      Called to complain, twice. This time as with 40 other calls to different police departments I have found that no one person has ever watched this or any videos but said that they were probably edited. Generally I have entertaining conversations. Dispatchers take a lot of shit and most of the calls. Cops hold their breath and wait you out. Funny thing is, I have to become angry to call and then calm down so to have a dialog. Nothing like your end. Luck be on your side.

    That male officer just showed up and immediately escalated the situation by threatening arrest. He is a prime example of what is wrong with most of law enforcement nowadays. Some officers let the power go to their heads and it’s a shame

      Nazi's said it a lot in the world court, and were hanged right after. Following orders that violates rights, puts harm, or is against the law are some of the only reasons to disobey a superiors order. Her boss was the gentleman victim here, not the supervisor.

      @@123lodge8 You aren’t allowed to be a good cop anymore. If you are on a probationary period you can be fired for any reason. And if this lady cop had disobeyed the Sargent’s order she would have been fired.
      This is why we have to start at the top if we are ever going to reform the police. I’m sure this lady cop would gladly respect our rights if she didn’t have racist nazi’s behind her telling her to break our constitutional rights. Instead, they give cops 2 choices, be a tyrant and break good citizens rights or don’t be a cop. Change needs to start all the way at the top.

    This situation is EXACTLY why qualified immunity needs to be greatly scrutinized! They want to arrest this guy for NOTHING and make him pay for an attorney to defend himself against frivolous charges, they need to pay for this nonsense out of their own pockets.

      If a cop issues a ticket or makes an arrest that the prosecutor refuses to take to court, that citizen should automatically receive a check for...(?) some amount for the inconvenience (I’d say $5000.), but the cop should have to pay all the court costs, attorney fees, impound fees if the car was towed, etc.
      Too often cops will make arrests or write citations, knowing full well the charge won’t stand up in court.
      I’ve had 1 in particular that was 5 bogus traffic citations all because the cop got pissed because he had read my plate wrong. Rather than apologize for the minor mistake, the cop inflated everything. Of course this caused me to overreact too.
      5 tickets later and on the court date the cop doesn’t even show up. The prosecutor knew this but no one informs me. So I sit there for 3 hours without being called. Find out the Prosecutor and cop already discussed it and it was all dropped.
      So I waste hours in court, paid for parking, missed work, etc all for retaliation tickets.
      (But I wonder, if I hadn’t gone to court, would the tickets stand? A warrant for my arrest?)

      @@TheRatlord74 I disagree, but it should be applied correctly. In this instance, no reasonable person would not know that his rights were being violated. It is these situations that the "qualified" part is supposed to apply. QI should be stripped and these cops should be able to be sued individually. But it will not happen, because QI is a joke and is never enforced the way it was intended, or at least the way it was written.

      Kind of feel bad for the deputy, or whatever she was. No one made her sign up to do this, but she apologized repeatedly, made an effort to stand up to her superior, claimed she didn't want to do it. Cop culture needs to change if any cop even wants a chance at being a good one.

      she definitely said that for the bodycam, for nothing to happen in court. she said a LOT of things for the bodycam, for Kearns, court in general and also her superior (the psycho sgt) I dont feel he violated your rights"... 100% she doesnt say that if her bodycam is off. He's a bully and she's a victim and will maybe pay the price for his bullying in court. I hope the judge spots this and only punishes the Sgt.

    The sergeant engaged in retaliation, pure and simple. He was pissed off upon his arrival… maybe he got pulled away from the chewing tobacco shop. .. who knows. But regardless, he’s the type of cop that WILL NOT allow a citizen to say, “No, you can’t do that.” He’s going to prove who’s “boss”. I hope Cleveland Heights’ phone and Facebook page gets “blown up” (goes viral) over this.

    This has to be one of the best videos I’ve seen on RUclips of a person who was at “no point” suspected of committing a crime get their 4th amendment rights so clearly violated. I am a huge supporter of Law Enforcement and our Men and Women in Uniform but Mr. Kern should most definitely file a lawsuit and all the officers involved needs to be retrained on how to deal with the public.

      This is more common than you think. Consensual contact, ID refusal, arrested for obstruction/interference/refusing to ID, then charged with resisting arrest because they say they have no right to arrest them, even if they are limp.
      "What am I being charged with?"

      The first thing she did to him was apologize, and she did it multiple times. She she even admitted what she did was aggressive and warranted an apology. And how do you not know the difference between a Tesla and a Porsche. The Sgt is a complete asshole and a Tyrant. I really hope he files a law suit. The level of unprofessionalism, arrogance, incompetence, and ego demonstrated by the Sgt is unbelievable. Officer Lewis was also grossly out of control and also is spineless and clearly doesn’t care for rights granted in the constitution.

      The problem is that cops get paid to be in court. It’s no problem for them to go. But for regular people they have to take off work, arrange childcare, maybe hire a lawyer, etc. And then the sgt fails to de-escalate and retaliates trying to get every single charge that he can. And they wonder why folks say ACAB.

    That was not a traffic stop. The driver stopped and engaged in a consensual conversation with the cops. From what I see, they had no right to detain him based on any kind of traffic violation.

He didn't have enough time to react. And the cop knew that. That's why she apologized as soon as she got out of the car. That's why her first words to him were "I'm sorry."
      She admitted that she was wrong. It was her supervisor that came up with those BS charges.
      You're not one of those people that just takes the cop's word for it, are you? There's no possible way that The guy was just driving along, and the cop cut him off, right? Have you ever been cut off by someone that you did not see coming at all? Never, right? And we all know just how courteous police are when they're trying to pull over their victim, right?
      That's a problem that we have here. You're not looking at it from an objective perspective. This guy didn't do anything wrong. He was simply driving and he was cut off by a cop. He says he didn't see the lights. Why is that not possible? Why is it impossible that he didn't see the light, didn't see her quickly cut them off, and therefore didn't do anything wrong?

    You have to identify yourself in traffic stop. At that point that became a traffic stop from him.
    He could cause an accident the way he parked, illegally, he’s car.

    I'm super familiar with Ohio Law. Obstruction in Ohio has to be an affirmative act. It specifically says in our case law that you can't obstruct by NOT doing something. In order to obstruct over identification, he would have had to provide FALSE identifying information. Basically, obstruction in Ohio can only be committed by physically obstructing the officer or lying to the officer.

    I just called the police station to express my grievances. Not only where they very rude they denied me to speak to a supervisor regarding the issue aswell as deniying me there names one officer gave me a badge#305 but refused to give her name. I will be calling back again to speak with a captain or someone in IA and I hope Mr. Curin has or finds a lawyer to jump on his case!

    They kept saying that he needed to ID "because it's a traffic stop." But it was not a traffic stop. She stopped the other vehicle, not his. His engagement with her was a separate encounter and he even waited for her to complete the traffic stop. They violated his rights. The Sargent was completely out of line.

      Dude should also be able to sue each cop in their individual capacity. There is no way they should be granted Qualified Immunity here. I bet if you go back through the history of the sergeant he has had dozens of cases where he arrested people for bogus obstruction charges and them having been thrown out. This means he knowingly violated rights. QI does not protect you from knowingly violating rights.

      And you're likely to be spending a lot more cash than you'll ever recoup from the courts.
      Going Pro Se would be the best way, but you'll need to have a very good knowledge of Court Procedure or you're wasting your time and will get screwed.

    These cops out here don't care about the law or what's right. They only understand lawsuits after false charges are dismissed or beat in court.

    I work in healthcare and I have refused something ordered for me to do when I found it unethical or not my place... If I treat my patients like they treat the general public...

    Kudos to Mr. Kern. I sincerely hope he can follow through with a Federal Lawsuit.
    The Sgt. needs to be fired and Lewis should be ashamed for selling herself for such a low price.
