I'd phrase it like: You will get convicted because bank robbery is often done with applied force. But, in Vivek's logic, if you would do the exact opposite of using force, for example using blackmail to force the bank into give you money, they would even have a bigger case against you, because there would be so much more evidence left behind in writing, so... that proves, that they are not convicting you for taking the bank's money, they are simply convicting you because they don't like you. No matter how you get to the bank's money, you will get convicted anyways.

Why didn’t they just read the indictments? Cheating on your spouse is not a crime. Paying that person hush money from your own pocket is not a crime. Having your business do so and using it as a business expense and calling the hush money, which is not a legal business expense, but legal fees, is called fraud.

I like how he seems to imply that passing the statute of limitations for a crime kind of equates to not having commited a crime. When it just means you can't be prosecuted for the crime, but you are still, at least morally, guilty for that crime
I would apply the Seinfeld opposite test: Egg salad on toast isn't the opposite of tuna on rye...you'd have to order salmon because they swim against the current and the tuna swim with the current. Actually there's no reason for ANY thought experiment. Is paying a hush money payment to disappear a story that might affect the outcome of an election and recording that as legal expenses against the law? That's the only thought experiment that needs to be applied. I believe that violates campaign finance law and tax law, which is exactly why Cohen who was doing it within the Trump umbrella was sent to prison.

Vivek made a cogent argument on the merit of the case. The indictment did not argue the morality of paying the hush money to the porn star but the mere fact that it was included in the campaign accounting despite being paid from private money. Therefore, Vivek's logic still stands.
