Steve you are mixing up battery and assault. Assault is putting someone in fear of apprehension of bodily injury. Assault does not require physical contact. When someone threatens to hurt someone, that is assault. In the case of the guy at 27:45, that was assault with a deadly weapon. Battery is the actual physical contact. When the guy in the truck hit you and your partner, that was aggravated battery on a law enforcement officer and aggravated battery with a deadly weapon.
