  • Social Security rules have eliminated "File and Suspend" or "Restricted Application" as a filing strategy for married people in 2015. For widows, the "Restricted Application" strategy still works as long as they have not remarried before 60. In this video, Tom and I discuss how two clients were recently helped and how they have been able to collect their benefits.

    When my second husband died in 2020, I was just about to turn 66. He was 71 and had been getting SS for several years, but his monthly check was very small (less than $900). When I talked to SS to apply for my survivor benefit, I was told that I could actually get the benefit for my first husband (he had died in 2017… we were married for 36 years) because it was about $500 greater. And then I could switch to my own when I turn 70. That was such welcome news! I am now officially retired with a pension from the university, collecting the ex’s benefit, am still teaching part-time, and in a few years will make the switch to my larger amount. I was so grateful that the guy from SS told me I could do that!

      5/13/23: 2:57pm. Hello everyone. Upon reading this I’m wondering. I became a widow at 43. Not remarried. He was 46. I received Soc Soc survivor benefits for a short time but only for my children because they said my husband didn’t have all the work credits yet. I am 62 and recently applied to disability and retirement benefits. The app asked if I wanted to apply for spousal that it might be smaller amount than if I didn’t. My question is if I could apply for his benefits until I start my own retirement benefits or disability if approved. I’m so overwhelmed w so much info. My app status reads steps 1 and 2 of 5.

    I was a widow at 57. My late husband was 58. SS told me I could apply when I reached 62 for his reduced benefit or wait for the max. I am now 65 and as I was applying for benefits - I was told I was entitled to receive benefits immediately upon becoming a widow. SS is not responsible for paying back benefits even though they provided inaccurate information. I simply lost almost 8yrs of benefits. My husband income/record entitled me to the maximum widow benefit. Over 200K lost benefits- Tough luck. We had done estate planning and trusts- but this issue was never discussed. KNOWING when you are eligible matters- DO NOT TRUST social security to give you accurate info.

      I am a widower, widowed at 57 too. The earliest I can collect is age 60 from spouse’s benefits. But because I work, until I reach FRA, I pay a penalty on SS benefits. I have to work until 65 due to needing health insurance

    Please make sure that people ask about benefits... I was married and my wife died very young, at 41... I never have remarried and went to apply for my benefits at full age of 66 1/4 and was told that I could have been drawing a check on my wife's benefits since I was 60, but no one ever mentioned it, and at the time of my application I wasn't allowed to back file and was told it was my responsibility to apply... PLEASE let everyone know that such a thing is possible. The amount would have helped out a lot.

      Also people need to be aware of the medicare monthly penalty that continues to be taken for the rest of your life.
      Ridiculous and so illogical ; makes no sense at all to make disabled people pay a penalty for life for not being able to afford medical insurance !!!!

    I have been praying for a miracle 🙏🏻 and your channel came to me!! My husband died 2yrs ago and I had know idea I might be able to receive a little help from S.S. I read something and thought I wasn't allowed to receive anything.. I'm also on SSD and I'm still not sure if I can collect anything 🤔 but, I guess my guardian angels 😇 were watching out for me....

    My husband passed away earlier this last year, he was 62 & I was 54 with a minor child.
    SS explained to me that I was to receive SS from my husband's SS as an adult with child provider. Not widowed or widower SS. Then, our minor child will receive a SS benefit until they turn 18.
    My benefits will end when the child turns 16. I can reapply at age 60 to restart SS benefits from my husband SS as a widow if I dont remarry.

    I understand that if survivor is on SSDI (disability), they cannot file for restricted application since their SSDI benefit is the surviror's full retirement age. Is this correct?

    I have difficulty understanding the reasoning behind taking away some of the Social Security benefits because they remarry. It causes so many people to not remarry and live a life of loneliness or live with someone who is not their husband. Why would the government want people to live in sin?

      Where do you get your information? The amount that an ex-spouse taking benefits, has NO bearing on the amount the person gets from who's social security account is being drawn off of by an ex-spouse. Please get and education. smdh

      Yep my companion’s brother brought that up and that’s why we are not married his brother never remarried because he’d lose 4K a month between him and his companion
      but if you decide to get married before 60 you only have to be married 9 months but you really just have to see in each senario how you are going to benefit

    We need to change the rules to allow widows and widowers of a deceased spouse to continue collecting their deceased spouses full monthly benefits added to their own. Why because the surviving spouse are still facing the same high rent or house payments and lose their home rental and end up homeless? I’m winder if our House and Senate do not have members of the Nazi Party considering their attitude toward retired seniors and our disabled?

    Thank you so much for the video. I am a widower and am 60 years old. Me and my wife were married for 29 years. My wife passed away in 2023 when she was 57and half. She was a full time home maker and never worked. I came to know that she would have got half of what I get in SS as spousal benefit. I am planning to work until my full retirement age and beyond and then only to claim my own SS benefit. Since my wife is no more, and she does not have any SS on her own as she did not work, is there a way I can claim anything until i start drawing my my own SS benefit at full retirement age.

    What happen when you get a ssi check and your husband dies and he 2as get a ssi small checkof 446 and a small a social security check of 308 and I'm get 914:what will I get if I took the window would it hurt me or would it help me

    If I am receiving Social Security disability and my ex has been passed away and we were married over 10 years, will I still be able to receive his Social Security? And will I still be considered disabled or will they take me off of the SSI benefits thank you will wait for your response.

    I was married for 25 years my husband passed away 8 years later I got sick and was put on disability everybody was telling me I should be receiving widow benefits so I called social security and explained to them they said I would of had to become disabled within 7 years of his death to receive it and I will have to wait till I'm 60 to apply for it I'm 59no big deal but I've talked to alot of people that has said they received the benefit and they weren't even disabled so I don't know or understand it

      That is an older question, but the information given is incorrect.
      If you are disabled, you can apply for Widow/er benefits at 50, as long as you have not remarried before 50
      If you are not disable, you can apply for widow/er benefits at age 60, as long as you have not remarried before age 50.
      There are other rules if you are taking care of a minor child of the deceased, or a disabled adult child of the deceased.

    If you want to apply for widower benefits at age 63 is there an income limit like there is with regular SSI benefits? If so how is the income determined, for example I would like to start Jan 1 and use that and a state retirement (Persi). I have been working steady for the last 11 years and I'm still working.

      If you take the widower benefits before full retirement age 67 and earn more than $21,240 from your job, you will have to pay some of your Social Security back.

    61 1/2 and had to turn down my husbands (37 years) social security. He passed Oct 2022. I'm still working at a job with an hourly wage. I make too much money according to Social Security. I can't pay our bills.He had multiple health issues and we have no more savings or property.They told me it wasn't my "benefit" because of my age. What they said I could get was only 8 months a year and I would have to claim it as income on top of my wages. I would be in arrears to the IRS at the beginning of each year. I will be homeless in about 3 weeks. Moving into my daughters apartment till I can figure it out. My husband and I both worked since we were 14. I'm glad he passed thinking I would be taken care of.

    If you moved to USA worked 6 years and you spouse died, how do that work? Do they look at the 1 and a half credit the person work in there last 3 years for the spouse to receive benefits for widow?

      I am unsure how the death of a spouse who was the primary earner under 40 credits with Social Security. You will need to contact Social Security. I’m sorry for your loss.

    If I have a State Pension for the rest of my life, can I still draw SS? I was in the military and contributed to SS and I also work full time since my retirement 5 years ago and have been contributing into SS and Medicare. I’m 57 years old. I heard that if someone has a pension, they lose their SS even though they paid into it during a second job during retirement. Thank you.

      You might get reduced Social Security but you will get something from Social Security.

    Could you, would you do a program on a married couple, both receiving SS presently, one larger than the other. When one o them die. There's ton's of video's in regard's to those who die prior to filing and receiveing a check, but I can't seem to find on when both are still married, both are receiveing a check, though the amount's may differ, and one of them die.
    Prior to one of them dying, it's only normal they existed on there being two check's. When one dies, there expenses do go down a bit, but the difference is almost nill. When basically for the most part. The dead one doesn't eat any longer. The other bill's they had, still need to be paid.

      The smaller of the 2 checks goes away at the first death. The survivor lives on with the larger check only

    I am a 70 year old woman who lives on 807 survivor benefits and 317 SSI..I don't know if I worked long enough to get my own social security.. Right now I get my deceased husband's Social security and $317. For disability for me..Is their a way to increase my income because I am 70 now?

    Hello 👋 my name EDD TAYLOR. I started getting S. S. Disability in March of 2012 at 58 years of age and I got a 2nd check, because My wife had died in 2008 . Well in Nov. Or Dec. Wright before I turned 65 S. S. sent me a letter saying that they had made a mistake in stead of me drawing 175.00 a month that I would get 245.00 per month on my widowers check. Now sorry for taking so long but . My question is should I have gotten back pay for all of those months that I didn't receive that extra 70.00 dollars per month ? THANKS MUCH EDD TAYLOR.

    SALUTATIONS TO THE BOTH OF YOU…MY HUSBAND DIED AT THE AGE OF 42, WE WAS MARRIED LESS THAN FOUR MONTHS. HE DIED FROM A MOTORCYCLE ACCIDENT. I FILED FOR WIDOW BENEFITS AT AGE SIXTY, BUT I DIDN’T KNOW ABOUT THE RESTRICTED APPLICATION. I’LL BE SEVENTY NEXT YEAR IN JULY.. CAN I STILL GET MY SS BENEFITS WHEN I’M AT THE REQUIRED AGE FOR RETIREMENT?

      If your own benefit is more at age 70 than your widows benefit, I think you can switch over to your benefit. Since you filed at age 60, the restricted application was not necessary. Make an appointment with Social Security.

    My husband died back in 1992. I've been on disability 17 years. I finally got my papers together, I didn't even remember I was married 11 years. I knew it was around 10, just wasn't for sure how long. Well, I'm 67 years old now and filed for widows benefits. I'm getting a check for almost 1400.00 a month! Amazing! I know it's not much, but I've been ill a long time, and this is more then I thought I'd get. Thanks for the info!!!!

      I was told long time ago I didn't have to file taxes while on Social security and now the IRS SAID I HAVE TO FILE FOR 2018 2020 AND 2021 IF I WANT TO GET MY 2 STIMULUS CHECKS I NEVER RECEIVED. IS THIS TRUE?

      @@janicebasch8682 if your income is all unearned ( only social security benefits) you shouldn’t have needed to file as your income at the amount would have been surely less than 30,000. My unearned income is still (2023-2024) less than 23,000 and I am a disabled widow with a husband of 30 years who served in the air force for over 2 terms and then had a nice income from good jobs for over 24 more years. That is hsrdly enough to survive on my own with having serious health problems. Had breast cancer now probably have cervical and ovarian cancer as tests show worrisome mass and cysts. I make too much income to qualify for food stamps or medicaid or even help paying for my monthly prescriptions. Plus copays for diagnostic images and specialists.,..it feels very hopeless and all my food is from pantrys and salvation army. Which I am very truly thankful and appreciate. I’m staying alive and joyful and loving and kind because I have an attitude of gratitude.
      But mostly I smile every day because my 3 adult children are healthy and happy and wonderful brilliant people. They are also the best , most wonderful, most loving parents and i am blessed by 2 adorable and precious 20 month old granddaughters who are also healthy!
      It’s easy to worry and stress and complain…i do it often to myself
      (Not to family) the system and government and corrupt are broken so don’t depend on them or trust them. Be a strong caring person and family and community !!! We can overcome if we love and respect each other. Bless you all

      That took me so long to type on this phone. My abilities in so many essential ways are not good any more. 😢 life is full of challenges. I’m wondering if the struggles and learning from them ever stops.
      I guess when this body is done here and my spirit is released and hopefully lives on in beautiful mysterious ways;

    My husband recently passed away. We were always told that if he died before me I would receive his SS minus my very small SS. I was shocked and devastated when I learned I would not receive any of his SS. My income was refused by half. I'm am barely getting by. 5:10

      Yes. She gets the COLA since 2015. It will also be based in his FRA benefit, not the 62 benefit.

    I am receiving $ 5 a month more than my husband’s SS retirement. When he passed I was not awarded his SS RETIREMENT. I complained about it.They said I m receiving more money than the deceased. Just $ 5 a month more than him I got denied? That is SS rules and regulations.

    If I am collecting spousal benefit from my spouses credits at age 62 and my spouse dies before my FRA am I required to collect the survivor benefit that automatically begins upon the death of my spouse ? Or can I pause the benefit until I reach FRA so I can get the full benefit that my husband was getting?

      Sandra. If your spouse dies before you reach age 67, you can wait until you are 67 to file for the survivor benefit.

      I would meet with social security by phone or in person. Have your original marriage certificate, his death certificate. You must choose his benefit or your benefit. You do have the option of collecting his benefit, filing a restricted application on yours, and then switching over to your increased higher benefit at 70.

    My husband died 15 years ago, he was 49,he had only 25 credit (cause we immigrant from different country) he will reach his PIA this year, and I turn 62 this year with 35 credit. Should I take widow benefit and and let my grow or can they combine both credits?

      You will need to call Social Security to inquire about benefits when you are short of the 40 credits. I’m sorry for the loss of your husband

      Brenda You need to be 60 or older or have minor children to collect on his benefit. It would help to have his Soc Sec # and a certified copy of your marriage certificate. A joint tax return from 2018 might help. Type in google “Local Social Security office”. Call them and make an appointment. I’m sorry for your loss. Hans

      Widower benefits are available to you at age 60 providing you don’t remarry. You benefit will grow until age 70. Then you can change benefits.

    Can you work and recieve widdow benefits/married over 10 years, deceased spouse on disability for over 10 years? Any difference if tge survivor is under 60 or over 60 snd are there earning limits?

      As long as you are 60+ now and did not re-marry before 60 you are eligible for a survivor benefit from deceased spouse. If you are still working and under 67 and making more than $21,000, you will give some of your benefit back. After 67, you can make all you want and still collect

    I keep Hearing about PIA and the widow benefits is supposed to reflect that amount your late spouse would have drawn if they retired at 67 regardless of what age they died say they past at 49 and would of received 3800 at 67 at 60 I should receive that amount because death was accidental

    My sister lost her husband back in 2005 and she's not collecting anything and she's trying to make ends meet it's sad because now her house is going and she's working to support her house and she has not received any stimulus checks because she owes the federal government

    My wife and I were on active duty in the US Navy.
    She died in April/2014 with full honors and is buried with full honors in Arlington National Cemetery.
    I retired in 2021 with nearly 30 years on active duty.
    I receive SS survivor benefits at age 62 as long as I make less than $21,000/year.
    I will wait until age 70 to collect my full benefits.
    It seems to work okay.
    Suggestions?

    Hello I find this interested. I was on SSI since 1998. My husband passed away in 2017. After a year-and-a-half I advise contacted to get my husband's social security. Which was only around $65 more. Now I will return in 62 in June. What is better for me today. My social security is low in money. What should I do? As I was offered to work part-time as a companion for elderly people in your home . I don't want to lose my widow benefits. Even though I am disabled being a companion two elderly people. Would I get my SSI back.and still work part-time? Since I did not get his benefits right after His death. So I never knew I could collect on my husband's social security. An ex-wife did not want no parts of it. then my mother-in-law after 18 months of his death told me to go file far as benefits should I get back benefits. Retro retro social security benefits.

      As long as you’re not remarried, you can apply for survivor benefits. If you’re still working and earning more than $19,000 from your job, you’ll have to give some of the SS back. Before you contact SS, find her SS#, your marriage certificate, and her death certificate.

      I believe at age 60 you can get 72 percent of your husbands PIA ( Primary Insurance Amount ) The amount he would have got at full retirement age of 67. Then when your between age 62 and 70 you can switch to your own SS when you think it makes sense. But as they say you cant remarry before age 60 if you want to get survivors benefits.

    When claiming widow benefits at 60 you get the reduced amount, about 70% right? That % is what you can get when you switch to your own at your own full retirement age. Does your own only 'grow' if you continue working?

      Kris If you claim widow benefit at 60, you receive a reduced amount. I believe it’s more than 70%. Your own continues to grow until 70 whether you are working or not. If you claim widows benefit before 67 and continue to work and earn more than $22,320 from your job, you have to give some of your social security back.

      @@krisinoregon6806 you’re only locking it in as a % of your deceased spouses FRA benefit. When you change to your own benefit @67, you will receive 100% of your FRA benefit. Wait until 70 to switch, it will be like 130% of your FRA benefit.

    Greetings. What about someone dies young and the widow is under 50 and disabled receiving ssi. But didn't get ssi until after the spouse died.

    Question: I became a widow and 1996 my husband I had been married for 22 years I was starting on and he was 41 our youngest child through his social security for 5 months until she was 18 then about six years later I think I became disabled Drew my my disability when I turn 65 on April 2nd 2022 they confuse me some because I could have been drawing my Widow benefits at 50 since I was disabled but I didn't even realize it till I was 55 and then they wouldn't pay me back pay accept at for one year! Actually I said the enrollment in my disability as 65 I'm drawing a portion of my husband's benefits would I not be better off to see how much my husband's benefits were and draw them and not retire until 70 I really don't know what to do Social Security didn't tell me anything except for my disability benefits weren't going to go down when they enrolled me at 65 into retirement my question is I bet my late husband's is a lot more than mine would not be better off to take his and not retire until I'm 70? I don't know how much his is but his in mind together is 1857 a month had somehow earning years I know more than I what do I need to do?

      It sounds like you’re on disability for your own benefit and started collecting widows benefit at 55? You’re 66 and 2 months now? Full retirement age for you is 66 + 6 months. I’m not sure you have the option to delay to 70 if you are already collecting disability. I suggest making an appointment with Social security and lay it all out for them. Hans

I am now 71 and my husband is 81. We both started collecting our social security when we were 62. I have been told that I could collect from my 1st husbands social security, we never had children so all these years it has never been collected on. I do realize if my now husband dies before me I would have a choice of which to draw on, but can still draw on 1st husband while married to second. Can you clarify any of this for me. Thank you

    My husband was medically retired and on ssdi. He had to fight for it for it for some time and received back pay, as well as a monthly check for about a year before he passed in 2014. His payments were cut off the day he died and I was told I was not eligible for spousal benefits because none of our children were minors. I'm on disability now due to multiple knee replacements and may have to go on ssdi myself. Would I be eligible for spousal benefits, as well as my own ssdi? Being on disability now is a big financial strain and I have no idea what to do in this matter. Due to my husband's struggle with them, I'm a little wary about enquiring without previous advisement. Thank you for any advice you are able to provide!

      You would need to apply for social security disability benefits and you can't be working! They will have approve you and it's not easy. you can collect reduced widow benefits at age 60 or when you apply for disability

      @@donnacrowell7061 ...the SS rep incorrectly thought you were divorced maybe. If you are divorced you had to have been married 10 years. To get the widow/widower's benefits aka Survior's Benefits, you just need to have been married 9months before their death.

    What if I was common law married to my husband for 28 years, and we had 2 children and both of us were self employed. Since he was married before he was with me, he found out about this and filed on his ex wife death benefit. He received it for a few months before he passed away in March. Do I qualify to get spousal benefits? He was born in 1961 and I was born in 1970. Our 1st born son is now 25 and our daughter is now almost 19.

      I would start at SSA.gov looking for a contact #. Social Security will do phone appointments. Social Security does have some international offices.

      You can start collecting from your wife’s SS when you are 60 if you didn’t remarry before 60. I’m sorry for your loss

    My wife past away at the age of 42. We have 2 small children together and I am currently out of work.i was told my kids will get 1407 each and i will get the same since i am out of work. I am 50. Does this sound correct? Thank you

      I am sorry for the loss of your wife. The amounts for the kids sounds correct through age 18. The payment to you does not. Make an appointment with your local Social Security office. Hans

      @@CardinalAdvisors Hi thank you for responding back. I did have a appointment with social security over the phone and this is what I was told. They also said when I get a job and if I make over 30k it will start taking away from the social security I am getting from my wife's since I am caring for 2 young kids. I live in NJ so I don't know if that makes a difference.

    is my mother eligible for survivor's benefit..she is a filipino citizen but my father was a U.S. citizen..he died july 17,2019 until now we don't received the burial fee

      Locate their marriage certificate. Contact social security. Have your fathers Social Security Number. I am guessing she is eligible if she was married to him 10 years or more, she is age 60+, and he had 10 years of work history in the US where he paid into Social Security

    Hello everyone. I am 57 and have been a widow since 54. My husband was on ssd since 38 years old. I have worked many years. I am recently disabled , can I collect anything as a
    Spouse? I will be filing for disability soon. I was told when I am 60 I can apply for something.

      You can apply for disability now on your own work record. At 60, you can apply for the survivors spouse benefit as long as you have not remarried before 60. You will not receive both checks at 60. Only the largest check will continue. I’m sorry for the lass of your husband.

      Your condolences. Unfortunately my husband check was about 1300 a month because he was so young when disabled . Social security says mine will be about 2600 a month. I am a teacher for 20 years so I should stick with mine then. Would I remain at that amount when I turn 62 or would it go down to regular ss retirement amount?
