      That means if you’ve been sober all your life and never consumed alcohol, you still have to take a breathalyzer test because all cops are ordered to assume that drivers committing traffic infractions are drunk behind the wheel.

      Article 8 of the Canadian Charter of Rights and Freedoms.
      _"Everyone has the right to be secure against unreasonable search or seizure"_
      And, as you stated, "even if the officer has 0 reason to think you've been drinking". Zero reason is perhaps an acceptable definition of "unreasonable."

      "Police officers can demand a preliminary breath sample to test for alcohol without reasonable suspicion the driver has alcohol in their body. Sober or not, a driver who refuses to provide a breath sample can be criminally charged with refusal to provide a sample."
      Thats the law, and its held up in provincial supreme court. Feel free to spend the millions of dollars on a lawyer to bring it the the supreme court of canada.

      It could be argued that an inability to follow traffic laws or negligence (by way of a vehicle's equipment and/or parts not being up to required standards) could qualify as probable cause for a driver being under the influence. Presumably, if a person is not following directions or neglecting their basic responsibilities, that person is either experiencing impairment of some kind (substance-related, emotional, or neurological) or they have no regard for civility and decorum.

    The question that will have to be answered in court is, is it reasonable to do an alcohol screening when the offence has nothing to do with being impaired? Under section 8 of the charter, everyone has the right to be secure against unreasonable search or seizure.

      @@BoogieBoogsForever a breathalyzer test is considered a search, a seizure is the arrest and/or detainment of you as a person. If you are forced to carry out a breathalyzer test when the cop has no probable cause to start one, that is considered an unlawful detainment.
      This is my understanding, I am not a lawyer, correct me if I am wrong.

      ​@@jimiplayscobo5877No, the Trudeau government changed the rules in December 2018. As long as you're driving police can stop you for any reason. They can even demand a breath sample up to 2 hours after you've stopped driving.

    Mouth wash and cologne will show positive for alcohol.... this is another way to detain and harass.
    I want drunk drivers off the road like anyone else, however not at the expense of our rights.
    Unreasonable searches are against our rights period!!!!!

      I'd prefer a delay of a minute for a breath sample, and be on my way, knowing they'll catch more yahoo's that ARE Drinking & Driving with them. I'd do it even if it was NOT mandatory.

      @@WhiteWolf65 IMO it's just going to encourage more unnecessary stops. Especially since it seems it's mandatory if they can find ANY reason to pull you over. The way this is stated, it is very much open to abuse. And when I got a breathalyser at a ride program it took over half an hour before they finally told me I could go. They didn't do any other roadside impairment testing on me (follow the light, walking test or balance test. Nothing).. Just immediately asked me to do a breathalyser. And it took that long just for that.

It would take the guessing game out of it, and we've all done it - "I've had 5 beers in 3 hours, body gets rid of a beer an hour, I should be ok" - - If it was ZERO blood alcohol, it would take the guess work out of it.

      I never bring up the cough syrup argument because that doesn't happen enough to make any difference.
      My point is there probably is another way to go about this. The government won't mandate a zero tolerance policy, they control the alcohol sales and they'd lose money.
      You figure they'd be just sitting outside bars and restaurants waiting to pull someone over for doing 5 km over the limit just so they can get a breath sample no?

      No it's not, there's no punishment, this is just evidence gathering.
      I believe it falls under unreasonable search or seizure, Article 8 of the Canadian Charter of Rights and Freedoms.
      They are literally attempting to gather incriminating evidence without any reason to do so, just as a matter of course.

      Dude, the Canadian Charter of Rights and Freedoms literally acknowledged that your rights won't be absolute. For example, there are laws against libel, defamation, threats, etc. These laws would come to pass, even if they were a breach of the Charter. The government must be able to prove that the violations of Charter rights, through the creation of a law, is a reasonable violation. In this case, it is reasonable for a law like this to pass, as it will make our roads safer.

      The fines from those caught will help defray the costs, plus the funds saved for less damage to police vehicles, etc. when pursuing a DUI. Then there are the funds to replace Municipal infrastructure, like street signs, light poles, etc. that DUI's damage. It all adds up.

      The Trudeau government amended the law in December 2018 so that a police officer, for any reason, can stop you if you're driving. They can also demand a breath sample even up to 2 hours after you've stopped driving.

      Must be part of the procedure to provide a garbage bag and straw to the person being tested, and to show the unit being cleaned afterwards to remove any dna and prints.
      Individually sealed, clean packages of gloves should be available for anyone wanting them, instead of touching the unit.
      No fishing expeditions for police.

    Without "reasonable suspicion" they are breaking the law. They are not allowed to break the law in order to enforce it. We'll see how this plays out in court. The PC could be facing some charges, and under the new rules, that may not go so well- no paid vacation.

    And it's another step towards Canada becoming a full-blown police state where you are judged guilty until you can prove your innocence.
    I have no problem with someone being required to give a breath sample if there is evidence that they may be impaired, but simply assuming everyone is guilty is NOT the way to go!

      If they pull you over for a traffic infraction (as they note in the video) there is cause. That is when they need the sample. They are not pulling over cars because they feel like it (it is NOT going to be a RIDE check all over the country)

      No there is NOT cause. There needs to be some indication of impairment. I suppose you're fine with the cops also doing a vehicle search for drugs while their at it, right? Or how about them doing a body cavity search?

    Ppl that haven't drank should deny the breathalyzer everytime and take em to court after but unfortunately that's not how the world works ....all that would do is cause you more trouble ...i don't know how this got passed.....they are slowly asserting more and more control and seeing how much they can get away with doing at this point they might as well put breathalyzer in ever car right from the manufacturer ... we're not far from it at this point.

      If it is supposedly mandatory in all provinces, the police in rural areas aren't bothering with it as far as I've seen. Also, it says all traffic stops. Does that mean organized traffic stops where they check every car that passes through? If so, that's extremely authoritarian.

    So if RIDE reduced the number of drunk drivers it would continue because it was successful.
    If it did nothing it would continue until it was effective.
    And if drunk driving increased they would expand random checks to ALL stops.
    If it still fails then the cops will conduct breathalizers in parking lots.

    It's a provincial law so it won't be a criminal charge to refuse but you could be fined, lose your drivers license and have your car impounded. The Supreme Court has upheld drunk driving campaigns where everyone is stopped on a section of road so this might be allowed. On the other hand Doug Ford loves to use the not withstanding clause to override your rights so that's an option. Vote him out while we still have rights.
