Very true... I've met some nice ones, but they can be super harsh and generally have zero sympathy. If you are caught over the limit or without a license for example they can confiscate EVERYTHING (equipment, boat, cars, guns/poles, etc.). Once saw a video where guys were magnet fishing. They had received confirmation that was okay from a nearby military base. They started fishing up ammo and weapons so they called the military to just be extra safe. The military showed up and was like, "Yah we can't let you keep that but no biggie. No harm." Then the fish and wildlife guy showed up. EXTREMELY aggressive right out of the gates, and even though they had military permission and signed documents they were SLIGHTLY off in the area and were given citations lol. The fish and wildlife guy was not polite and couldn't just let them go with an honest mistake warning. Even the military guys said, "Sorry - we feel bad for you guys. We have no issue with this."
They are NOT adults. They’re grown but they’re not adults. The problem with our society and societies around the world is that they give adult status to a human based on their physical age/maturity. The implications are vast and I won’t go through it here but suffice it to say, being grown doesn’t make you an adult. I’ll leave you with this. Some people will live an entire life having never reached adulthood (emotional maturity).
Never do field sobriety tests. He’s arresting you regardless of whether you do them or not. Regardless of how you perform on the tests he’s going to say you show signs of impairment. He was getting arrested from the second he was pulled over, that’s the point where the officer made the decision.
Don't participate in the sobriety test. The state will take your license , they will have to get blood drawn. The sobriety test is just to let them fish out more evidence. Don't say anything and delay the blood alcohol test especially if you know you have only drank Soo much . A half hour could put you at or under the legal limit of operation. Even if he sounds like a punk , this guy is technically cooperating within the extent of the law . He's also doing a great job of stalling and so are the friends 😂. Also where the video cuts in , there was no positive identification on either end . Anybody can dress as a cop or a game warden . In the end of the day the police are not judge jury or prosecution and now isn't the time for this guy to fight them , just stall them as long as possible. The flight will be left in the court room and this guy should say no more. Failure to take a breathalyzer is one thing and easier to fight . Failing the breathalyzer test and sobriety test as a result of the police asking and not a lawful order ... This is why they ask if you " would like to take it ?" This could make you guilty from your own admittance if you take them . If the courts order you to lose your license, you can fight in court and in a lot of cases get it back. Good luck trying to get that DUI that's gonna destroy your life and driving record off . THE SMARTEST THING YOU CAN DO IS ... JUST DONT BREAK THE LAW !

I would not say smart because he let his friend drink and get behind the helm, but he definitely learned several lessons really quick and kept himself out of the situation as much as he could.

Not really. 1. He told the cop that the girl was really drunk (gives cop Probable Cause to believe the captain was drunk); 2. He helped the captain find the shit on the captain's boat (gives the cop more Probable Cause to believe the captain was drunk); 3. He continued talking to the cop (he was likely drunk too, which gave the cop more Probable Cause to believe the captain was drunk); and 4. He told the captain to do a field sobriety test (there is no reason you should ever do a field sobriety test-the cop made his mind up with or without the test--failing it just gives the cop more Probable Cause).

For those that don't know. Follow the directions of the officer, don't resist, invoke your right to remain silent, and don't consent to any testing. If he was from a family of lawyers, he would know that.
I am from the UK. ONLY from videos I have watched I thought to refuse a field sobriety test means you get arrested. So.. if you have nothing to hide SURELY its best to consent to it and pass it. Its not manatory to do it.. but you will be arrested. We do not hae field sobriety tests here in the uK. i am retired police here. We ask them to blow in a device.failure to give a full breath test. ie.. not breathing into it in a continuous breath for was long as the device needs is an instant arrest. Offence is failing to provide a specimen of breath. if they refuse to blow into a machine int he station.. or give blood or urine for analysis.. will be charged with failing to provide. that is an instant disqualifation from driving. So. nothing to hide.. nothing to lose.. do it . here in the uk.
The issue is that the field test is highly subjective and prone to false positives. Once you are suspected you are as good as charged. If you truly have not been drinking its better to just be taken to the station where you can blow zeros and give a blood sample so charges can be dropped. If the officer claims you failed the field test AND you tell them you had a drink two hours ago they will still have evidence to charge you if you blow zero.

I can’t believe no one knew where the fire extinguisher was! If you are the driver (captain) you have got to point out to your friends where everything is at before taking off for the day! Accidents usually happen in a split second, though some are from smoke and fire. I carry two extinguishers just in case.

In spite of popular opinion, game wardens have no more authority to violate the Constitution than anyone else. I think the confusion comes from an agreement to waive specific rights (exactly the same as probationers and parolees) to allow for warrantless searches. I had the same argument with one that wanted to search my personal cooler while I was with people fishing. I didn't feel like buying an out of state license for 6 hours of fishing. He tried to say that because I was with people fishing he wanted my ID and to look inside the cooler. He was mad as hell but he did neither.

The officer said he was placing him under arrest at 11:18. After that, taking the field sobriety tests would just add to the evidence against him. The odds that the officer would change his mind based on the tests are pretty much zero. I guess there are rare instances where the police actually have you do the tests prior to deciding if you're drunk, but this wasn't one of them.
There are *NO* instances where they ask you to do the tests before deciding if you're drunk. The moment he said they were coming from BeerCan Island, he was gonna be tested & arrested under suspicion of BUI. The FSTs and PBT are _solely_ performed for BWC video capture and/or officer testimony (which is routinely falsified).

You can decline the field sobriety test but refusing the State’s test of blood, breath, or urine will get your licensed suspended. Potentially a warrant for a blood draw.

The problem with the FST test is everything is on video and any missteps, stumbles will help their case, not yours.

I used to be a Freedom Boat Club member which is an excellent organization. You had to do a separate boater education safety course on your own. I did mine through the VADGIF. Then they take you through additional training with a Coast Guard certified captain for just basic boat training and there are additional levels of education if you want to use boats with equipment like bow thrusters or go offshore in the ocean. One thing they do do before you take a boat out is inventory all of the safety equipment on board of the boat.

A lawyer only comes into play after you have been arrested, officially charged,and they want to ask you further questions. Then that's when you get your rights read to you, and you can have a lawyer present during questioning.

Don't participate in the sobriety test. The state will take your license , they will have to get blood drawn. The sobriety test is just to let them fish out more evidence. Don't say anything and delay the blood alcohol test especially if you know you have only drank Soo much . A half hour could put you at or under the legal limit of operation. Even if he sounds like a punk , this guy is technically cooperating within the extent of the law . He's also doing a great job of stalling and so are the friends 😂. Also where the video cuts in , there was no positive identification on either end . Anybody can dress as a cop or a game warden . In the end of the day the police are not judge jury or prosecution and now isn't the time for this guy to fight them , just stall them as long as possible. The flight will be left in the court room and this guy should say no more. Failure to take a breathalyzer is one thing and easier to fight . Failing the breathalyzer test and sobriety test as a result of the police asking and not a lawful order ... This is why they ask if you " would like to take it ?" This could make you guilty from your own admittance if you take them . If the courts order you to lose your license, you can fight in court and in a lot of cases get it back. I've seen, more than once, the person initially questioned by the police be let off with a warning, or a minor ticket, while another party that interferred being taken away, cuffed, in the back of a patrol car.

He helped the captain find the shit on the captain's boat (gives the cop more Probable Cause to believe the captain was drunk); 3. He continued talking to the cop (he was likely drunk too, which gave the cop more Probable Cause to believe the captain was drunk); and 4. He told the captain to do a field sobriety test (there is no reason you should ever do a field sobriety test-the cop made his mind up with or without the test--failing it just gives the cop more Probable Cause).
The longer the kid went arguing with the cop it was more apparent he was drunk.

I am from the UK. ONLY from videos I have watched I thought to refuse a field sobriety test means you get arrested. So.. if you have nothing to hide SURELY its best to consent to it and pass it. Its not manatory to do it.. but you will be arrested. We do not hae field sobriety tests here in the uK. i am retired police here. We ask them to blow in a device.failure to give a full breath test. ie.. not breathing into it in a continuous breath for was long as the device needs is an instant arrest. Offence is failing to provide a specimen of breath. if they refuse to blow into a machine int he station.. or give blood or urine for analysis.. will be charged with failing to provide. that is an instant disqualifation from driving. So. nothing to hide.. nothing to lose.. do it . here in the uk.

The issue is that the field test is highly subjective and prone to false positives. Once you are suspected you are as good as charged. If you truly have not been drinking its better to just be taken to the station where you can blow zeros and give a blood sample so charges can be dropped. If the officer claims you failed the field test AND you tell them you had a drink two hours ago they will still have evidence to charge you if you blow zero.

If you are suspected of being intoxicated you are afforded the right to show a LEO you aren't by taking a sobriety test and/or breathalyzer. By LAW a LEO can not legally allow you to continue operation of a vehicle, vessel, airplane, unless he can stand in court under oath and state he believed you weren't intoxicated, or it was proved you weren't by scientific testing. That's the law in all 50 states, doesn't matter how lefty stupid the state is. You can thank a lefty majority SCOTUS for that precedent.

I can’t believe no one knew where the fire extinguisher was! If you are the driver (captain) you have got to point out to your friends where everything is at before taking off for the day! Accidents usually happen in a split second, though some are from smoke and fire. I carry two extinguishers just in case.

You really don’t have to be doing anything, as they have the right to inspect any boat, at least in Texas and Oklahoma, just to make sure everything he’s asking for is on board and operational, we call it a checklist! I’m 68 and have been stopped 3-4 times for a safety check.
The cop could have said he didn't pass when he really did. It's up to his discretion. I wouldn't put myself in that situation either.

Drunk or not drunk, it's so hard to keep your passengers quiet and not "helping" when you get stopped or boarded by the USCG or police agencies. They never seem to understand that the "captain" is the only person they want to deal with, nor they understand how responsible said captain is for everything and everybody on the boat. Obviously, this douche failed his responsibilities in every way possible.
I agree this man probably does not know his duties and responsibilities as a Captain should. But I can not agree that he failed everyway possible. In fact he made some wise choices that will work in his favor if this ever lands in front of a jury.

I think the confusion comes from an agreement to waive specific rights (exactly the same as probationers and parolees) to allow for warrantless searches.
I had the same argument with one that wanted to search my personal cooler while I was with people fishing. I didn't feel like buying an out of state license for 6 hours of fishing. He tried to say that because I was with people fishing he wanted my ID and to look inside the cooler. He was mad as hell but he did neither.

The reason for this is that in the state of Texas game is considered property of the state. Therefore they have the right to come in if they feel you are breaking game laws.

The officer said he was placing him under arrest at 11:18. After that, taking the field sobriety tests would just add to the evidence against him. The odds that the officer would change his mind based on the tests are pretty much zero.
I guess there are rare instances where the police actually have you do the tests prior to deciding if you're drunk, but this wasn't one of them.

@@setin1956 a safety equipment check is 100% different than cops searching an entire boat or boarding it.. equipment check, all you have to do is prove you have the required gear/equipment. Which you can do without them searching things or getting on your boat.

Agreed. The cop has already made up his mind that he is impaired and he wants to go to step 2….breath test or blood draw. If the boater was HONEST and is alcohol free, his test will come back 0.0. The problem with the FST test is everything is on video and any missteps, stumbles will help their case, not yours.

I used to be a Freedom Boat Club member which is an excellent organization. You had to do a separate boater education safety course on your own. I did mine through the VADGIF. Then they take you through additional training with a Coast Guard certified captain for just basic boat training and there are additional levels of education if you want to use boats with equipment like bow thrusters or go offshore in the ocean.
One thing they do do before you take a boat out is inventory all of the safety equipment on board of the boat.
Fun fact: you can't request a lawyer for a dui investigation. It's a yes or no situation.

You can request a lawyer all you want if there's enough evidence that you committed a crime ,which there usually is. Otherwise, you wouldn't be stopped, then you're getting arrested. A lawyer only comes into play after you have been arrested, officially charged,and they want to ask you further questions. Then that's when you get your rights read to you, and you can have a lawyer present during questioning.

And *it's never a good idea to take those field sobriety tests* which are nearly impossible even 100% sober. I don't think anyone EVER gets let go when they perform one.
