    For joint seller with 50% share each what will be taken for Purchase value and value of acquisition. Whether 50% of Purchase value and 50% value of acquisition to be considered for filling its 2. Moreover what should be the date of acquisition of an under construction property where possession was given after 8 years from date of agreement.

    Sir,
    For computation of LTCG under section-54,arise by sale of resid.flat.
    Which purchase value to consider as purchase cost for indexation.
    1) circle rate/market value for Stamp duty purpose
    2) Actual sale deed value (as per sale agreement)
    Note:what if sale agreement value is less than market value/value for stamp duty.
    What to consider.

    Sir we have claim exemption earlier under 54f but now 2 years lapse .So as per provision it will be get taxable during the year . So which date shall be consider as sale date and what will be the procedure of capital gain under similar scenario ? Will same process will be followed.And we have kept amount in capital gain account scheme so what will be the procedure to remove the amount from scheme

    Please guide... will Sale of plot of residential plot of Land will come under Section 54 or 54F for Capital Gain tax benefit if I have no other property? As residential plot is not a residential house so under which section we have to take the Capital gain benefit 54 or 54F?

    Sir for example --ek flat mene 2012 me 10 lakh me purchase Kiya tha phir mene apni mother ko 2016 me registered gift deed ke through gift ke roop me de diya ab meri mother usko 2022 me 19 lakh me sell karti hai, to indexation 2012 se dekhege ya 2016 se, and second thing agar indexation ko ignore kar de to capital gains 9 lakh hoga ya 19 lakh....

    I bought a residential land in quarterly installment starting from year 2004 till 2008 - 13 installments I paid. I sold in Mar 2023. Do we need to consider index value of each quarterly paid installment? Could you please throw some light on this.

    Sir hamari eka land aur building both sell kiya hame long term capital gain hua tha hamne pura proper tax pay kiya 54f main exmation liya aur return file ki aur mhuje uski intimation bhi mili no demand no refund processing complite abhi 16 month complit ho gaye kya mujhe notice askati hai kya pileas bataiye sir hamne koi extra construction nahi dikhaya pura proper CA se sub return file ki hai

    if long term capital is 500000.and invested rs 4 lakhs &taken buy agreement of rs.15 lakhs.i taken housing loan of rs 11 lakhs .
    in above case my capital gain is zero.??(less invested rs 1 lakhs.but buy for rs 15)

    Dear Vivek sir Good mrng I have a query regarding Capital Gain on sale of property. My Clint has started sale proceeding of his residential flat. He got amount 25 lac as a part sale consideration in last financial year 2021-2022 and total flat value has been final 40 lac but sale deed (Registry) has not been proceed till now. It may be proceed in Dec 2022. Now please suggest me what I do the part payment received in last financial year. my clint is salary person.

      You need to check the provisions of transfer.
      Capital gain arises on transfer of Cap Asset not on payment basis. So you need to show cap gain in respective year when transfer occur.

    I have a doubt sir, as you said in the video in the practical aspect we use stamp duty value for computation of capital gains , but the actual sale consideration which is received completely in white is greater than stamp duty value, so how can I give explanation for the difference amount as it is in my savings account

      Actually sir forgot to mention it. Consideration for IT means higher of stampt duty valuation and actual. So section 50c which considers stamp duty valuation as deemed cobsideration is applicable only if stamp duty valuation is more than 110 percent of actual consideration. percent

      Get the circle rate on 01.04.2001 as your fair market value. Then indexation till april 23. That would be indexed cost of acquisition. From thay deduct actual sale consideration or stampt valuation which ever is higher

      You need to check FMV of property as on 1-4-2021 then calculate indexed cost of acquisition
