    It means that you can commit crime privately under privacy clause and if you record it without his consent, it will be not admissible by court. What a judgement!!!!!!

    It should be allowed, victim person must have a right to collect evidence whether it is legal or illegal. We should not inform a criminal before recording an audio,video and any other evidence.

    Very good decision. If someone is giving life threatening on call, asking for bribe etc. then the victim will politely ask to the other person 'Sir, since you're doing unlawful against me, Im going to record the phone call and produce it in court, please start threatening me.'

    In my opinion, the Parliament as well as the Judiciary should work together to clarify such ticklish issues by passing amendments to the applicable laws in a very crisp manner so as not to leave any loopholes for any interpretations. Such efforts would go a long way in reducing the pendency of cases in the Courts where on similar grounds, people across different Courts in different States of India have to unnecessarily spend their valuable time, money and energy!
    I would really appreciate it if you make a special video on how to make a certificate under Sec. 65-B of the Indian Evidence Act to assist people to draft one with all the essential requirements. Thank you ma'am.

    This call recording settings were set up to prevent ourselves from false allegations. So, this must be allowed. It might violate the right to privacy in a way of illegal but, way of fighting against fake allegations. Thank you ma'am for such an informative video.

    Indian judges should understand the right to privacy is not for only wife but it is also right of privacy for husband also, if both spouses have gone to court for their internal matter, then this matter is self proven legal.

    As an electronic evidence, the original electronic equipment (e.g. original mobile phone where it was recorded) must be presented in working condition to be admissible in court as evidence.

    I personally believe Phone recordings should be legally accepted as evidence. Because nobody does call recording routinely . Call recording is carried out by someone when there is an anticipation of a specific kind of crime likely taking place or to prevent oneself from becoming a scapegoat in a particular case. Violation of privacy should be given preference only after evaluating the merit of the call recording. Maybe the evidence can prevent an innocent person from being wrongly punished. I believe that the people speak in the true sense and exactly what they mean on the phone. A call recording is always chosen by a person who is defending the case and has no other option left.

    The same right to privacy can be misused, if someone falsely claims that blackmail is done via phone call, but he has no proof because he couldn't record due to right to privacy issue. 😅

    How is it a violation of privacy? Here the conversation is between two persons. One has recorded the conversation, unless it is brought to notice of a third person the privacy does not get violated. Before the conversation is produced before a court the permission has been sought. So there is no violation of privacy. Does right to privacy superceed right to justice.

    Wife is like an open book for her husband so that husband can record call,make videos and should be admitted in court also bcoz there is no privacy between husband wife. also recording may be an important evidence of the case so it should be accepted by court and may be listen by the judge in presence of only husband and wife in his chamber.

    It is not a crime to record any illegal activity on phone or camera.
    If you are recording someone's private activities without their permission which is not illegal then it is wrong.
    how these people manage to became judges.

    If someone is constantly threatening you over telephone, should you request him or her to allow recording its voice and do you expect he will say, ok.
    And on the other hand if the govt. or any telecom authorities hold the right to record the conversations of their citizens or clients then why we the citizen of Bharat won't have the right to record the same for their own safety and security.
    How can it be proven if any criminal commits a crime or give random threat over phone, how can it be proven before the Honourable Court?

    So if I record someone shooting other people, the honorable court will say it is under the right to privacy and you can't provide it as proof. I think it's really dumb that instead of checking that proof, the court nullified it. They could have put a penalty on him but noooo. They gave a dumb order.

    There is a right to defend yourself . And collection evidence through any possible means for defending yourself in court should be legal. Phone taping can be illegal but if you are moving the court what you have talked is against you should be legal because court wants to know what king of talking has happened between you and the party. How can one understand what you have originally talked with someone.
    Then because of right to privacy your finger print should not become evidence . Without consent you cannot collect any suspected criminal's finger print. Five senses are private . So evidence regarding five senses are invalid.

    Aap ka kahna bilkul sahi hai mam. Aysi koi bhi baate accused chhip kar hi karta/bolta hai. To uska evidences collection chhip kar hi kiya jaa sakta hai. Saamne se to koi bhi nahin kahega/batayega ki haan hum ne..... aur saamne se evidences collect kar bhi nahin sakta koi Q ki mauka hi nahin milega/dega. Ab evidence, evidences hi hota hai. The main goal is to have a perfect judgement bas. Agar us chhipe evidences ko accused ne except kar liya court mein to fir court kya kahega us samay, Q ki ye evidences bina uske permission ke liya gaya, uske privacy ka hanan hai isliye main faysla ulta dunga matlab evidences ki kamin nikaal de....! . Ye to koi baat nahin hui ? Judge ko bhi malum ho jaata hai ki kahani kya hai magar Q ki kanun mein aysa isliye faysla bhi waysa ? Fir justice ka matlab kya rah jaayega ? Court ek sahi judgement ke liye hai chahe evidences kahin se bhi kisi tarah laaya gaya ho bas evidences pakka aur sahi hona chahiye. Ek baar judge saab sune to, poochhe to accused se ki haan bhai batao ki kya tumne......Tabhi to sahi justice ho paayega warna to court bhi sab kuch jaante/samajhte hue bhi.....
    Koi bhi case court mein aata hai to table par paper put hote hi judge saab us case ke baare bahut kuch samajh lete honge ki ye case kya hai aur decision kya ho sakta hai. Wo baat alag hai ki beech mein agar case ka rukh dusre taraf jaane lage to.....aur wakeel saab to shuru mein hi poora kahani sunte hi samajh lete honge ki case kya hai. Q ki roj to un logon ko kitne cases se gujarna padta hoga. Unka tajurba hi case ko pahle hi samajh leta hoga ki is case mein galti-sahi kis-kis ka ho sakta hai.

    The Indian Penal Code authorises every citizen to defend himself against any criminal act perpetrated again him. Call recording is a material evidence and for gathering evidence against any criminal adventure is not a crime. When a person speaks in phone the place where communication is transmitted is public domain and all public domain has public interest and public rights.

    My question is who will willingly allow to record the statements when you are in trouble or having court case .
    Everyone speaks their mind clearly good or bad when they feel comfortable to share their input .
    Next , everyone is scared to get tangled into court proceedings as witnesses due to long years of harassment faced . Truth tends to die fast when compared to liars .
    So only way left is to record the conversation silently.

    Injustice against men will only increase crime against women. There should be some provisions in law to punish these cheap women who misuse law otherwise only hate against women in general will increase resulting in offense.

    It means kidnapper call for ransom against kidnapped person is legal as per Indian law if recorded without permission of kidnapper. Judge give new business idea, sabka saath sabka vikas.
    I think judge eager to make this decision to be legalized his settings behind the court with criminals against their crime on call,

    if two persons are talking on phone and third person is recording that is breach of privacy, when two persons are talking and one of them is recording its should not be a breach of privacy.

    Judges should allow this call recording as an evidence to produce either by wife or husband as this is not right to privacy....it is absolutely fine as the argument is between the husband and wife...yes it could be illegal or right to privacy if an outsider or anu any other member records without the consent of the both..
