    Great Video Sidney. I noticed at 4:42 & 5:17 in the video, you charged your EV in my home town of Tracy, CA. I also saw you at CES back in Jan 2023. So Cool! Keep up the good work!

    I just happened to go there at the time of the firefall last year (my typical unplanned trip) and found myself in traffic and road/parking closures, mostly around the south side of the river. I go there in winter to avoid crowds! It’s one of the few times during the year you can get a room in the valley. So I asked about what was going on (people were walking over a mile from the lodge to this place) and learned about the firefall for the first time. I decided to avoid the crowd and do a Timelapse of El Capitan on the other side of the river. It was beautiful! But not the same. I also appreciate sharing your experience with permitting, up front. Great you were able to get there, weather has been pretty rough and unpredictable this year. I enjoy your videos Sidney, keep it up!

    So every video I see on RUclips from creators at Yosemite, Grand Canyon, Zion, Glacier National Park etc those people had to get permits? It's literally thousands on RUclips. I knew about drone restrictions and that makes sense, but to restrict people putting their video on RUclips is a little much. I can't imagine they told Ansel Adams "no you can't take photos of our National Park."

    • @SidneyDiongzon
      @SidneyDiongzon  Год назад

      It's a new rule enforced back in October 2022. A RUclips channel got fined $10K for filming without a permit. I know it sucks.

      @@SidneyDiongzon so is there a permit you can get that applies to all the parks? Or is it different for each?

    • @SidneyDiongzon
      @SidneyDiongzon  Год назад +1

      Each park is different I believe. I really hope they reverse this rule one day

      John, Its very much gray... as a small youtuber and semi-professional landscape photographer (this is my genre, I spend at least one weekend a month in the national forests) (with a large backlog of national forests videos to still publish and many more trips to come on landscape photography), it is a big concern for me. I have looked at the data from various avenues. I appreciate Sidneys input, it seems to mainly come from Dovey and his lawyer friend but like anything else with the government, things are not clear, there is a mixture of competing info out there.. It is very questionable whether or not a non monetized channel would really need a permit or not, Dovey's lawyer and some people connected to the forestry departments say yes but other lawyers argue it is all about the person's filming intent. If their intent is to not make money and they post as non monetized, they say they are ok, good to go. There is mixed opinions and many youtubers are just posting what they are hearing the most but it is really questionable what the truth is. My hunch is, it is really about intent. If not, that means that even people who post family videos on facebook in the public realm from these parks could be fined too... Facebook puts ads before and after showing videos in peoples feeds, no different than youtube.. Imagine how many people fall into that category. Imagine someones mother who posts a few clips on facebook for grandma, of the children in the park, getting fined. By one definition out there this is basically what they are saying. If youtube is out of bounds, so is facebook and other media that has ads. So I imagine, the lawyers who talk about "filmmakers intent" are probably right but here is the thing, its like a ticket, you might can beat it in court but you still have to go through the hassle and the cost of a lawyer to do so. So I would not recommend putting it to the test. Another gray area is Parks vs National Forests, some people like Dovey say forests are included, some say only parks. The government websites seems to imply forests also, not just parks, but that said, I have spoken to local youtubers in the same genre as me who just communicated with our local forestry offices for permits and they were told forests, permits are not needed, just parks. So even within government agencies, there is mixed information and a mess. So long story short, before someone goes, they should just call their local forestry office and ask, and get it in writing in an email... lol . There is too much mixture of information out there.
      On a side note, their is already a bill in the senate to roll this back. The new bill will allow for up to seven people in a group to film without a permit as long as they follow certain rules, such as what kind of equipment they use (amount of equipment) , that they are basically doing things that the park was made for etc. I am following its status right now, so far, so good, fingers crossed. Basically all of the fishing, hunting, tour guides, landscape photography, hiking and other youtubers in this genre will be in the clear once it passes. I am hoping only a few months.
      As for me, I have information from my local office that in the forest, no permit is needed, so I am in the clear. I rarely do the parks, mainly focus on the remote mountain roads in the forests.

      @@SidneyDiongzon There is a bill at the senate right now that will reverse it. It will allow for no permit for small filmakers in groups of less than 7 that fit a certain criteria (basically youtubers etc). Fingers crossed.
