroundings. After asking for her driver’s license, he identified her as Carissa Kalaydjian.
Given the initial nature of the call, first responders with the Sparta Ambulance Squad arrived shortly afterwards to evaluate Carissa, and Patrolwoman Brown arrived on scene to assist. Patrolman Finley informed them that there was no medical emergency and they cleared the scene. He returned to his patrol car to run her license and spoke with Patrolwoman Brown about their next steps. Based on their suspicion of impairment, Carissa was offered an opportunity to complete field sobriety exercises.
Patrolman Finley started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Patrolman Finley observed a lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation. The second exercise was the Walk and Turn test. During the Walk and Turn test, Carissa did not walk heel-to-toe on all steps and turned improperly. The third exercise was the One Leg Stand test, and Carissa initially claimed that she could not complete the test because she was wearing heels. Patrolman Finley offered her another opportunity to complete the test without her shoes, but she was still unable to maintain her balance or raise her foot as instructed. At this point, Patrolman Finley terminated the One Leg Stand test for safety reasons.
Based on her falling asleep behind the wheel, the odor of alcohol on her person, her physical appearance indicating impairment, and her inability to adequately complete the field sobriety exercises, Patrolman Finley placed Carissa under arrest for driving under the influence. Her vehicle was searched and impounded for a mandatory 12-hour hold under John’s Law. Patrolman Finley subsequently transported Carissa to the Sparta Township Police Department for initial processing.
At police HQ, Carissa was read the Standard Statement for Motor Vehicle Operators and agreed to submit breath samples. Her Alcotest results indicated a BAC of 0.12%, which is more than the legal limit of 0.08%. After Carissa was processed, she was released to her husband pending her court appearance after she signed the Potential Liability Warning form on her behalf. Patrolman Finley issued her the following summonses: Operating under the influence, careless driving, failure to possess driver registration, and failure to possess driver insurance card

The cops should not be allowed to turn off the audio on cameras! The whole point of the camera is for transparency.
The cops do not turn that off. As part of the FOIA ACT, those parts have been edited out for privacy prior to the video being released to the public. Similar to the parts of the video that have been blurred out for privacy prior to the video being released.
And it might not be relevant to the case.

What about when they have to take a piss? Im sure in their reports they have to describe in detail why they have to turn the camera off and what happened while off.
It appears to be around him clearing her registration/insurance, so they will quite often blur the screen or the audio is redacted. He showed her how to turn hers off so that it didn't pick up on her camera either.
Unfortunately, this will be another tap on the wrist by the judicial system

@@djsi38t it’s actually 2-3 drinks depending on her weight and when consumed. I’m guessing she’s at least 140 so 3 drinks. There’s also the fact that it’s 6:40 and she’s already this drunk.

Drinking while driving became a law around 1910, however it wasn't a #1 priority. After MADD was founded in 1980, it started the anti-drunk driving movement. Drunk driving stops/arrests became more prevalent.

As someone who also spent time in a psych ward as a young teen and had an irresponsible drunk for a parent I really feel for her daughter. I hope she has at least one responsible adult in her life to look up to 😢

I used to work 12 hour night shifts in an ICU and had to drive home 35 miles. Giving report to day shift was painful as I was so sleepy. Sometimes I’d try to nap in the break room before going home but some days I’d have to pull into parking lots and take power naps.
I know I’ve driven after a few drinks before and I regret that. I’ve never had a DUI and I now usually go home and have some wine.
Nap at the hospital. Never do that in parking lots. Not safe for females. And an unnecessary interaction with law enforcement. Cuz they will conduct a dui investigation. You will be asked to do FST's. Nobody, and I mean Nobody passes them. You'll get arrested for suspicion of dui. Once the state board finds out, and they will, say bye to your RN license. No bs. I know a former rn that lost her rn license over that. Let that sink in and think about it! Just sayin. Make wise, safe choices. State board would make u jump thru a bunch of loops to get your rn license back.
Seems if one has to pull over if they had too much, it's best to get in the passenger seat.

About 7 years ago I took my kids to burger king to play in the play area and eat. They had actually fallen asleep by the time we got there so I decided to just sit in the car and let them sleep since they had not had their nap. I ended up accidentally falling asleep too and woke up about an hour later. I consider myself lucky that no one called the police on me or that a cop didn't knock on my window because more than likely they would have thought I was drunk and had me do all the tests to prove that I hadn't consumed any alcohol

Well damn. I really like this woman. She genuinely seems sweet. But stressed. And I can get behind that. I too have a teenager who is struggling greatly and exhausting me.
I think people make mistakes in hard times. I don’t think she means harm. She spoke a lot about it being a peaceful moment- almost like time stopped for a bit. Seems like she just needed a break. I hope things are better for her.
I’m glad the officers seemed to care enough to press the issue, but I will say, I could fall asleep anywhere. Within minutes. I’ve slept in many a parking lot in my car on lunch breaks 😂 And some people are REALLY hard sleepers. And neither one of those necessarily means a person is unsafe to drive or under the influence of anything. Just saying.

Field sobriety tests are of no benefit to the person being tested. They simply provide a prosecutor with potential evidence for your prosecution. The subjective judgement of the officer providing the test is the only determining factor on whether the will haul you in or not. The officer will not have you do the fst unless they have already determined that you are under the influence. Personally I would bypass the fst and let them take me in to do the breathalyzer.
Excellent point. If a person comes in below the legal limit but with detectable alcohol in their blood on the official test, the failed field sobriety test can be used as evidence to demonstrate that they were impaired and they can be convicted anyway. It's also interesting to note that if a person passes the field sobriety tests perfectly, the police can still take them in anyway based any other subjective observations. If a person comes in above the legal limit on the official test, passing field sobriety does nothing for them.
I've only been asked to do a FST once, it was at a DUI checkpoint and I admitted to having two beers. The cop quickly realized I was sober and cut the test short, gave me a verbal warning about the empty beer bottles in the car, and let me go on my way.

People "pass" the SFSTs all the time, it's just that watching sober people do well on the tests and NOT get arrested is boring so no one bothers to get and then post the bodycam footage.

**** I'm a single mother of toddler twins and a teenager plus I work 8 - 10 hr days 6 days a week and I've Never fallen asleep sitting behind the wheel in a parking lot..
My father in law worked nights, had a wife and four kids. He would head home. A time or two he fell asleep while waiting for a long train to pass and even fell asleep in his driveway. But this was 7 decades ago when someone would knock on his window, ask if you were okay, and be on your way.

If she is in the vehicle and in possession of the keys she can still be arrested even if she was in the back. Kinda messed up because if you realize you can't drive and choose the safe option of sleeping it on in your car you still get screwed

@@musicinggp true, but it's also true that I spent one entire year walking everywhere barefoot. I was 18. Everywhere except work. But church, school full time, restaurants everywhere. It was interesting I never cut myself and it was actually not hard walking on most surfaces.

Well the car was parked but how did she get there. She was driving before, car didn’t get there by itself and she was in the drivers seat. After she was found they couldn’t say oh well your not driving now ok we will let you be. Then she drives off and kills somebody.🤦♀️
She should get her windows tinted so she can relax peacefully next time. I knew the cops were up to no good when they muted their body cams. And before anyone says anything I'm vehemently against drunk driving but I truly believe this lady just had a peaceful moment and fell asleep. She didn't act intoxicated at all and yes the breathalyzer showed a little alcohol in her system but that little bit could have been from the night before or anywhere considering the muted body cams

The purpose for the body cams is for the interaction between the police and the public. Not conversation between coworkers. Everything is on body cam and it's documented in their reports. In most states, as long as she is behind the wheel which they have on camara and the keys are in the ignition, and she's drunk, she can definitely get a DUI

This is so strange to me. I have napped in my car several times over the years. No one has ever called the cops on me…it seems like they overreacted.

So I have a question. I take naps in my car all the time. I get tired during the work day and take a nap in my car at lunch. When I'm driving a longer distance I sometimes pull over to take a nap in a parking lot. I do have medical issues that make me more tired than the average person. But why is it a problem if someone is sleeping in their car? I might be considered "impaired" if I didn't sleep, but after a nap I'm wide awake and alert. I realize that she has alcohol in her system but in the first part of the video they focus on her nap as if it is so abnormal, but I really don't think it is
It is illegal I think in every state. If you take a nap in the driver's seat and have alcohol in your system then you are asking for trouble. Now if she was sleeping in the passengers seat or in the back with no keys in sight, then she has a argument if they try to arrest her. I haven't seen any videos of that anywhere so maybe it hardly ever happens. I don't know. But if they were in the back and then taken out and arrested, it should easily get thrown out. Lots of these types of arrests in NJ get thrown out anyway if you have a good lawyer.

Is it illegal to sleep in a parking lot? I did it today with my engine running and my seat down all of the way cause I like the vibration of my car for taking a nap.
It’s illegal to sleep in your car when you’re in the driver’s seat and you’re drunk, yes. That’s illegal. Whether the car is OFF OR ON. Keys don’t even have to be in the ignition. If you’re in the driver’s seat and you’re drunk, that’s drunk driving. Period. NEVER get in the driver’s seat to “sleep it off.” Get in the passenger seat or the back of the car. DO NOT put the keys in the ignition. EVER. You do that, you’ll be fine.
I'm glad that they prevented her from driving while impaired. Drunk drivers are an absolute menace for sure. I'm curious, though. I didn't realize that a person could be charged with DUI who was not actually driving while impaired. If she drank in her car, I know that is a crime. However, if she drank somewhere else, and then got in her car to "sleep it off," would that still be considered a crime?
Yes. She was in the driver's seat so she was "in control of the vehicle". I've heard LEOs say to get in the back seat to sleep.

@@margaretbrady5646 My husband taught a court ordered driving without impairment course, and here where we live, getting in the back seat wouldn't cut it.
You are considered to be in care and control of the vehicle while situated anywhere in the vehicle, so hopping into the back seat would make no difference.
The driver could easily wake up from back there before sober and drive off.
Should be illegal to just leave the engine running for ages .
Putting bodycams on mute shouldn't be allowed.

I'll never forget working my day shift at a gas station. A guy came in for a roll of quarters. 😂 My manager and I went out a bit later and he hadn't left. We looked and he was trying to put the quarters in the ignition and couldn't figure out why his car wouldn't start. Yep cops got called. He wound up taking a plea deal.

No transparency there .Cops should never mute body cams while investigating a crime or out dealing with a member of the public . If I'm her attorney that'll be a question I'm asking the officer about if it goes to trial.

The cops didn’t mute. That’s the FOIA act. The audio was removed before the video was released to the public just like parts of the video have been blurred for privacy. It was considered private or irrelevant. She would have had access to the entire thing for her case but the public does not.
