  • My boat was stopped by law enforcement while fishing with a limit of Summer Flounder (Fluke) in my possession. A Department of Environmental Conservation officer went through my cooler and asked lots of questions about the fishing. These are New York's fisheries police.

      A cooler can’t have anything else other then fish, beer or food. Even if you try to put others things the cooler will not let you..

      Because it typically does in my opinion. Of course I don't have concrete proof but in most cases where things escalate it could have been avoided. Even if you dont agree with whatever the officer says you did you just do as they ask and solve the mater at a later time. If you try to fight the cop or something stupid like that you are going to get pounded by the law. 99.9999% of the time an officer has no reason to be a dick to you unless you proved him or her.

There's just too many cases of powertripping officers who are always inviting confrontation, yelling when they should be speaking, and not following any level of professionalism in their stops - and they are empowered by the wishful thinking of people saying its almost never the cops fault.I know a couple who work in my home town, and everyone including little old ladies, hate them like the devil himself. Noone feels safe knowing that guy might roll up to your back bumper late at night.
      Look - fact of the matter is that 99% of people will get along as well as they possibly can with an officer, because they dont want trouble that has, in many cases, absolutely no oversight. And yet stuff goes down all the time. The officer is the one in control in these situations, yet they get out of hand all too often. Less true after the bodycam regulations, but before - Cops Did What They Want. People are very uncomfortable thinking about that, but at the end of the day, the fact that its unfortunate has no sway on whether or not its the truth.
      Getting better nowadays? Yeah, I think so. Because of the internet seeing things before they get buried by the police department, and bodycams making it more likely footage is out there. NOT because of this wishful thinking that never helped the situation, in fact, it empowered the worst of the bunch to keep abusing their power.

      @@blobcity3591 Agree, its why I said I think one of the things thats making it better is body cam laws, where they have to be rolling all the time. Not all Chiefs are clean, but now the ones that are, have video to prove where their bad apples are, or maybe those bad apples are having to act better now that there is less slack being given to them by brainwashing like '99.9% of the time just do everything they say and you will be fine'. Man, that was NEVER, EVER true, not in any era.

    I used to fish around Chatham Massachusetts with my Grand Dad back in the 1970 s for bluefish,and flounder your Chanel brings back some great memories.👍🐟🦞

      Bluefish and flounder (winter flounder) are two fish that were in very short supply the last couple of years in NY. Winter flounder have been scarce for decades actually.

    You should have acted like a sovereign citizen by not showing him your fish or license and reciting specific law codes because no crime had been committed and then spend a good 45 minutes continuing to refuse while requesting a supervisor, followed by an escort to the ramp where you would then meet other officers who would then arrest you. Why show him your license to make a routine stop quick and painless?

      I had a vgif officer run over the line when my brother in law was reeling in a striped bass on the james river , and the followed us with binoculars i ended up confronting them that evening and they finally left us .

      @ agreed, with so much going on in this world, these buffoon's pick on the little guy. We are no longer living in a free country. Notice all jobs being created are government or state level, they are all after our money I don't care how nice they appear, it will escalate into more than just fish cops, soon enough. They will ramp up their authority and turn them into bounty hunters. Wonder if he checks out the big fishing dragger's along the horizon see if they are netting any under size fish.

      My friends and family certainly have had different experiences. 1 example: When my buddies were 16 a wdfw officer ripped his car apart and threw his fathers fishing poles all Ofer the street, breaking 2 and damaging a reel. He was swearing and aggressive the entire time. He supposedly saw my buddy put king salmon in garbage bag and bring them to the truck. All he found was the wet clothes of my two friends who went swimming after they were done fishing.
      I also have had a wdfw Officer try and trespass us from public land. We argued for over an hour while showing gps coordinates and the regulations and physical maps of the area. Long story short, he walked away with his tail tucked.
      A lot are polite but many are not.

    I'm a police officer and a fisherman. I have some mixed feelings about these checks. We have creel officers in my state. They will pull up and ask what and how many you have caught and the size. They don't look at what you have caught. Other wildlife officers do just like this officer. This was a respectful check but I can't connect it to my duties as a police officer. We have to have a reasonable suspicion that someone has committed a crime to stop them in a vehicle. I understand boating is a little different but I suspect that fisherman's constitutional rights are violated regularly. I chartered a 4 1/2 hour fishing trip in Florida. About 2 hours into the trip, the Coast Guard boarded the boat and were on the boat for 1 hour and 10 minutes. When they were done and found no violations, I asked them if they were going to pay for a quarter of my charter, they thought that was funny. I wasn't trying to be funny. I asked them why they didn't do boat checks when the charters were returning and docking. They didn't really want to talk about it.

      A1scooter1, I agree with your assessment, reasonable suspicion in this situation is "justified" because a line is in the water. That's all they need. As an officer, what happens when you don't get compliance? ticket? a ride to jail ? court dates and a whole lot of trouble. The system sucks for sure. I have a lot of respect for your chosen profession. Personally, I want nothing to do with law enforcement (until I need you) Lol. Be safe and keep up the good work.

      I would have been livid. And likely hostile after 20 mins. It was what amounts to theft, you were stolen from.
      But was there some karma involved? Have you ever been professionally involved in a lengthy search, where nothing of interest was found, and maybe not returned the personal property back to order before you disengaged? Perhaps said something like, "That's your problem, bud." ?
      It is no fun to be on the receiving end of that. Please consider that while you are working.

      If someone is driving a car, I can't pull them over to check for a driver's license. I have to have reasonable suspicion they have committed a traffic violation, or another crime. In my state it's legal to carry a weapon with a permit. If someone is carrying weapon, I can't walk up and demand to see their permit for no reason. I have to have reasonable suspicion they don't have a permit or have committed another crime. I've been a police officer for 30 years and when it comes to outdoor sports and armed carry, I think citizens's rights get violated regularly. I have been careful for my whole police career not to. Just because someone is seen fishing, it is no reason to think they don't have a license.

      Turb0 Draw - Engaging in a legal activity like fishing doesn't qualify as reasonable suspicion or probable cause. Otherwise you could say driving could be probable cause for any activity that could be related to driving or be done while driving, same thing for pedestrians. Essentially there would be no 4th amendment protections for anyone. Even sitting in your house could be used as a reason to search your house because you could be doing something illegal in your house. A law enforcement officer needs to observe some sort of illegal behavior in order to be justified in a stop or search.

      I've never even felt the need to lie on a report. Never had any direct knowledge of another officer lying on a report. I've been involved in the arrest of other officers. Police are no different than non police, they occasionally commit crimes. It is much rarer than you might think though. I have had lengthy discussions with new officers concerning constitutional rights. Especially when it comes to gun rights. There is nothing special about me though. Most officers are just like me. The last 20 years of my police career I haven't worked in the capacity of traffic control. I think out of every 50 stops I had when I did, I probably wrote about 3-4 tickets. The rest got a warning. So yes, I have stopped officers speeding but never wrote them tickets. They got a warning like almost everyone else did. Most of the few tickets I wrote were to people that I stopped for violating a traffic law and then found out they had no license or registration or insurance. Again, I'm no different than most officers.

    This post is generating a lot of interesting comments from many viewpoints. I'm curious if commenters' feelings toward law enforcement stops on the water generally differ depending on where they live. If people could add the state they're posting from to their comments, that might explain differences in opinions. Thanks everyone for their comments. OK, I see I need to mention something else because a bunch of people asked why I put a live fish in my cooler. The fish was cut across the gills and bleeding out in a water bucket when the cop interrupted me. It was hot out, and I wasn't sure how long the cop would stay, so I put the fish on ice rather than risk the meat spoiling.

      I am out of WV.
      I don't mind these kind of stops. While the license and catch checks are intrusive and Constitutionally questionable, how else could compliance be monitored?
      And it does need to be monitored as there are people who will rape our resources if given the chance. So, I don't mind bending my rights a bit for that.
      -------
      That said, where I do strongly object is when wildlife officers stray into other forms of law enforcement and use their extra legal leeway in ways that would be blatantly illegal in other settings.
      If wildlife officers want to be police, then their activities should be rolled into, and paid for by, the State Police or the equivalent of, and regular legal requirements such as "probable cause" should apply.
      And Legal considerations aside, within a 40 radius of my home there are 11 separate law enforcement agencies and that is not counting the Federal agencies. --add at least 4 more. That horribly inefficient, and incredibly wasteful of tax dollars.
      Our wildlife fees and taxes do not need to be funding (at the expense of legit wildlife projects) yet another general law enforcement agency.
      -------
      To be clear, I am NOT calling for doing away with the DNR or equivalents. I am calling for their general law enforcement arms to be rolled into an existing law enforcement agency, back into compliance with the Constitution, and out of wildlife funding sources.

    Sadly many don't think of the future and will gladly fish out an area. These guys help to prevent that so we can keep fishing for centuries into the future.

      It all odds up but yeah, big trawlers are the main guilty party for sure. More so those that use illegal nets that catch young flounder for example. Which seemed the officers main concern. the size of his fish.

      It isn't just about nets, in this case it is about not releasing underage fish. If you don't allow fish to grow large enough to breed and continue the species then the species will be GONE!. Every breeding fish matters, not only those caught in nets by the trawlers. Personal rights is not justification for what many think it justifies. We are part of society and have responsibilities. We are part of this earth and have responsibilities. Don't get to wrapped up on your "rights". You maybe a responsible person, others may not be and these fishery officers have to limit the damage the irresponsible do and if it means the responsible have to take being stopped for 5 minutes and answer a few questions...it is worth it, more so if you want your kids or grand kids to have fish to fish. The world oceans are being fished out and many will start dying soon if this keeps up. Enjoy your tuna sushi, in a decade or two, you may not have any to eat or it will be so expensive you can't afford it.

    You payed taxes on the boat, , payed to register the trailer, bought a permit to put the boat on the water, taxes on the fuel for the boat, had to buy a license to fish. Then, your taxes pay for the salary and all the equipment the fisheries guy has to have to come and check your compliance. Sheesh! Government has their fingers into every square inch of our daily lives.

      Very true.
      I once heard a comedian talking about how government has their fingers in everything. He challenged the audience to find something they're not involved in. Somebody yelled "SLEEPING!" and that was debunked because the mattress you sleep on has a tag that says "do not remove under penalty of law"!!

      They are just checking. US government is the best government ever in the history of the civilized world. You have to compare it to other governments and see the difference. Try fishing in Europe. You need 10 different licenses for every arm of the river and the lake.

    Hello John great fishing video I fish alot off shore off of Tybee island ga. And I really want to try to do more flounder fishing. The question I have is what's the best tide and bottom to fish for them.
    We have alot of inshore creeks and oyster beds. And again thank you for all your hard fishing videos I really enjoy watching them

    Everyone complaining about unlawful stops. Who cares? If they didn't do these random checks, people would be poaching/exceeding the limit until there were no fish/game left. Yeah it's your natural right to hunt and provide for your family, but you have to be responsible about it or there will be nothing left for your grandkids.
    As long as the cop is fair and respectful, who cares if he stops to check in on you? Just be polite and get on with your day. He's helping you in the long run

      This sort of thing isn't as effective as the peer pressure we put on one another. Most of the time they don't catch the offenders because they're too busy checking people who follow the rules. You should care that the government is wasting your time, money and freedom to put on a show instead of working harder at actually finding violators in the act.

      the supreme court said police need a thick skin otherwise they're not right for the job. expect to be insulted and disrespected in any law enforcement capacity. it's just part of the job.

      I have different laws on the great lakes, no seasons, no size limit and a bag limit of 100# a day. Pretty simple tbh. I never even come close to that, I don't wanna clean that much fish honestly. Also I don't net and I don't spear, only rod and reel and I'm even getting away from bait for more of a challenge.

      Report them if you witness it in action. It's our responsibility too to help reduce poaching. Plus there is no way they can check every spot every day especially at night, but they respond pretty quick once they receive a report.

      NO, he's exactly right and that's NO LAW enforcement officer. That is a regulation enforcement officer and regulations are ILLEGAL under our constitution, ONLY law created by the legislature are legal and enforceable. I have a great deal of respect for law enforcement, even this guy who is enforcing illegal statues and regulations, he probably doesn't know any better but they all should but then they'd have to start arresting their own bosses who send them out to enforce this shittery.

    Been operating and fishing the coast of New England for 30-plus years. I've been stopped and boarded a handful of times by Federal and State Fisheries, State Police, DCR, USCG and Harbor Masters.
    Every contact went well... they were polite, stated their business and after exchanging papers and pleasantries they were on their way. A few times I was in the wrong and after a couple of words of caution I received a warning citation. The water cops have a job to do and many lives they have saved off the coast of New England far outweighs the occasional bad encounter. Fish lawfully, have the boat squared away, have your paperwork in order and be courteous. Your encounter will go well and be over in minutes.

    I was on my uncle's rebuilt 42 foot torpedo chaser when it was boarded by coast guard in Puget sound in 1962. The boarding was like a trapeze trick. They were checking boat licence and that there was a horn and fire extinguisher.

      I know in Florida you need a license for saltwater and freshwater, and purchasing the license gives consent for FWC officers to boat your vessel and open your coolers.

      @@stevewilliams4777 If you are fishing and FWC comes up to check if you have a license, if you do they have the right to search you because having that license gives them the right to search. If you do not have a license, you are breaking the law, and that gives them probable cause to search you. You get a fine and could lose your gear, and definitely lose your catch. If you don't pay the fine, you go to court. If you don't go to court, you get a bench warrant and could do jail time.
      Freshwater and saltwater is $17 a piece, combo is $32.

    I don't fish (yet). But I recreational boat near Clearwater FL. Each season I check and double check my safety gear. I also get a courtesy safety inspection by the USCG auxiliary. I have been stopped twice by Marine patrol. Both times they were courteous and polite.
    Now they recognize my boat. Just give me a friendly wave. No more stops

      Agreed. Some people just don't respect wildlife. If you're going to eat it and it provide sustenance for you, the least you could do is kill it or at least leave them on a stringer in the water. Some fisherman annoy the shit out of me the way they treat fish, you wouldn't take a wounded deer home without finishing it. This land and its oceans are to be respected. Without it we would not live.

      Before placing the fish on ice, we cut the gills to bleed it out. This preserves the quality of the meat better, and the fish die quickly. The one you saw in the video had just been cut across the gills to bleed out. When the cop interrupted me I wanted to get it iced because I wasn't sure how long he would stick around and it was hot out and I didn't want the meat to spoil. We do not bash fish over the head here.

    I had just refurbished an old Lund boat, everything. Added lights, fixed trailer - new bearings, new safety equipment, license plate and fishing licenses. Had my son and father-in-law from out of state (we were in FL) and we had been fishing for several hours on Lake Manatee. We were all loaded back on the trailer, tied down and hopping in my truck, when a FLDNR pulled up. He began with the pleasantries; "any luck today?" etc. Then his partner stepped out and by golly, they did a 100% full inspection. Coolers, ("been drinking?" - yeah...water!) life jackets, throwable device. Even asked if I had a fire extinguisher and I told him that the law does not require for under 15hp - mine was 7.5 - BUT! Yes. I did have one. Asked if I had any signalling devices. I showed him my working running lights, a flare kit and he said, "do you have a whistle?" So I put my two fingers in my mouth and let out a warbeling 'coach-whistle' shrill that made him laugh - but said that really wasn't counting - and I told him, 'but I had the flares and I only need one of the two and what the heck - I can 'create' the 2nd if needed. Long story long, after finally checking our licenses - even though we weren't fishing and didn't have any fish on board - he gives me a 3" round FLDNR Safety Inspection sticker - told me it was a collector's item because he doesn't give many out - he mostly gives out tickets (laughing...I wasn't). All this took over 45 minutes and we were hot and just wanted to get going and get the AC turned on!
