    We have two Wings Cooperative Housing Society. Wing A has larger carpet area flats where as Wing has very smaller Carpet area rooms . Wing A covers all most 75% of property including parking space allocated in building.

    Why the farce of the MCS Act for a society of 11 members?
    Legal members are just 3 or may be only two, if rules are to be strictly applied. The split is :
    Membership to stand alone garage outside membership - 1(one) (11-1)
    Membership to other members 10(ten)
    Disputed membership 3(three) (10-3=7)
    Expired member 1(one) (7-1=6)
    Dismissed members u/s Section 79 3(three) (6-3=3)
    Husband and wife allotted two flats on the same floor 1(one) (3-1=2)
    So with just two members, a society is run for redevelopment. All laws are hanged. The building is demolished 3 years ago as dilapidated.
    Where a Dy. Registrar's order is as good as toilet paper, when he does not bother about his own order, why the farce of the MCS Act for a society of 11 members?
    What is the relevance of the MCS ACT?

    Here in Mumbai 40 years old building we are not collecting sinking fund , now we have major repair above 20 lac and we have 12 flats with different square feet . what will repairing cost calculeted it will be per flat or square feet basis ? . Society members are asking prepair cost per flat basis not on sq ft basis what is correct calcutation we are paying society maintnace on sq feet basis

Aata society committeee members ne aamhala maintenance charges per sq feet including terrace area lavla aahe..aamch mat aahe ki sglyana same charges lavalyla hvet bz terrace flat la already buidler ne jyada paise ghetle aahe...

    Dear Madam
    If a society has two seperate wings with seperate entrance, seperate lift, separate pump room, seperate water meter, seperate electricity meter and the bills recd from Mcgm for water, and electricity are issued for specific wing seperately, then are this charges shared between members of that particular wing, the other wing has seperate water, electricity etc how the utility cost to be divided, as we are not using each other water and electricity and lift.

    Whether Premises and/or Industrial Co-operative are related with the Mumbai District Co-operative Housing Federation Ltd and they have to adopt the Bye-Laws printed and published by Federation and they have to carryout amendments as per 97th Amendments of 2013/2014 and also carryout the Amendments as per recent amendments in Sections 154B in the year 2019 requested enlighten on the subject

      Bye law adoption is must once the amendments happen..I'm 2019 MCS act amemdment has happened but rules are not yet prescribed and model bye laws too not amended yet ...once amended model bye laws are introduced then you may get it adopted ...

    We have 3 floor commercial building and we have ground floor shop and these people are charging 3 times more maintenance from ground floor then of 1st and 2nd floor...how this is calculated can you please guide us ? Should be calculated per sq ft or should be commonly charged ?

    Our society is going for redevelopment and builder is taking maintenance charges for 2 years in advance with out giving starting construction of our houses I want to know who is supposed to pay maintenance cost builder or member till the time we don’t get our houses.

    In our apartment there are total 8 residential flats,3 commercial shop.shop owners using toilet inside society they are say it is in our agreement our property.not ready to pay any maintenance charges.the light connection,water connection,are from our society meter.we are charging only 100rs to each shop.they are saying to clean our toilet to us with extra 20rs means 360Rs total.also they enclosed space infront of shop by shed.they are saying it is our property.still society not formed 5 flat sold 3 vacant.what can we do for this to get maintenance from shop owners.they are saying to cut water supply and electricity for toilet.can we lock the society gate by cutting water supply and electricity.drainage line belong to whom society ?what is correct provision for this under laws as we cannot lock the toilet.can builders do such thing to give ownership of toilet to shop owners which are inside promises of gate.kindly guide properly.still no society is formed.

    I stay in Virar in one housing society. The committee members have not recovered appx 2 crore from the members as well as some tenants who are not members. They are staying given by builder who took money from them many years back for 2nd phase. They are not paying the maintenance but getting water, electricity. But the committee members is not serious in all this matters what to do

    Maza monthly society maintenance rs850 mi nehmi bharto. Aamchya society ni decide kela ki terrace vrti patra shed bandhaycha tyasathi rs25k per flat magitle aahet. Aani mala te nahi bharayche. Kahi issue yeu shakto ka?

    नमस्कार ताई.....माझा 160 sq feet गाळा आहे. रूम वाले 500/- समान maintenance सांगत आहे. सर्व रूम 800sq फीट चे आस पास आहेत. त्यामानाने sq. Feet मागे मला 3 रुपये व रूम ला 1
    रुपया पेक्षा कमी चार्जेस लागतात. फक्त कॉमन शौचालय वापरायला मिळते. रूम वाले बोरिंग पाणी, पिण्याचे पाणी , लिफ्ट, स्विपर चा वापर करतात. त्या मुळे गाळे मालकाने काय करावे. मार्गदर्शन मिळणे स विनंती

    Madam your clip was good and informative but I still feel that the service charges is right, what has been given on contract or salaries, common areas etc, but charging the same maintaìnance for 1bhk and 2 or 3 is unjustified or why would one go for 1bhk after taking a loan if he has to pay that high maintainance compared to a 2 or 3 bhk, what is the logic or justification of this law...can you please suggest some way out and in the past where we were staying in the same area the charges from the Chs used to differ for 1bhk and 2 bhk....it was less for 1bhk, how come is it so...please try to answer in comments.

    In my society maintenance is charged equally to all .. however smaller sq ft flats face higher burden compared to bigger flats...there are 3 flat configuration 635,518,450 so 635 is charged 4822,4612,4502 respectively this way of u divide amount by sq feet it shows smaller flat which is 450 sq ft is paying at 10 rs. And bigger flat which is 635 is paying at 8 rs...this becomes burden for smaller flats...while buying & selling of flats the value is derived per sq feet then why not maintenance according to sq ft...smaller flats pay more technically

    माझी Pollens Recidens society kalepadal Hadapsar Pune येथे आहे.खूप विचित्र पद्धतीने mentenance घेतला जातो. सोसयटी मध्ये one BHK and 2 BHK असे 44 फ्लॅट आहेत, one BHK RS.1000 and 2 BHK RS.1000 maintenance and also charged as a Maintanance on RS.200×1 for One BHK bathroom and RS.400×2 for 2 BHK bathroom असे चार्ज केले जाते आहे. म्हणजेच 1200 &1400 अनुक्रमे 1BHK and 2 BHK maintenance घेतला जात आहे. मी विनंती करूनही अध्यक्ष सेक्रेटरी एकण्यास तयार नाही. काय करावे?

    Your video is very informative. Our housing society has 180 flats and 22 shops. These shops are facing the road and some of the common amenities like lifts, swimming pool, security etc are not available to them. We had proposed to charge them equally as per the bye laws and Cooperative society act. However we have received a request from the shop-owners that they should be charged lower as all services are not available to them( as pointed out earlier). So can the general body in an EGM pass a resolution amending the bye laws, to the effect, that the shops can be charged say at 75% 0r say 2/3rds the charges paid by flat owners on principles of equity? The Flat owners are now paying Rs. 1,500 per month. So can we charge the shop-owners Rs. 1125 /Rs. 1,000 per month based on mutual agreement and resolution passed by the members in an EGM? please clarify whether this can be done?

    Hello mam, I need your suggestion on maintenance charges which I pay. I live in a society where each bunglow have one ground floor and a first floor. I have rented first floor and my landlord lives in ground floor. The maintenance charges my landlord pays 3600 INR and I also pay 3600 INR as a society maintenance charge. So my question is can society take two maintenances for one property? As I live on first floor of the bunglow? Kindly enlighten me

    Respected Ma'am, Can you please tell me how many members of a family can stay in a single flat? Actually one family having 11 members stay in our building in a single flat. But other flat owners have only 2-3 members. The family having 11 members has been asked to pay double maintenance charge.       There is nothing written about family members limit in CHS bye laws.

Hence please inform can we fill single triplicate form which has both the owners name and signature. Will it be valid?     अध्यक्ष सेक्रेटरी काही कमिटी सदस्य यांच्यामार्फत मीटिंग न घेता, न कळवता परस्पर निर्णय घेतात. मी कमिटी मेंबर असून आम्हाला निर्णय कळवले जात नाही.सगळे निर्णय फक्त व्हॉटस् अप ग्रुप वर टाकले जातात. Very horrible everything. Please suggest what I can do. against that.

      Give one notice to society and acknowledge same and wait 1 month for reply if revert no received by society then submit your all complaints to registrar with keeping cc to AUDITOR.

    Hi Ma’am, I am owning few commercial shops and in my society the maintenance charges of residential is 6.74rs per sqft but for commercial shops on Ground floor its 19.85rs per sqft and for first floor shops its 13.23rs per sqft
    But the facilities provided to residential is 24/7 water supply and many other facilities but they are providing less facilities for shops and charging high maintenance rates.
    So is it fair and if not what actions need to be taken?

      Common charges to be divided equally only exps like property tax will go on area basis ..pls take it up with Ur managing committee

      @@sahakarviswa2020 Hi Ma’am, In our society the managing committee is not giving permission for FIRE Exit at backside of the society bt they have given the same to other shop.
      What’s the solution i have also submitted the agreement and architects letters bt they are not responding.

    उपविधी, कायदे कानून शासन निर्णय, परिपत्रके इत्यादींचे चे उपनिबंधकाच्या आशीर्वादाने पालन केले जात नाही अश्यावेळी कोणत्या बाबींचा अवलंब करावा ह्याचे शिक्षण सभासदांना देण्यांत यावे.

      Aap services use karo ya na karo common maintenance aapko bharana hota hai ...agar bill galat calculate ho raha hai toh committee to letter likho aur registrar ko approach karo...if you need any professional help you can get back to us

    नमस्ते मॅम, आमची एक आर्मी सोसायटी आहे. त्यामध्ये एकूण पाच बिल्डींग आहेत. त्यापैकी दोन बिल्डींग सहा माळयाच्या असून प्रत्येकी 36 युनिट असून सर्व समान 1008 चौरस फूटाच्या आहेत. दुसऱ्या दोन पांच माळयाच्या असून प्रत्येकी 20 युनिट असून सर्व समान 1450 चौरस फुटाच्या आहेत, शिल्लक एक पाच माळयाची असून त्यामध्ये पण 20 युनिट असून सर्व समान 1755 चौरस फुटाच्या आहेत. सोसायटीमध्ये सार्वजनिक हॉल, सुरक्षा रक्षक, साफाई कर्मचारी, सुरक्षालाईट व पंप हाऊस लाईट इ. कॉमन सर्विसेस सर्वांना दिलेल्या आहेत. प्रत्येक बिल्डींगसाठी एक लिफ्ट असून प्रत्येकी बिल्डींगची पार्कींग लाईट व गॅलरीची लाईट सुविधा दिली असून प्रत्येकाचे सेपरेट लाईट बिल येत आहेत. लिफ्टीची AMC एकत्रच एका डिलर कडून करून घेत असतो.
    महत्त्वाच मुद्दा हा आहे की काही सदनिकाधारक हे मासिक मेंटेनंस हा चौरस फुटानुसार घेयला पाहीजे. हा खुप वादाचा प्रश्न निर्माण झालेला आहे. आम्ही सर्व 132 सदनिकाधारक हे आर्मी बॅकग्राउंडचे आहोत. आधिकारी लोक जे आहेत ते खालील वर्गाच्या लोकांवर दबाव आणतात. यातून एक मार्ग काढला की जे कॉमन सर्विसेस आहेत त्यांचा खर्च सर्वाना समान भागात वाटू व प्रत्येकी बिल्डींगची पार्कींग लाईट व गॅलरीची लाईट लाईट बिल, लिफ्टीची AMC त्या त्या बिल्डींग वर टाकू. त्याप्रमाणे आम्ही मागील वर्षी केले पण. त्याप्रमाणे येणारा मेंटेंनस रिकव्हर पण केला. परंतु पुन्हा एकदा ह्या मुद्दयावर भांडण निर्माण केले आहे. तरी आपणास विनंती की या वर काय मार्ग काढला पाहीजे की जेणेकरून कोणावरही अन्याय होता कामा नये.
    सदया आम्ही सर्वजण 1000/- मासिक मेंटेनंस घेतो व एक वेळेला सर्व बिल्डींगचे लाईट बील व लिफ्टचे AMC एकत्र करून येणारा खर्च काढून ज्या बिल्डींगचा खर्च जास्त झाला आहे त्याकडून वन टाईम वसूल केला जातो. पण यावर्षी ते नकार देत आहेत. यावर काही न्यायीक निर्णय असेल तर कळवा व आपल्याकडून काही मदत आसेल तर त्यांची काही न्यायलयीन ऑर्डर असेल तर कळवा, ही नम्र विनंती.
