Respected Sir, What is the difference between contingent contract and wager agreement ? and also difference between contingent contract and voidable contract
A contingent contract is a contract, the performance of which is dependent on the happening or not happening of a future event. It is defined by Section 31 of the Indian Contract Act as "a contract to do or not to do something, if some event, collateral to such contract, does or does not happen." A wagering agreement is one where two parties bet on an uncertain event, which is the subject matter of the agreement. A contingent contract and a wagering agreement are both dependent on the happening of a future event. In a wagering agreement, the parties to the agreement do not have any interest in the event except winning or losing the amount of wager. In a contingent contract, parties have other interests as well. All wagering agreements are contingent agreements; however, the vice versa is not true. In a wagering agreement, the event is essential to the agreement whereas in a contingent contract the event is collateral to the contract.
Thank you so much sir, you are doing a great job, your lectures are too helpful amid this lockdown Sir one more small help i need, please tell difference between contingent contract and voidable contract
Voidable contract is a contract which becomes void at the option of the parties for reasons like non performance by the other party, incapacity etc. Voidable contract is valid under law but its performance is optionable. Contingent contract is a contract which depends on the outcome of a particular event. Contact of insurance and indemnity are examples of contingent contracts, as their performance depends on the happening of a particular event.
In sec 33 uncertain future event if not happen then it can be enforced or if event happen then contract void but in this sec there are chances that event happen or not happen but in sec 36 from the very beginning contract become impossible to happen there is no chnace to that impossible event happen so that is become void
In a condition precedent condition is separate to contract which needs to be fulfilled before the enforcement of contract. Whereas Contingent contract is collateral or incidental to contract and it's enforcement depends upon the happening or non happening of that event.
