    In a significant judgment, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has ordered a developer to pay interest to homebuyers for the delayed possession of their flat, even though the occupancy certificate (OC) was obtained within the agreed timeframe. Lt. Col. Pratap Rajnish Singh and Mrs. Smita Joshi Singh filed a complaint against Pearlite Real Properties Private Limited, the developer of the "Godrej 24" project in Pune, through their advocate Gandhar Sonis. They had booked a flat in 2018 with a possession date of 30th September 2021. Although the OC was issued on 20th March 2020, the complainants did not receive possession until September 2022, and finally moved in on 10th January 2023. They amended their original complaint, seeking interest and compensation for the delay instead of a refund.
    The key legal issue was whether the complainants were entitled to claim interest under Section 18 of the RERA Act for the delayed possession, despite the OC being obtained on time. The developer argued there was no violation since the OC was received as agreed. However, the MahaRERA bench, led by Shri Mahesh Pathak, found that the developer failed to prove that possession was offered after obtaining the OC. Under Section 19(10) of the RERA Act, allottees must take possession within two months of the OC being issued, which the developer did not comply with. Therefore, the bench ruled that the complainants were entitled to interest from 1st October 2022 to 10th January 2023. The developer's claim that the delay was due to the COVID-19 pandemic was rejected. The MahaRERA's decision underscored that the developer had violated the provisions of Section 18 of the RERA Act.
    The MahaRERA partly allowed the complaint, rejecting the claim for compensation but directing the developer to pay interest from 1st October 2022 to 10th January 2023 at the prescribed rate on the amount paid by the complainants towards the flat's consideration. The complainants were represented by Advocate Gandhar Sonis, while the developer was represented by Ld. Adv. Prabhakar.
