Can we get drug test for government workers
Yea lets also test police officers for performance enhancing drugs.
I agree,i once saw a york regional police officer do a line of a cd case while the car was moving. Crazy eh. Lol
not "government workers"... *Elected Officials*
Yes everyone in law enforcement should be tested for drugs or alcohol before their shift
Nah.... Police are above the law they don't need to do any test that would be silly
Mandatory? Without any evidence of intoxication? What a disgusting police state we've become here in Ontario.
It's across Canada: Mandatory Alcohol Screening 18 December 2018.
That means if you’ve been sober all your life and never consumed alcohol, you still have to take a breathalyzer test because all cops are ordered to assume that drivers committing traffic infractions are drunk behind the wheel.
If you're not drinking and driving you have nothing to worry about. It's a breath lol
Do not drink and drive you will no worries ok ?
booohooo i have to breathe into a tube
fun fact: our premier was a cocaine dealer in high school.. mandatory drug tests for anyone taking a paycheck from the government.. weekly :)
Citation needed.
I seem to remember that Drug Ford dealt hash, not cocaine, but it could have been both, I'd have to go back and check.
thats when the government will decriminalize the drugs
Lakeshore Collegiate?
@@gmkbelanger o
This has to be the stupidest thing I've ever seen, even if the officer has 0 reason to think you've been drinking they still have to do this test 🤣
Article 8 of the Canadian Charter of Rights and Freedoms.
_"Everyone has the right to be secure against unreasonable search or seizure"_
And, as you stated, "even if the officer has 0 reason to think you've been drinking". Zero reason is perhaps an acceptable definition of "unreasonable."
@@Gulgathydra Mandatory alcohol screening
"Police officers can demand a preliminary breath sample to test for alcohol without reasonable suspicion the driver has alcohol in their body. Sober or not, a driver who refuses to provide a breath sample can be criminally charged with refusal to provide a sample."
Thats the law, and its held up in provincial supreme court. Feel free to spend the millions of dollars on a lawyer to bring it the the supreme court of canada.
@@keith3761 Canadians have zero rights, aint it great
Totally unconstitutional . Without probable cause ( evidence ) that the driver is impaired this is just that.
Shut up Alex Taylor. Why are you worried? Do you drive while impaired?
Not evidence, just reasonable suspicion. Which they clearly lack in this instance.
@@Gulgathydra Exactly.
It could be argued that an inability to follow traffic laws or negligence (by way of a vehicle's equipment and/or parts not being up to required standards) could qualify as probable cause for a driver being under the influence. Presumably, if a person is not following directions or neglecting their basic responsibilities, that person is either experiencing impairment of some kind (substance-related, emotional, or neurological) or they have no regard for civility and decorum.
It will hold you up an extra 3 minutes if you comply. But if your not intoxicated or under the influence then who cares about doing one?
Just curious?
The question that will have to be answered in court is, is it reasonable to do an alcohol screening when the offence has nothing to do with being impaired? Under section 8 of the charter, everyone has the right to be secure against unreasonable search or seizure.
What search, what seizure? 😂🤦
@@BoogieBoogsForever a breathalyzer test is considered a search, a seizure is the arrest and/or detainment of you as a person. If you are forced to carry out a breathalyzer test when the cop has no probable cause to start one, that is considered an unlawful detainment.
This is my understanding, I am not a lawyer, correct me if I am wrong.
@BoogieBoogsForever, Really? Breathalyzer is a search device for alcohol. If you are not suspected of consuming alcohol that is an unreasonable search.
@@Turtle50 I thought they had to smell alcohol on your breath before they could do the test?
@@jimiplayscobo5877No, the Trudeau government changed the rules in December 2018. As long as you're driving police can stop you for any reason. They can even demand a breath sample up to 2 hours after you've stopped driving.

Unreasonable searches are against our rights period!!!!!
I'd prefer a delay of a minute for a breath sample, and be on my way, knowing they'll catch more yahoo's that ARE Drinking & Driving with them. I'd do it even if it was NOT mandatory.
@@WhiteWolf65 IMO it's just going to encourage more unnecessary stops. Especially since it seems it's mandatory if they can find ANY reason to pull you over. The way this is stated, it is very much open to abuse. And when I got a breathalyser at a ride program it took over half an hour before they finally told me I could go. They didn't do any other roadside impairment testing on me (follow the light, walking test or balance test. Nothing).. Just immediately asked me to do a breathalyser. @@mikeoxlong5843
That's unfortunately what is gonna come down too, however; the government won't make any money on their zero tolerance policy.
Driving with alcohol in your system isn't illegal, it's having an amount over the the limit that's illegal
@@curtish5925 - - Perhaps mandating ZERO alcohol in ALL drivers is the answer. It would take the guessing game out of it, and we've all done it - "I've had 5 beers in 3 hours, body gets rid of a beer an hour, I should be ok" - - If it was ZERO blood alcohol, it would take the guess work out of it.
I know, your comeback is "what about cough syrup" - Well, if you're taking cough syrup in a ZERO alcohol world, then don't drive. Pretty simple.
@@mikeoxlong5843
I never bring up the cough syrup argument because that doesn't happen enough to make any difference.
My point is there probably is another way to go about this. The government won't mandate a zero tolerance policy, they control the alcohol sales and they'd lose money.
You figure they'd be just sitting outside bars and restaurants waiting to pull someone over for doing 5 km over the limit just so they can get a breath sample no?
Thats called guilty until proven innocent. Thats wrong. Lawyers are going to have a field day with this.
No it's not, there's no punishment, this is just evidence gathering.
I believe it falls under unreasonable search or seizure, Article 8 of the Canadian Charter of Rights and Freedoms.
They are literally attempting to gather incriminating evidence without any reason to do so, just as a matter of course.
@@mellowoutman4516 This is criminal law, tort only applies in civil matters. The probable cause is speeding, or other traffic violations. However, I suspect that this will get challenged at each level of court until the Supreme Court of Canada.
Wrong. Saskatchewan has been doing it already and their Kings Bench Court ruled it constitutional.
@Risran -- It's already been ruled constitutional. However, feel free to refuse the test if you so wish. That big bad policeman can't tell you what to do, right ?

Sounds like someone needs to appeal to a higher court.
What about Section 8 of the Charter?
Illegal. And Orwellian.
Dude, the Canadian Charter of Rights and Freedoms literally acknowledged that your rights won't be absolute. For example, there are laws against libel, defamation, threats, etc. These laws would come to pass, even if they were a breach of the Charter. The government must be able to prove that the violations of Charter rights, through the creation of a law, is a reasonable violation. In this case, it is reasonable for a law like this to pass, as it will make our roads safer.
Violation of Section 8 of the Charter .
Safety is more important 👍🇨🇦
They are now going by the UN's charter not the Canadian charter.
Everyone has the right to be secure against unreasonable search or seizure.

It was passed in 2018 by the Trudeau government. Bill C-46 amended the law so the police could stop you for any reason if you were driving. They can even demand a breath sample up to 2 hours after you've stopped driving. They snuck it in with the marijuana legalization.

It's a provincial law so it won't be a criminal charge to refuse but you could be fined, lose your drivers license and have your car impounded. The Supreme Court has upheld drunk driving campaigns where everyone is stopped on a section of road so this might be allowed.
