    Dr Mpofu and Jamie I was thinking about this ConCourt case regarding President Zuma. If they judges agree that the sentence given to President Zuma was unconstitutional, would that mean they have to account for 300+ people that died because of the judgment they issued to Zuma without a trial?

      You make an interesting comment nkokheli. There is an interesting other side of the coin that may protect the judges behind same judgment.
      You will recall that there was a finding that there is no link between the arrest of Former President Zuma and the unrest.
      To bring sanctions against the CC judges may require a review of the findings that say there was no link between the unrest and the arrest Former President Zuma.
      Again I'm not a legal person hense I could very well be interpreting these complex issues correctly.

    Spot on again guys - Judges, lawyers, political analysts, journalists are human beings also, they are as biased as we all are. Zuma is right to fight for his rights. Zondo and Madonsela are against Zuma through and through.

    The more these judgements are scrutinised, the more we are led to question the integrity of the judiciary as a whole

      Ramaphosa paid ConCourt, & he is trying all he can to buy his was past 50+1% , but will fail.
      IEC doing the best to suppress MK.

      My take is that the Zondo Commission was setup by Thuli Madonsela on the findings that Jacob Zuma was at the heart of the so-called State capture. Of course, the Commission could have subpoenaed Koos Bekker, thus charging him with "contempt of court" should he still refused to come before it to give evidence. But Jacob Zuma, given that by law he needed to answer to the charges laid against him as an "accused," he simply does not have the same luxury as the one who was to appear to give evidence. But of course, you and I can debate whether the apex court should be used as a court of first instance. There, I can't fault you.

      Naspers CEO didn't take the oath of office and fiduciary duties are not the same. The CEO of Naspers is a private citizen but the former president JZ took the Oath of office to abide to the laws and constitution of the country. What he was requested to do it was to testify for what is alleged has happened during his office as the former president of South Africa.

      @@mohaleshai5139 He was no longer a President. Anyway, section 5 requires a forum where appeal is possible.
      The APEX Court is Court of first instance on pure Constitutional matters. The drafters of the Constitution could not have foreseen that criminal Mafias Ramaphosa/ Zondo would use their power to put a contempt matter direct to ConCourt
      PW Botha refused to go to Truth & Reconciliation & Tutu refered him to magistrate Court for a more serious Contempt.
      That urgency was FAKE, report was more than a year latter & is rotting in Ramaphosa, he can't uses, point largely to ANC, though Zondo didn't even follow the TOR, he confirmed it to anything that will make Zuma bad. He never pursued Gencor evergreen contracts

    Sometimes 'anti- capital rhetoric' is an unfair barometer to assess if a person should be mainstreamed by media, the fact that jamie is so peripherally platformed because his political analysis is uncertified by the directors of the official narrative, negatively depicts our nation's attitude towards the project of harnessing productive intellectuals.

    A mind-boggling interview. Classical analyst needed in this era of turbulence and disruption leading to elections. Is the so called bench assigned for this case listening to what is at stake here?     Thank you for this very thought provoking discussion. To me the long and short of it rests to a greater extent on how the concepts power and people are defined especially by our leaders. Unfortunately and especially our crop of elderly African leaders have always taken power more at personal level rather than using rationality. The more personal one looks at a thing the more one invites emotions and one finds themselves taking decisions to fix someone.

    Let's not forget that Pres Zuma walked out of the commission and went to court for an appeal. Why was that ignored....

    I really appreciate the analysis on this and Jamie makes a lot of sense.
    On the point of Zuma protesting the Con Court and ending up in jail. Judges are people and they will make mistakes. That's why you have more that one judge at these higher courts, the legal system is not perfect and will never be perfect. Zuma choosing to protest and not make presentations before the court disadvantaged himself. The reason we always have 2 sides making arguments before judges is to help the courts to come to a better decision. That's why you even have things like Friends of the Court, the aim is to make arguments and put all relevant information and scenarios before the judges so that they come to decisions that are thoroughly examined and thought out. Many of the arguments that Jamie is making should have been ventilated before the Con Court by Zuma and his lawyer to help the Con Court to come to a more informed decision.
    Even on the issue of the sentence that Jamie was arguing, the Con Court again invited Zuma to mitigate for himself and he once again declined that chance to help the court and help himself in the process. Instead, He and Mpofu only chose to go to the Court only when he was faced with the reality of jail.
    Personally, I just don't think Zuma has the best interests of this country at heart. He is a very wise and strategic man but unfortunately for us as a country, he uses all that to serve himself. Even if he wanted to protest what was happening, he could have simply done what Dudu Myeni did. instead, he chose the most destructive way to protest and let the whole country burn.
    Let's also remember that one of the reasons that Zondo wanted to end the commission was because of the escalating costs. People are now forgetting how everyone was on Zondo's case about the escalating costs. The man was under a lot of pressure from the same people that are now asking why did he go straight to the Con Court and not the High Court.

    Remission of sentence doesn't reduce a sentence but reduces jail time. The courts imposed 15 months, remission came from the President so the reduction of the sentence had to have been given by the court and above that, every case is expunged or a criminal record clears after 5 years, so Zuma's case may have been 15 months or even 3 as in this instance but the expungement is 5. Criminal record & fingerprints cleared of all crime or exclusion.

    How will MK be affected if Zuma is not going to Parly, as even if he wins, he still not be in Parly.
    He will be more effective as party Leader.
