All the WhatsApp conversations are backed up in Google drive, I am not sure why it is difficult to retrieve it?
what about delete feature available in whatsapp for both parties… the conversation may be long gone…

Unlock bootloader

Root android device
Step 3
Decrypt the databse with rooted phone you can get the key
Step 4
Edit The message database
Insert your messages/images/audio of any time/sender
Re encrypt the database to crypt12 format (Its little difficult to generate header and trailer for now)
Step 5
Unroot the phone
step 6
lock the boot loader again
5-6 steps for making is difficult to find if the phone was tampered

All these are not primary evidence but its substitute evidences.
In other words, courts always first try to save criminals and offenders and not victims. LOL.

But sir often in divorce case spouse take screenshot of their conversation and submit on affidavit....even court accept..in that case what section we can say such evidence is not acceptable.
Indian judicial system is very very outdated today
Recordings isn't always right . Sometimes people try to accuse innocent person by playing provoking situations so that the person will react & record things as an evidence to misbehave . So all in all recordings can't be Always considered right

I relied in a case on photographs taken on my mobile. I had to give the photographs in print, a CD containing the same photographs and oral evidence saying that I have taken the photographs and it was marked as part of my deposition.

Goes on to show how blind really is the supposed "law." EVERYTHING that one does online leaves a trace and the trail can be, in most cases, easily tracked. A screenshot is an image that does have the timestamp and when was even that saved. That can't be photoshopped. Additionally, people generally do have auto-backup so even if the person has deleted the conversation, the records will show it all.
Not everything can be tracked if taken precautions
You can easily modify timestamp details of any file....i used to do it in my android phone

Even if you have a copy of the digital evidence you can adduce it in court with help of Section 65B of the IEA, you can Arjun Panditrao Khotkar Vs Kailash Kushnrao Gorantyal case in SC

Sir, only the original copy of the electronic evidence needs to be produced and the IT FSL can easily prove if the evidence is tampered or not. 65B certificate along with original copy of the electronic evidence will be considered as primary evidence. If a internet server data is produced in the court as electronic evidence it is impossible to produce the server to the court. So your information video needs to be relooked, please check.
True sir it only happens in movies that chats and audio recording were verified correctly and with caution. But, in reality they really care so much unless it's high profile.
You never win to fight a case in the court because all of them working for the crown.

Question: Does the backup of whole chat taken by the platform itself, for eg, Whatsapp chat backup saved in Drive, or Instagram chat backup (Made by instagram itself on our request) and made available to download for us Via an email will count as a valid proof? any such cases?

Now most new phones don't have discreet call recording, gives a prompt. Google is preventing manufactures from using their own call dialer and insisting on Google dialer which isn't as good and doesn't have discreet call recording.

There is one thing i would like to ask you that in the court of law every screenshot or audio recording is not admissable without the backup because it can be photoshop, we get it. in order to have backup for the same can we silently take partner's phone and keep it with us without informing them for the screenshot backup, will not this breach the right to privacy under article 21 of Indian constitution for the same? can we do so? if no ? is there any other way to do that?
As far as i know it is not breach of privacy if it dsnt harm her or her modesty n also if it is necessary for the justice
Idk about law but taking someone's personal phone without their permission even if that person is ones spouse or Child is a low blow and unethical

But audio recordings can be really long and have to be transferred to other storage devices. What if the person against whom the evidence of audio recording is, is heard speaking very clearly. Is it still not enough?
U should have that device in which voice is recorded n opposition can object that this is not his real voice n than it will take alot of time to prove it as mentioned by respected advocate
Also show call details made from that phone, eg. Call duration and at what time it was made

How do the signature do it better in an agreement? The voice record as evidence is more better. Video recording is better with signature in selling or buying land or anything?

Use phone. It is best evidence. I only talk about how data extracted improperly from phone cannot be used as evidence.
