When they say FAULT you correct them "NO no not FAULT, the word is CAUSE". Just remind them that FAULT implies blame and CAUSE is the reason. "No officer the CAUSE of them locking the prison down would be a drone flight, but the flight is legal so it's not at FAULT for anything."
We shouldn’t expect too much from these guys. They are learning as they go. So if we legally do something that someone doesn’t like the police are willing to criminalise us because they can’t be reasonable and ensure that our rights are respected. We shouldn’t have to beg them for our legal rights.

They did have the final say, they said no lower than 165 ft, it was the prison wetting their panties causing the drama. CAA had set the precedence ,(over ) the prison, that the prison does not control, over 165 feet.

You seemed to agree with the Police & Prison that they would have to lock down. Why would they HAVE TO lock down ? Do auditors realise that flying a drone over a prison gets all the prisoners locked in for hours on end. Things are bad enough for prisoners who are normally the most vulnerable in society without a twat trying to get hits on their RUclips channel.
Logically then they should be in permanent lock down, because anyone can fly a drone over that prison at anytime. Surely the prison service worked with the CAA to get these flight restrictions put in place, so they must have agreed with that specific height restriction.
The prison doesn't have to put everyone into lock-down. The prison is making a conscious choice to do it. They don't have to do it, they are making that decisions independently.
As A microlight pilot with a full pilots licence group D which is the lowest weight rating for a private pilot you can fly anywhere that is legal IE all airspace in Great Britain is governed by the CAA and you do not have to phone in to anywhere or anybody as long as your flying legally which all trained pilots are aware off. And these rules do not change much for drones as long as you stick to Air Law.
Actually the rules are completely different for drones as aircraft cant fly nearer than 500 feet to any person animal or structure except for take off landing and emergencies. Drones can.
@@beniceffs ppl a group d is for microlights and similar weight aircraft A is for the Largest weights aircraft including all passenger aircraft, B is for all military aircraft and maybe others in same weight group and C is all small light aircraft and D microlights, there are now certain lightweight microlights and similar flying craft where you don't need to be licensed but the craft does need CAA approval and registration, think this is below 200kg.hope this helps
@@beniceffs Allso I hold a full pilots licence but when I started flying I held a restricted licence which meant you could only fly solo within and no more than 15 miles from base or take off but you could do a triangular route to certain outlandings to gain enough hours towards your cross country qualifications and to gain more hours and experience towards your full licence.
Got to give all credit to the police on the phone, polite, professional, respectful and impartial. The cops that showed up were certainly attempting to be helpful, but clearly an issue that not many will be qualified to deal with. Level restriction limitation is SO obvious eg planes at 30k feet fly over the country everyday unrestricted. So probably nowhere is totally restricted from ground level up to space. There has to be a cut off level BELOW which MAY be restricted. Well done Michael for spotting this.
The other way. The rules used to be strange, Above 25K feet in the UK, it was unlimited for gliders for example. That's changed. Typically its not restricted low down, with more restrictions the higher up you go. The low level is for obstacles and airports.
(Off topic but interesting) To be clear when the altitude of a plane is less than 12.5k feet, there is no supplemental oxygen required for anyone in a private aircraft. Between 12,5k feet to 14k feet, supplemental oxygen must be used by the flight crew for any portion of the flight that is longer than 30 minutes. Not many gliders would ever attempt 25k as there's so little air to provide lift.
@@nickbnickb5262 I've regularly flown over 25k. UK record is 38.6K. World record is much higher. On the oxygen front, the issue is above 40k you need to have oxygen with positive pressure. That's only good to 44K. Above that you need a suit or a pressurised cabin, [or both in case of failure]. The current glider record is 74,298 ft.

If it was illegal it would be restricted on your drone hardware, that said bye laws may stop you doing it, I was flying my drone in the NY moors national parks, I was stopped by a ranger who informed me that it was illegal. Your more than reasonable with your actions when gathering footage and it seems this police officer is educated to a higher degree than most we see these days which is great to see. I believe that the prison's response was a kind of emotional "blackmail" ... i.e., if you legally fly your drone over the prison at 400 feet, we'll put the prisoners in lockdown. taking away their freedom to associate and to exercise etc. and have the prisoners banged up in their cells. Not a nice thing to do IMO. I have to admit that if I was a "droner", I'd not want to take away the prisoner's rights to associate etc. so I wouldn't fly over ... but that is purely a personal thing and I wouldn't criticise you for doing so ... it appears that this is a right which you have and you are very likely completely within your rights to fly over the prison at 400feet.
i have to agree ,as with this covid buisness the prisoners have been locked up 23 hrs a day , just for the sake of flying a drone over cause its legal doesnt realy justify all the hassle the prisoners have to go through , ime not being negative towards auditor it just my personal opinion,

Nobody cares about cameras and photos. That's why the FRZ ends at the prison's outer boundary. The reason the FRZ is directly over the prison is so that people don't drop drugs and mobile phones into the prison.

Hi guys , Hmp Leeds does have a max limit of 164ft above ground you are correct , however the prison is within the Leeds /Bradford CTR ( controlled traffic region ) class D airspace so from ground to 8500ft , this then cancels out the right to fly over HMP Leeds . Unlimited will never happen. It would cause too many problems. There’s already restricted airspace defined above the prison. Leeds airport is just under 10 miles away.
They must think you’re as daft as they are. ‘Come back Monday’ and speak to security’! Then on Monday the security will no doubt tell you a bunch of lies and say you can’t do it. Ring back in 20 minutes and we will threaten you with arrest. The authorities always say it’s ok to film but it would be polite to let us know first. You politely let them know and they ignore the law and fob you off with a bunch of rubbish.
You have way to much faith in people who write software. The law is not defined by software programmers but the Government. If DJI screws up YOU go to prison.
As a qualified ppl pilot I have flown many times over HMP Parkhurst at a height well above any restrictions but able to see prisoners with my naked eye I .e about 1000 feet with no prior notification to the prison . If your within the air law then why notify them? I can even fly lower than 500 feet to buildings or people if practising an emergency landing which a lot of people misunderstand.
Would it be worth getting something in writing from HNK solicitors too. My thinking is, although legally you can fly above the prison higher than 164agl, the prison seem intent on lockdown for 'security reasons', also if that's the case that cop said you will then be breaking the law by breaching the prisoners human rights etc. So Would it be worth speaking to HNK solicitors because surely the prison are stopping you from doing a legal activity as it would end with you getting arrested so surely the prison are breaching your human rights? It's not NNY breaching the prisoner's human rights. Its the prison for being stupid and locking down for nothing. If they don't lock down because a private plane is flying over, then they don't need to do so for a drone flying above 165'. Even with a zoom, there is very little detail that can be captured on the drone's camera.

In this video nny has done everything correctly and has tried to work with the prison but they're not interested. He's even contacted caa to explain. So hopefully the police will see a solicitors input and then tell the prison nny is not breaking the law and leave him to fly his drone.

Back in the seventies I use to skydive at place where we use to open up directly over a prison and circle around over the top before making a final turn towards our drop zone (airfield). No idea if it bothered anyone. Coincidently my brother in law worked there.

I disagree with this one. The explanation from the officer about what to do next was wrong. NNW had the RIGHT but also had tried to be reasonable and inform the prison. The onus was then on the prison. They could have asked to examine the drone (costing just one officer temporarily). Even the attending police could have examined it. This was an example of the Police taking the side of an institution even when it appears (so even if he was unsure) in the wrong. He was wrong saying 'what they allow' - they allow nothing, and have no right to PREVENT anything.

Very interesting angle you've taken, thinking outside the box on flight restrictions. Possibly the reason they have it at 160ft no fly zone rule is you cant drop something with any great accuracy from that height and you cant recognize inmates faces from that height, so you should be fine.

The DJI Mini 2 is a fantastic bit of kit but I would *NEVER* buy one solely because of the geofencing. If I buy a drone I expect that it is me, and only me, who controls where it flies -- not some clown half a world away in Shenzen.

If this is a public nuisance then ANY drone flight is a public nuisance. Makes you wonder if that is true why they bothered to have any drone regs if they can hit you with that law.

I think this was a fantastic audit, you gave the prison the courtesy of letting them know what you wer planning, (and yes prisons are a no low fly zone because of drones taking in contraband). but this flying would be within the law. I can fully understand why you didn't fly ,other auditors may have flown, and risked false arrest. I really really hope you get to revisit and drone film.

I was under the impression that prisons are restricted simply because people can use drones to drop items into the prison yard, as has happened in the past. It is common sense, and I don't actually think it should be tested, as it is not a good idea. YOU may not have any underhanded intentions, but others could exploit it.

HMP prisons give the inmates bugger all exercise time in the yard anyway, the only thing you will see is the screws skiving off. The prison control room operator said they only had a skeleton staff on duty so it's unlikely the prisoners will even have normal association.

If it was illegal it would be restricted on your drone hardware, that said bye laws may stop you doing it, I was flying my drone in the NY moors national parks, I was stopped by a ranger who informed me that it was illegal. What on earth is so scary about a drone flying over, there are aircraft that fly over that jail every day. Well done buddy, fly on.👍

Your more than reasonable with your actions when gathering footage and it seems this police officer is educated to a higher degree than most we see these days which is great to see. The fact that some police officers still abuse powers when you clearly demonstrate your knowledge of the law not to mention how well you reason with them is just mind blowing
NNY ... I believe that the prison's response was a kind of emotional "blackmail" ... i.e., if you legally fly your drone over the prison at 400 feet, we'll put the prisoners in lockdown. taking away their freedom to associate and to exercise etc. and have the prisoners banged up in their cells.
Not a nice thing to do IMO. I have to admit that if I was a "droner", I'd not want to take away the prisoner's rights to associate etc. so I wouldn't fly over ... but that is purely a personal thing and I wouldn't criticise you for doing so ... it appears that this is a right which you have and you are very likely completely within your rights to fly over the prison at 400feet.
i have to agree ,as with this covid buisness the prisoners have been locked up 23 hrs a day , just for the sake of flying a drone over cause its legal doesnt realy justify all the hassle the prisoners have to go through , ime not being negative towards auditor it just my personal opinion,

To be totally honest, I can't see the difference between flying a drone over a prison as opposed to say a Helicopter? Helicopter pilots can carry passengers with much higher quality camera equipment than a drone ever could? Especially a news outlet machine.

Nobody cares about cameras and photos. That's why the FRZ ends at the prison's outer boundary. The reason the FRZ is directly over the prison is so that people don't drop drugs and mobile phones into the prison.
The helicopter can pick up passengers.

every time i see someone fly a drone i see idiots coming out telling them they need to get permission first, so you try to get permission first to do something you have the lawful right to do and they still tell you NO !!, then they wonder why people don't bother to ask permission from every person who gets offended, this prison decided to punish the prisoners to try to get you to stop your lawful activity, that's disgusting, trying to pressure you into stopping by punishing people.
Hi guys , Hmp Leeds does have a max limit of 164ft above ground you are correct , however the prison is within the Leeds /Bradford CTR ( controlled traffic region ) class D airspace so from ground to 8500ft , this then cancels out the right to fly over HMP Leeds . Sorry for that news , love the interactions . Cheers 👍

Unlimited will never happen. It would cause too many problems. There’s already restricted airspace defined above the prison. Leeds airport is just under 10 miles away.
They must think you’re as daft as they are. ‘Come back Monday’ and speak to security’! Then on Monday the security will no doubt tell you a bunch of lies and say you can’t do it. Ring back in 20 minutes and we will threaten you with arrest. The authorities always say it’s ok to film but it would be polite to let us know first. You politely let them know and they ignore the law and fob you off with a bunch of rubbish.
It could be done without anyone in the prison even being aware.
If the software let's the drone enter that airspace then it IS lawfully.

The law is not defined by software programmers but the Government. If DJI screws up YOU go to prison.

As a qualified ppl pilot I have flown many times over HMP Parkhurst at a height well above any restrictions but able to see prisoners with my naked eye I .e about 1000 feet with no prior notification to the prison . If your within the air law then why notify them? I can even fly lower than 500 feet to buildings or people if practising an emergency landing which a lot of people misunderstand.
Would it be worth getting something in writing from HNK solicitors too. My thinking is, although legally you can fly above the prison higher than 164agl, the prison seem intent on lockdown for 'security reasons', also if that's the case that cop said you will then be breaking the law by breaching the prisoners human rights etc. So Would it be worth speaking to HNK solicitors because surely the prison are stopping you from doing a legal activity as it would end with you getting arrested so surely the prison are breaching your human rights? It's not NNY breaching the prisoner's human rights. Its the prison for being stupid and locking down for nothing. If they don't lock down because a private plane is flying over, then they don't need to do so for a drone flying above 165'. Even with a zoom, there is very little detail that can be captured on the drone's camera.
@@TheSadButMadLad I know yeah, that's what I mean, the prison are threatening to lockdown the prisoners knowing they can then phone the police and say nny is breaching their human rights when in reality its the prison who are doing that as they know there is no threat from nny and would be a waste of police time etc. If nny also had a supporting letter/email explaining how he has done everything correctly and has tried to work with the prison then when police turn up he can show them the letter/email then if he is arrested, it'll be a wrongful arrest.
In this video nny has done everything correctly and has tried to work with the prison but they're not interested. He's even contacted caa to explain. So hopefully the police will see a solicitors input and then tell the prison nny is not breaking the law and leave him to fly his drone.

Back in the seventies I use to skydive at place where we use to open up directly over a prison and circle around over the top before making a final turn towards our drop zone (airfield). No idea if it bothered anyone. Coincidently my brother in law worked there.

OK, so you're allowed to do it. But they don't want you to. So 1. The cop already tried to suggest you're causing a nuisance. 2. How is the prison putting people in lock down for something that's completly legal any fault of yours in terms of their human rights. The explanation from the officer about what to do next was wrong. NNW had the RIGHT but also had tried to be reasonable and inform the prison. The onus was then on the prison. They could have asked to examine the drone (costing just one officer temporarily). Even the attending police could have examined it.
This was an example of the Police taking the side of an institution even when it appears (so even if he was unsure) in the wrong. He was wrong saying 'what they allow' - they allow nothing, and have no right to PREVENT anything.
So to be free, you need to ask permission...news flash, freedom doesnt need permission

Very interesting angle you've taken, thinking outside the box on flight restrictions. Possibly the reason they have it at 160ft no fly zone rule is you cant drop something with any great accuracy from that height and you cant recognize inmates faces from that height, so you should be fine.
No, it was set at that level before drones. It was to do with Police/traffic/ medic helicopters.

The DJI Mini 2 is a fantastic bit of kit but I would *NEVER* buy one solely because of the geofencing. If I buy a drone I expect that it is me, and only me, who controls where it flies -- not some clown half a world away in Shenzen.

Hi,NNY. you can use different software on your DJI. The software. Litchi or Maven software.
I normally fly my Phantom 3 using the Litchi app. Always performs well and the setting of waypoints is much easier than the DJI app.

Both phone operators at the prison and the police were very professional and courteous. The police officer in the van was reasonable too.

If this is a public nuisance then ANY drone flight is a public nuisance. Makes you wonder if that is true why they bothered to have any drone regs if they can hit you with that law.

I think this was a fantastic audit, you gave the prison the courtesy of letting them know what you wer planning, (and yes prisons are a no low fly zone because of drones taking in contraband). but this flying would be within the law.
I can fully understand why you didn't fly ,other auditors may have flown, and risked false arrest.

Just a matter of time before the government close loopholes like this. They don't like people having rights or people having freedoms. It's the way of the world. Boris and co showed us that we have to strictly follow whilst those in power can flout or ignore any restrictions as they please.
You need to ask them about exercise times so you can avoid those times. Sort of stitch them up.
I was under the impression that prisons are restricted simply because people can use drones to drop items into the prison yard, as has happened in the past.
It is common sense, and I don't actually think it should be tested, as it is not a good idea. YOU may not have any underhanded intentions, but others could exploit it.
Then that's a mistake on their end, they can apply to the caa to get it changed if anything the auditor is pointing out a weakness.
@@robinelliott-ni2eh no it is already against the law to fly over prisons or in restricted airspace around airports. I have seen the interactive map on the CAA app that shows the restrictions.

HMP prisons give the inmates bugger all exercise time in the yard anyway, the only thing you will see is the screws skiving off. The prison control room operator said they only had a skeleton staff on duty so it's unlikely the prisoners will even have normal association.
