    i recently opened up a consulting business LLC but would also like to start a dba to start selling merchandise (different brand, different purpose). Applying for the DBA seems pretty straight forward but do i have to update my operating agreement or any other official document ?

      Most LLC owners choose to amend their operating agreement when member responsibilities, business operations, or asset contributions change.
      Small changes, like branding a part of the LLC with a DBA, are generally added to a list of less significant alterations.
      These alterations can then be added to the operating agreement during an amendment to member responsibilities, changes in the way assets are contributed, and operations of the business.
      The DBA portion of an LLC doesn’t require a new EIN. Some business owners choose to open a separate bank account for the DBA name.

    I'm planning to file a DBA for my sole proprietor craft business in New York county, that being my primary location of business, but may do craft fairs, pop-ups, and/or wholesale to other counties in NY. Do I need to file a DBA form in each county where these occur? ie. each county where I may participate in a craft fair or sell wholesale? Thanks!

      New York state has different DBA filing laws for sole proprietorships, general partnerships, and other incorporated entities. As a sole proprietor, you are required to register a DBA name, known as a Certificate of Assumed Name, in each county that you wish to conduct business in.     Hi. I wanted to know if I have a LLC already for an apparel line but want expand to creating a beauty line should I file a DBA to have a second entity under my LLC? Like a parent company and a subsidiary company, would that be the way to do it?

    You can use a dba as a subsidiary company under an LLC?

      Hi Kesh! The DBA is another name for your company. Business owners usually get a DBA for their company if they decide on a better name that suits their brand or would like to have different stores with different focuses but are still technically the same company for legal and tax matters. So as for your question, you could have a subsidiary focused part of your company, but it would still be the same company technically.
