(1) People belonging to BPL have no right to marry.
(2) Husband is liable to give maintenance even if wife earns more than him.
(3) Wife should not give affidavit in any situation to disclose her income and assets.
(4) My (this judge) own home made laws are above of supreme court's decisions and laws of the land.
(5) A poor man can't marry well to do woman.

He had very good points to argue on but unfortunately he was unable to. Judge will try to scare, try to make an advocate come to the point where he will have to compromise but that's where an advocate should stick to his submissions with confidence and object to his Lordships in respectful manner.

Judge looks biased. If man is earning less than wife then it is mentioned that spouse has to maintain the partner (based on law) not Husband has to maintain the wife. Stating this, "If you cannot earn why did you marry". It clearly against their mutual decision. A poor man has all the rights to marry someone. Justice should be served based on law and facts.

Below are the remarks after seeing entire video
1-Advocate not define why wife left the husband.
2-Judge have to consider or even have a look how much wife is earning ( If defence file any support document) .
3-Defence not came with propose preparation. There are so much points he misses out.
4-If its true that husband done the 2nd marriage than automatically it is well settle law & judge have to come on this point on a serious notes.

Shame on such a biased judicial system. This judge is making a statement that the person married a girl without income, how can he be so sure that the person was not earning any money at time of marriage. What if after a few years of marriage a person becomes unemployed?

Anpadh neta law banayenge toh yehi haal hoga ? Isliye parliament member ki minimum educational qualification graduation honi chahiye. Husband wife ko maintenance money dega yeh law uss time ke hisab se tha jab sirf husband kamata tha magar society, ladke aur ladki ki family women ko bahar kaam karne nahi deti thi magar aaj ke time situation change ho chuki hai isliye law mei bhi reforms hone chahiye.

why cant the same arguements be used in custody case. wives keep filing cases for maintennace and that she has no income but when it comes to custody, the court ignores all this and hardly gives custody to the father.

It’s curious someone earning a mere three thousand a month has the means to contest a case in High Court. Once a marriage breaks up, a man’s reluctance to pay alimony is understandable. If the wife is earning well and unwilling to cohabit, the husband can also seek maintenance under the law.
By seeing this argument I would lose my belief in Indian justice. Judges are looking biased then why would we go to them
