    If they say you've taken a picture of a screen, in breach of the DPA, then _they_ (as data collectors) have committed the breach and not you (after all, even if you simply looked at the screen, the same breach would have occurred), so this security guy is essentially admitting (on behalf of his employers) to a data breach. He's admitting to sensitive data being on display to the public . . . and they have 72 hours to report this breach to the ICO.

    • @tonyb1223
      @tonyb1223 Год назад

      Hence why you are not allowed to film in there, which means Reggie became a data handler and is subject to the same rules as the supermarket.
      Just think if Reggie had not used his camera, as he shouldn't have done due to it being private property inside, it wouldn't have caused any issues, but because he did, guess what? It did cause issues.
      So where does the blame lie, with the supermarket which is a private building and to film inside, consent is required, or the guy with a camera who wasn't allowed to film in the first place?
      Shouldn't be too difficult to figure it out...

    • @davelordy
      @davelordy Год назад +4

      @@tonyb1223 _”Just think if Reggie had not used his camera, as he shouldn't have done due to it being private property inside, it wouldn't have caused any issues”_
      Er . . . no . . . regardless of whether someone has a camera or not, if information is being displayed to the public the data handler is in breach of GDPR not the person who sees it. So, if there is a screen which is viewable by the public, and it’s displaying - for example - an account number or passcode, then it doesn’t matter if someone makes mental note, scribbles it down on the back of their hand, photographs it or goes outside and makes a voice memo . . . the fact is the data handler allowed it to be viewable to the public.
      _”So where does the blame lie”_
      As a data handler, the blame lies with the supermarket.
      _”the supermarket which is a private building”_
      A private building, but a public place, which the public has free access to.
      _”and to film inside”_
      As pointed out above, the filming aspect of the interaction is an irrelevancy . . . for example- would you be happy to have your private information on display, on a screen, inside a store, where any passing member of the public was free to view it, with your only caveat being no one was allowed to film it ? The answer is no.
      Even without a camera, if private information is on public display the data hander has breached GDPR.

      @@tonyb1223 Wrong. No such law exists that explicity states, "unless express permission is given, it is not allowed". We live in the UK, where the law is, EVERYTHING is legal or assumed allowed, unless explicity stated.

    • @tonyb1223
      @tonyb1223 Год назад

      @@davelordy I take it you missed the important part?
      If the information is for personal use, there would be no breach of GDPR, but if its published then there would be, and this is the factor you overlooked, because it was published, he breached GDPR, and that is the difference.
      So as much as you were on the right lines for someone who would only see the information and not publish it, thats fine, but the second it's published, it's not (or no longer for household use). Hence why filming can be restricted by the building owner as to stop this happening.

    • @tonyb1223

      @@zigzagtoes Actually there is, it's a part of the human rights act, and as with article 10, you have to protect the rights of others, which basically means that you cannot trump another persons right, ie privacy for example, it means that Reggie failed to meet the criteria as laid down in article 10 when he is expressing his chosen freedom and as such can lead to the likes of the offence of public nuisance.

      Exactly all for the state meaning the crown's servants. Like they don't lie, or rape, or kill. Just yesterday the met put 1000 officers into off duty measures. Blackpool police, council, magistrates are amongst the most corrupt in the nation

    i had a security guard working at morrisons grab me from behind and physically drag me back into the store a couple of weeks ago because the electronic alarm went off as i walked through with a group of other shoppers, i punched him full on in the face then called the police, they came and looked at the CCTV and confirmed to the security guard that i had every right to punch him in the face to stop the assault that he was committing and then informed me that i can make a complaint for assault, security guards really need to start learning the law or they are risking their safety by going hands on with people.

    Reminded me of the Viz comic strip "Robo Store Detective" - with the tagline "Shoplift and die, mother******s"
    Very funny and serious at the same time. Security guy saying you can't take a picture of their apparatus for taking pictures. Says you're breaking GDPR when to him you would have appeared to be acting as a private individual, whilst he was working for an organisation.
    On the more serious side, he blocked your path when you tried to leave and therefore assaulted you - leaving him open to be prosecuted.
    You should expect a public apology from a senior manager of Sainsburys as well as them saying that those 2 guards have been sacked.

      Yes that will save the footage, but won't stop the devices being seized though. Yes it's one way to do it. I think Reggie was more concerned with the devices being seized, which for a RUclipsr it's vitally important.

    • @ReggiePhoto
      @ReggiePhoto  Год назад +2

      @stuartb4525 it's more being able to share the footage and let you the viewers and the public see the evidence before it escalates to a court. A friend got his devices taken of him and he was convicted without him being able to show his evidence and they still haven't given him his devices back. I've got many devices stashed of to get me back on the road filming that's not the issue it's the footage of any false allegations that is more important.
