One of many ways people avoid paying taxes on their properties and keeping a low profile on SARS radar is to come to an understanding with the developer. Essentially, the developer will keep the house under their name because they get a lot of lee way from Government regarding their developments. A developers can rent out a newly build house for the first 12 months, without losing their tax breaks. After the 12 months has lapsed, the developer must put the house up for sale, and it's tenant must vacate the house otherwise the developer will be taxed as per normal company. When an individual comes to an understanding with the developer, the individual shall purchase the property and reside in it, but the ownership of the property will still be listed as the developer. This means that, when the owner sells the property, it will still carry the same tax breaks as it had from development because it is registered as the developers property. At times these house may be listed for sale but no individual shall ever be able to purchase the house unless they make an above and beyond offer. So to cut the guy some slack, that could be the case with the house.

Eish you are wrong about the house my brother. In waterfall no one pays transfer duties because the land In Waterfall is on a lease from the owner of the land so the incentive for buyers is that we don’t pay transfer duties. So it does not necessarily mean that John does not own the house or that it was still in the developers hands. However, if you go to property 24 and pay for the property report for this exact house you can get a better understanding about who the owner of the house actually is.
Some people forget to advertise it brother... And yes you do pay fees but it's just transfer costs which include bond reg fees and transfer fees which are for the attorneys.. Look up on Google about waterfall land lease agreement. You will see what I'm saying, I stay in waterfall so I'm just speaking from my experience as a property investor
What you are saying isn't rooted in reality, you still pay transfer duty because although the land is leased, the house which it is built on belongs to the owner. Transfer duty isn't a tax that's primarily on land, it's a tax that's paid on transfer of ownership of property, ie the house.

In waterfall no one pays transfer duties because the land In Waterfall is on a lease from the owner of the land so the incentive for buyers is that we don’t pay transfer duties. So it does not necessarily mean that John does not own the house or that it was still in the developers hands. However, if you go to property 24 and pay for the property report for this exact house you can get a better understanding about who the owner of the house actually is.
