- The IEC is calling on the Electoral Court to decline MK Party's withdrawal of the legal bid to have the May 29th election outcomes set aside. The MK party claimed that the elections were not free and fair, and alleged to have evidence to prove the polls were rigged, but withdrew this bid last week. Legal Director at the Institute for Election Management Services in Africa Nkululeko Tselane has more.

Only a court judgment can provide legal certainty in this matter; it must be revisited in court and tested.
But unfortunately the Electoral Court deals with urgent cases related to the election. Withdrawing their case does not bode well for the urgency component, and their case might be dismissed if the file again.
The question should be where do you get these analysts that give you the questions in advance?

There are small problems in every election but they don't affect the overall picture.
All disputes were dealt with by the IEC and some recounts were done.
There is no evidence of widespread manipulation.

Withdrawal is temporarily. Matter is legal and some aspects found to be criminal. The matter must go back to court. However, if the electoral court wants to dismiss matter by responding by means of a MEMO , then MK must witdraw case. The electorate needs a public transparent court case. MK must take the time to regroup and send matter back to court. IEC cannot be left to do the same thing over and over again and expect a different result -thats INSANITY. Nor should it be allowed for electoral court to dismiss case using a memo to MK.
That's what MK is plaining to do, they said they are withdrawing the Initial application but they are going to submit another one, what is discussed here is not true reflection of what MK said

But Let's say you're right, if the evidence exists and the court decides to rule against MKP, they can always appeal to the higher court.
