Sorry but I get tired of people suing over one incident. The world should change for their daughter. I am 71, people were responsible for their own actions. I remember when they insisted that child proof caps be placed on everything since parents were apparently too busy to put things out of the reach of children. They forgot about the old people with arthritis who now can not open their medications. Soon we will have to get a doctor's note to buy any edibles. Sorry, see all the old people. We lived through metal slides which were as hot as the sun and took off a layer or two of skin on the way down, We "walked" the backseat now kids are locked in as if they were going to the moon. Result? Kids are in the back facing back and parents forget they are there, the point on the swing sets was to get the legs behind you to lift out of the ground. bicycle helmets? Are you kidding. I remember my friend who was ahead of me hitting a light post, the bike road right over and landed behind her, A guy witnessed it, came over, we dusted her off and away we went. No ambulance, no ER (she is now a great grandmother). Kids on skate boards look like the michalene man. I think you get the point.

It’s unfortunate but it was her responsibility. I’m a survivor of childhood heart disease and have ongoing complications including arrhythmia. I do drink caffeine moderately. And I avoid energy drinks. Still, I happen to love coffee. Even so, there is NO WAY I would order anything, not even lemonade, labeled CHARGED at a coffee shop. A person must be aware of any ingredients if dinning out or if can't have certain things to eat or drink... Too sad this happened. Death is our worst enemy.
College student that didn't know or ask??? I call BS Sorry for your loss but sometimes you can't focus grief into lawsuits and blame Parents don't know everything their children do .

I'm imagining a future where all restaurants will need to ask you to fill out a complete medical history before serving you, than getting sued for denying someone service 😁
I would never think that lemonade had caffeine in it . I would have thought charged meant extra lemons . Who puts caffeine in lemonade? I agree with this lawsuit and I’m not a sue happy person. Panera should have not put this with all the other drinks it should have had a separate listing with big words Caffeine !
One of my grandsons, who is 9 years old, is allergic to oatmeal, cashews, and almonds. He reads the list of ingredients before he eats anything or drinks anything if he’s not already familiar with it. I feel for these parents losing their daughter, but their daughter knew of her condition and should have asked what was in the “charged” lemonade that made it charged lemonade. I would have asked since it’s something I’m not familiar with and I don’t have allergies.
Huge tragedy. HUGE! However, she could/should have asked what was in it. prior to drinking it. Panera should have also reported that it contained caffeine for sure.
My condolences for your loss. That being said, your daughter knew better than to drink caffeine and should have asked. The onus is on her. You won't win. People with peanut allergies will always say they have a peanut allergy and ask if there is any possibility of cross contamination. She should have asked and should have been drinking caffeine AT ALL.
Some of you are commenting that the girls should have known better than to have the drink. And because of that the family shouldn’t be awarded anything in a lawsuit. But after learning about how much caffeine is in the drink, I question whether anyone should be having it for health reasons. There are a number of medical conditions that could be exacerbated by this amount of caffeine. A friend could purchase this and bring it to you and say “hey I got you a lemonade.” And then you drink it and you get sick or die because your friend didn’t read the label. For the sake of other people who might get sick or die from this drink, I hope they remove it from the selection.
For some reason she must not have made the connection to the part of the name - "Charged" - to mean that it was caffeinated. Death by misadventure can happen to anyone at any age.
I drank the mango yuzu charged lemonade all the time, until they stopped having it. One day when I drank one, I was having really bad chest pains. My family and I thought I was having a heart attack. I was scared so badly.
I'm caffeine sensitive and the word 'charged' on the name of the drink alone should be a warning for me to check out what it meant before I drink it. Sorry for your loss though.
What did she think the “Charge” in Charge Lemonade? College students aren’t always smart when it comes to taking risks and I would bet that she knew exactly what was in it and might have even had it before, thinking “…it could never happen to me.” Her roommate knew what was in it, how did Sarah not.
I always ask before I drink anything these days and tell them upfront I am caffeine intolerant multiple times until they get upset at me to make for sure for sure because fast food workers just don’t have the capacity to care about details. I am so sorry to this family. I also think that the energy drink craze in this nation needs to STOP! Energy drinks should be all natural and should come with a warning label if they don’t.
Having charged in the name of the drink is a big clue!! She should know better, used her college brain. It's always the fault of others, people should take personal responsibility for their actions. Restaurants, fast food companies don't know your medical conditions!! No case here!
I love Panera bread but I stand by these parents. I don’t think kids or adults know the amount of caffeine that they are getting, especially like the parents have stated there’s nothing saying how much caffeine are in these drinks. I am a 61 year-old woman and I have heart issues. I have a heart murmur and a mitral valve prolapse and I never purchase anything unless I know how much caffeine would be in a drink. I can honestly say if I were younger and wanted that caffeine I wouldn’t think twice and I would purchase it And I was diagnosed with these two problems when I was 14.

She made an educated choice to gamble on a charged beverage killing her.
That is not a very compassionate comment.
@@i.m.watching5536it's the truth though. It's sad, but true.
@@MathieuLLF I don't think it was all her fault.
@@i.m.watching5536 she's the one with the issue, she's the one who needs to be careful. Something called charged lemonade should be hint enough that it had caffeine.
@@MathieuLLF What if this were your family member?
That girl was already weak unfortunately. It’s not Panera fault! Tired of these BS lawsuits.
So incredibly sad. 🙏🏻🙏🏻🙏🏻
"Charged" is marketing term that is popular within the Electric motorized vehicle circles. Get a full charge .
Caffeine amount should simply be listed on container for the users to judge what they can consume
As much as it may be “her fault” for not reading the labels the ultimate thing is that this Panera lemonade has caused many people different pain including a girl going into cardiac arrest and another college athlete having heart palpitations. As much as people try to blame this girl it’s happened to others and there’s no reason for the Panera Lemonade to have the amount of caffeine it does and not be behind a counter, having free refills on the lemonade is also very tempting especially as a college student.
I don't even understand why this drink exists. It's shameful. We as consumers need more protection from such things. I hope this family gets justice. @4:21 FDA needs to step up its game. There's no room for a lack of transparency by these food compannies. We should know exactly how much caffinne is in a product. Why withhold the info?
What is the same reason people drink a lot of coffee?
There are plenty of harmful products out there and it's up to each person to decide and research the ingredients on things and if they don't want to drink this charge drink then they should be aware of what it is restaurants and retailers can offer whatever they want to sell marijuana drugs alcohol all kinds of over-the-counter drugs and if you take it the wrong way it can be harmful this girl had a heart condition for years since childhood and her roommate said she's been drinking more of these caffeinated drinks lately and the girl knows she had a heart condition she should have read the ingredients on everything she eats or drinks and if she would have asked the Panera person what charged means they could have told her and I'm sure it's listed somewhere on their menu
@@marysaade4343 not all at once
The people who should be sued are the ones that held a gun to her head and forced her to buy and consume that drink. That's who should be sued.
Why does any kid need an energy drink! Give me a break.
It's embarrassing to listen to these parents. They don't even sound like they believe their own story.
Absolutely 100% hope they don’t win a penny. People need to start reading and investigating what they’re putting in their mouth! So this young lady didn’t know what the word charged meant? For God sake, give it a rest. This girl was guzzling them just like people, guzzle, red Bull, and all that other crap she knew.
I think these parents need to go grieve and stop it! Sometimes we have to own our own stupid choices
Bless her heart but she should have known better.
That sucks their kid is gone. I'm sorry for that. Panera has no responsibility. Stop ridiculous lawsuits. She was an adult and should've been more responsible with what she ingested. Sad story.
The word “ charged” wasn’t a clue that it was some type of energy drink?
Sorry to hear of your loss...
have a friend that has to know what everything has before she orders out of any food or drinks which she rarely eats out-cooks home most of the time. A person must be aware of any ingredients if dinning out or if can't have certain things to eat or drink...
Too sad this happened. Death is our worst enemy.
I can sympathize with the parents I know what it's like to lose an adult child. 🥺🙂↕️
You can’t sue bc your daughter is too lazy to read. And does it comprehend what “charged” means.
It said “Charged” lemonade.
💔💔💔🙏🙏
College student that didn't know or ask???
I call BS
Sorry for your loss but sometimes you can't focus grief into lawsuits and blame
Parents don't know everything their children do .
I’ve seen these before and it literally says it’s highly caffeinated on the spigot. The roommate said she had been drinking them lately? So it’s not like it was her first one? Is that correct?
I'm imagining a future where all restaurants will need to ask you to fill out a complete medical history before serving you, than getting sued for denying someone service 😁
It's listed at the fountain drink station as how much is in it. Caffeine
I’m old and didn’t know what charged meant until this happened. Now I’m careful what I drink when I’m out.
Sad 😢
I would never think that lemonade had caffeine in it . I would have thought charged meant extra lemons . Who puts caffeine in lemonade? I agree with this lawsuit and I’m not a sue happy person. Panera should have not put this with all the other drinks it should have had a separate listing with big words Caffeine !
So many people have died from that lemonade! Take it off the menu already.
I didnt know there was large charged lemonades
What else would "Charged" mean?? 🤔
Did she not understand the definition of charged.
Well why does it be called "charged"......
It says charged tho
Ah yes, it never fails with the lawsuit.
It’s sad their daughter died, but this lawsuit is nonsense. So much nonsense.
Umm...CHARGED! Yeah it's literally in the name. But, It's tragic all the same
Katz. These people never take responsibility for their own actions. I'm surprised the parents didn't blame Hamas.
What did she think it was “charged” with, and why was she drinking a large size?
Half a cup of coffee and I vibrate for 2 days. I avoid energy drinks completely.
They don't put any warnings cause I could drink those charged drinks all day and then take a nap...
It was irresponsible for Panera to offer this product especially without any warning. I hope they sue the pants off of them.
