  • The IEC has lodged an appeal with the Constitutional Court over the electoral court's ruling which allows former president Jacob Zuma to contest the 29 May elections. Earlier this week, the electoral court set aside the commission's decision to disqualify Zuma from taking part in the upcoming polls.
    Legal analyst Zola Majavu weighs in.

    Mr Zola Majavu is 100 percent right. The IEC must get ConCourt’s understanding of the Order. For instance the definition of ‘remission’. That is “Remission of sentence is the reduction of the term of a prison sentence…the order of conviction and…sentence remains unchanged…”.

      you cannot separate sentenced to serve in prison and sentenced by court if one is sentenced to death and get remission it mean the death sentenced is being reversed because that person will actually end up not being killed,,my understanding

      You're very right that if Ramaphosas' stoedgey Zondo could have done things the right way Zuma couldn't even have won the case in the first place. Now the IECs impartiality and independence is to be questioned.

The courts are there to attend to legal disputes - take MK Party and Zuma out of the process itself for a moment and consider the implications of a wrong interpretation of law. These matters have to clarified no matter who is wrong or write, if MK Party succeeds or lose then the matter will be settled and clarity obtained. Don't mix political views with law.

      This is the most path*tic comment thus far. Yes, if you're referring to 22 objections as being the decision of judges, then you're correct. Their ruling represents a majority's concurrence. If 60 million is us the population, then you're stating that we should all be judges, and that can only be possible on the 29th of May 2024.     I would have been so pleased if Mr Majavu have given us the grounds on wich this matter should be the matter deserving appeal, agency andy it should be regarded as matter in the public inerest. I think what is in the public interest is why is it the IEC that is so adamant that the order is not the correct order.

Otherwise the pressure they will be under if they decide to sit on this matter, they will have no choice but to rule in favor of Zuma, if not the Concourt will lose its credibility

    Why they dont ask the Electoral court to expedite the reasons. How can the Apex court pronounced on a matter that is not finished in the electoral court. The reality is they hope someone there a friend will try something. This is a character of a corrupt people. God save SA.

    Why are they challenging a judgement they have not seen yet? Why not wait for the judgement and challenge the reasons in the judgement? The ConCourt should throw the matter out on the grounds of lack of urgency first because there's no judgement yet. This rush is undermining the Electoral Court judges.

      Your wisdom would be outstanding if you applied the principles of the law. Biased in your view/opinion is not a universal standpoint. We have courts for a reason and if you are familiar with the law you would know their purpose. It's important not to allow personal frustration to shade the principles of the law, where provisions are available every entity has the right to exercise and enjoy their legal rights

    Question is didn’t the PMB court issue an order and say it will provide reasons at the end of the arms deal trial???
    So the labour court issue an order and say they will issue reasons not after the election then IEC runs to con court for clarity, sounds like they’re saying con court compel that court not to issue reason anymore but ruling on this matter 🤣😂🤣😂 Roman Dutch law

    The section in question here is the application of section 47(1) - the Exceptions start from a to e. That's how everyone must read it. They just give MKP more airtime.

    I think the remark of Zola Majavu on the matter relating to Zuma 's eligibility to stand for election is well balanced. To me his mentioning that this matter has reached this predicament because the Concourt acted as an arbitor in the matter than needed to be ventilated in an ordinary court of law initially. As it is known the judgement to sentence Zuma was given by the Concourt instead of it being given at a lower court where Zuma would have had an option for a fine. This never happened but according Zola Majavu the Concourt remains a final arbitor in this matter.

    I don't want to speculate on the motives of the IEC, especially since they have not had the benefit of the Electoral Court's ruling, other than that they were not allowed to exclude Zuma.
    From a purely legal standpoint, I would like to know who has the authority to decide whether a person is seated in the National Assembly and under what provision of the Constitution. The Constitution merely states that a person is not eligible under certain conditions but not who is responsible for enforcing that. Tselane's viewpoint needs to be tested and is not the law as it currently stands.
    Who then takes responsibility for eligibility checks, if not the IEC? Must the National Assembly conduct eligibility checks after the election? No other court can make a final ruling on the constitutionality of any matter. Only the Constitutional Court has the final say on all constitutional matters. That is the law.
    But I agree that the IEC should have waited for the Electoral Court's decision before approaching the CC to see if the Electoral Court provided a constitutional basis for its ruling or whether it was based on Zuma's conviction for which he received a pardon or remission, and then appeal, if necessary. Right now, it is seen as a clumsy handling and creates suspicions of impartiality.

    I failed to understand this. Who is the IEC appealing against? Zuma or Electoral Court decision. Secondly what reasons or reason for the appeal. As far as I understand the Electoral Court has not furnished anyone with the reason. Thirdly, Zondo has just said these trivial matters should not been brought before the Apex Court, why accepting this circus of IEC and EC to waist tax payers' money? Is it coz of Zuma?

      the chapter in question has to be interpreted by a Apex court because it involves the constitution and IEC is appealing against the judgement and its not a trivial matter its a constitutional matter
