From watching Judge Judy I've learned that if something bad happens you need to go to the police or the hospital immediately if you want to be taken seriously on court.
Its a hard sell to say someone caused you so much pain and suffering that you feel the need to sue them, but took 3 days to go to the hospital to get it looked at. I would also say its somewhat indicative of our current Health Care system, where people will often put off getting non-life threatening injuries looked at, because the hospitals charge $500 for a band-aid. So most will hold off getting an injury looked at until it either gets worse, or persists with pain for a longer time than you feel it should last.
That’s common sense
@@Eros4tw I'd at least hit a med center, or an urgent care if I couldn't justify a hospital. It's only marginally cheaper, but it's documented that you made a same day effort to alleviate your pain/problem
@@Eros4tw Yes, it's totally reasonable to think that she didn't go to the doctor right away, because she couldn't afford it. She's 71 years old working multiple retail jobs. She probably doesn't have a lot of disposable income.
I love Judge Judy, but it does bother me that she's more than happy to rail against social programs, saying they're what's wrong with this country, but never addresses health care costs, which are a far greater burden on the population as a whole.
Or at least, sue the right person, the defendant didn't even spray it, a customer did!!

Things people put off getting treated right away, AND SHOULDN'T. Most can be treated and minimize damage with immediate help, but people usually "wait and see" 🙁
When you are so poor, and can’t afford to miss work, you make different choices. I encountered a young women, while out doing my daily morning walk. She was dazed, her clothes were torn, and she had some bruising. Upon questioning her, I discovered that she was a victim of a sexual assault. I persuaded her to call the police. When the police arrived, after questioning her, he suggested that she go to the hospital to be examined. She declined to go, because she said, “ I can’t afford to go to the hospital, because I don’t have any health insurance..” The police officer and I impressed upon her that she needed to go, to gather evidence, and that she would not be billed . When someone has financial challenges, there choices follow accordingly.

HUH? Why sue the person who owns the stand and not the person that sprayed the product? Is her argument that the owner of the product should have secured the products from others before stepping away and because they didnt its their negligence?

I believe the plaintiff is suing the wrong person here; the defendant didn't cause the "injury" to her eye, a customer did (and it was most likely an accident). Not everything is a lawsuit ... case dismissed.🤨
Plaintiff is as hoping defendant was working for a big company as an employee. Didn’t realize it’s just and old lady mixing potions in her basement.
Probably tried to sue the store too but was given a pack of coupons and laughed out of the parking lot.

This reminds me of the time I was at Best Buy. I went to the front desk to pay for my items and there was a bottle of hand sanitizer. I squeezed some into my hand but some got into the cashier’s eye! It was a one in a million chance for a tiny speck of it to land right in their eye but it did. I felt horrible and apologized so much. But the cashier didn’t sue me!

@@justinenicole3926 Essential short term money is less important than your essential eyes. Besides, there's always been medical facilities you can go to any time of day. She didn't seek treatment and it got worse. I don't see how the defendant is responsible in any way. Accidents happen.

@@Mybpeterson If you cause an accident you are still responsible for it. If I knock someone down by accident and they are hurt I still caused the problem accident or not. People are held responsible for accidents.

I know the conversation is about JJ being upset about her not going to the doctor right away but why would this lady be responsible for SOMEONE else spraying her products in the plaintiff's eye?? I've gone to places where I've had a booth or helped someone who had a booth/cart and there are times when you do need to walk away. To use the restroom would be one thing. I don't know how that makes her negligent when the customer who came by thought it would be appropriate to touch things in a booth that wasn't theirs.

Anytime someone accidentally sprays something in their eye that is an irritant, they need to flush it for 10 to 20 MINUTES. The Plaintiff didn't go to the Doctor for 2 days. Someone was negligent and it wasn't the Defendant.
It would make more sense if she sued the person who sprayed it instead! She waited 3 days, and kept rinsing her eyes out, probably using water from different location. Who knows, maybe one of the tap water she used was bad 🤷
A supermarket would have had an eyewash station. Plaintiff should have immediately went and rinsed it out.
