The DEFENSE attorney should say, "Per the 6th Amendment of the Constitution, as the court appointment attorney, I am morally required to represent my client to the best of my ability. Are you suggesting I break my oath to the constitution?" Who would want an attorney we KNOW would NOT do everything legally possible to protect us. It's a political show. An attorney represents a client. A prosecutor represents the state. A judge decides. It's an attorney's sworn duty to advocate for a client, period. Called the adversarial system. You have it in England, long tradition, Barristers in court. Punishment can have a deterrent effect on others, I recognize that, but proper prevention of re-offending can also carry that deterrent. Simple punishment for punishment sake serves no real purpose. I disagree. A defense lawyer is required by "ethics" to do the very best job for his client. That's his job. It's a political show. An attorney represents a client. A prosecutor represents the state. A judge decides. It's an attorney's sworn duty to advocate for a client, period. Called the adversarial system. You have it in England, long tradition, Barristers in court. Punishment can have a deterrent effect on others, I recognize that, but proper prevention of re-offending can also carry that deterrent. Simple punishment for punishment sake serves no real purpose. Enjoying the suffering that punishment inflicts says something bad about the people who enjoy inflicting suffering.
When it comes to crimes against children, there should never be any type of compromise as to sentences. They should throw the whole library at them.

I generally agree with Sen. Hawley on many issues, however the defense lawyer has a responsibility to do the best for his client.

In all fairness it was his job to defend his client to the very best of his ability. The fault lies in the judge so why are you holding that against him when he did an effective job?
WRONG! His job as a lawyer is an officer of the court and the ONLY obligation of a lawyer to their client SHOULD be to assure they receive a "FAIR TRIAL". America's most dishonest professionals have turned that concept on it's head to where lawyers feel free to use ANY tactic to get their client OFF.
No. Most reasonable people with a moral compass inherently know that it is indefensible defending this garbage and yet certain individuals willingly do so using underhand, dubious tactics. As the comment above states there is a huge difference between a fair trial and the shameful behaviour of certain defence lawyers.
He was a court appointed attorney, not a privately hired attorney - there is a huge difference! He should be on a side of justice and follow judicially recommended guidelines - private lawyer has no such constrains!
@@Brave2standalone are you trying to tell me that because a person can't afford a private lawyer then he does not get a lawyer that actually fights for him to the best of his ability? Don't get me wrong, I honestly think that his defendant should have gotten a much more Stern punishment because this is completely unacceptable behavior!! But if I was on trial for a crime of some sort, I don't think it's fair or just put anyone put restrictions on my lawyer so that he can't represent me to the best of his ability.

What am I missing? Regardless of the crime a DEFENSE attorney's job is to DEFEND his client. Anything else would be unethical and could lead to a mistrial for not representing his client properly. It is the court's job to determine how much time to give. This is one time I disagree with this senator.

I understand the defendant is evil, but it is unwise for Hawley to ask a defense lawyer to NOT represent his client at the best of his ability. This is one of the purposes of the 6th Amendment of the Constitution. To have a defense lawyer that is not representing the defendant interests is to have NO defense attorney at all. He is NOT the courts' advocate, NOT the prosecutors' advocate, and NOT the victims' advocate. He is the DEFENDANT'S advocate. HE MUST DO EVERYTHING LEGALLY POSSIBLE TO HELP HIS CLIENT. To do otherwise is morally wrong and violates the defendant's 6th Amendment. If the 6th Amendment can't help the guilty...how can it help the innocent??? Careful what we ask for or our attorney's will be on trial right next to us. Oh, wait a minute. It is happening now with Trump. Too late.
