Is debt validation the same as a dispute? I see you interchange those words. I sent a debt validation letter to Transworld for a NCSLT collection. I received alot of information back rather quickly but I am now questioning some of the info they sent me, namely the AES computer printouts and also when the debt will be at SOL (which they did not answer in my first letter). Is this considered still a diapute? I wonder if they will bother to send me an answer. Thank you for your videos. If I lived in Florida I would be calling you for sure.
Essentially the same thing. The way the law is worded, the debt collector sends verification in response to your dispute. (See 15 USC § 1692g(a)(4))
All they have to give you, in effect, is an account statement with your information and the charges. They don't have to tell you when the SOL runs.
I'm working on my credit. I sent a debt validation and no response. I checked to see if I had any cases against me, andcthey filed suit in 2019. I never got summons because my unit number was not on the court docs-address incomplete. I did however receive subsequent mailings. I'm wondering if there's any recourse atv this point. Statute in my state is 3 years and we're beyond that....
If the case got dismissed and you’re beyond SOL you should be ok from here out. If they got a judgment against you that will be a real problem that you’ll need to discuss with a lawyer in your state.

i've been sued by someone i don't even know, so i filed and affidavit with the court, and sent certified copy to the plaintiff. they never picked it up. now what?
It sounds like you’re deeply unfamiliar with how the legal process works, and that means you’re likely to get hurt.
Check with a lawyer in your state before you make a mistake you won’t be able to recover from.
I live in Wisconsin. I disputed several debts that were held by a collector and all but two were removed from my Credit Report. I tried to settle for the two verified accounts. They are trying to make me pay all of the accounts, even the disputed and removed ones, in order to settle. Can they do that?

What if I disputed for validation and correct amount via certified mail and collectors showed proof which is correct now who is working for the original creditor. Now I negotiated an amount I can pay via certified mail to collector and it’s been over 6 weeks they have yet responded. It shows they received as well. Do I call them?

Never talk to debt collectors on the phone.
If they want your money, they'll respond. If they don't want to deal with you, there's no way to make them. (Unless you catch them breaking the law... check out our Debt Collection Battle Plan video)
What do you suggest if I keep getting letters from the same debt collector- trying to collect- when I have already gone through the process of disputing it with return receipt and signature requested to the debt collector, along with all 3 credit bureaus? All 3 Credit bureaus (TransUnion, Equifax, and Experian) removed it immediately. Then why is the debt collector still sending me letters? They never sent me proof that I owe the debt, however, I provided proof to them and the credit bureaus that I do not owe the debt. The original creditor sold an illegitimate debt (I never owed it). I am so frustrated with trying to deal with this effectively. Do I need to respond to the debt collector? Can they really submit this same collection to the credit bureaus again? Do I need to respond to the debt collector, or do I ignore them since it's already been handled in March/April of 2024? Thank you for your time!
Did you send your dispute to the bureaus, the debt collectors, or all the above?
If you sent a dispute to the debt collector, and they never responded, but continue to collect, they're breaking the law and you can sue the,
If you only disputed to the bureaus, there is nothing stopping the debt collector from communicating with you. Just because the bureaus remove it, doesn't have any effect on the validity or collectability of the debt.

I have been receiving letters from Jefferson Capital for months. The other day I got a text message and I clicked to the link sent and then I logged in using the last 4 of my SSN found it was Jefferson. The debt was time barred, I never believed the debt was accurate. Did I make a mistake? I'm in California.
I would never click a link in a text message.
If a collection agency dosent respond to my best validation letter does that mean they need to delete it off the credit report during that time also?
No. But if they make a new report, there are many ways they might be violating the law. And that exposes them to getting sued by you.

I have 750+ scores and nothing negative since 2015. My past 2 judgements are fully paid and off my report. 1 medical dept was paid for delete in 2013. One other was also deleted by MCM in 2013 after contacting CFPB. All of this is now way past Satute of Limitations. In recent months Capio Partners and one other has keep calling. They never leave a msg and have never sent me collection letters in the mail. Could they be junk debt buyers trying to collect now? In FL. might have to call you if it escalates.

I live in AR, and have found out I'm being sued by LVNV Funding for credit card debt. But, the only way I found out is I received mail from a couple of law firms offering their services for representation. Both letters contained the circuit court county name and case number. But, I have not received anything from LVNV to indicate they are suing me.
I have tried on two separate occasions to settle the debt with them in writing, but have not received a response back either time. Each of those times, I didn't think to send the letters by certified mail. Dumb mistake on my part as I'm learning. But, I still would have thought I would have received some type of response from them, but certainly not a lawsuit when I was trying to settle with them. Do you have any advice/suggestions on what I should do now since this is turning into me being sued? And is settling still a possibility if you're being sued? I'm frustrated that they didn't respond to my first two attempts, and it's turned into this. Thanks for any help.
Every state has different rules about whether you've been "served" so definitely talk to at LEAST one of those lawyers.

I’m currently being sued by Midland. Can you tell me if it’s legal for Midland to sue when they know or should have known, there’s an arbitration clause that clearly says any and all disputes will be settled by arbitration? I’ve motioned to compel arbitration. Motion to be discussed at pre trial scheduled for mid July 2023. Thanks
Yes, it's legal, but the judge may compel arbitration.
That might get the case dismissed, but it won't extinguish the debt, it won't clear your credit report, and they certainly won't be paying you any money for violations they've committed. Only total victory will do that.

Hi, Mr. Mike.
I decided to contact the phone number of the collection agency that notified me that I owed a debt, which I do not.
The purpose of calling was to find out how often they check their PO boxes because I had already sent in my dispute letter via certified mail a week ago today.
The lady picked up on the first ring; it seemed sketchy. Nevertheless, I asked my question but she DID NOT tell me the address of where their PO Box is located; another thing I found sketchy.
Long story short, I looked up the number online and found out it is a scam number listed on RoboKiller.
Should I be concerned about having to go to court and/or my credit score given that these people may just be scammers?
I have my return receipt. I didn't send any money and I didn't make any "admissions" over the phone. I also didn't discuss any sentive information (banking information, social security, where I work, etc.)
Edit: ALSO, the zip code she told me didn't match the zip code on the letter that came to me a few weeks ago. It was off by the last number. And I asked her was she sure and she said, "yes", but obviously she was wrong.

Michael, great info. Just received a letter from a collection company here in Florida for 16K. Waiting on the verification from them. I was a leaseholder for a mobile home park unit in Vero. My father in law owned the mobile home itself and was only resident in it. He died in July 2021 and I notified property manager in an acknowledged email on 7/30/21 that unit was empty and I had no further interest in it. My lease should have expired 12/31/21. Apparently they kept charging me for rent until they could gain possession of the mobile home. Anyway, not asking for free legal advice regarding this, but would I normally be able to negotiate this with collection agency? Thanks

@ricardowasylikpl7430 just received the first and only collection letter from Hunter Warfield in Tampa 6 days ago. I sent them an email requesting a breakdown of what I'm alleged to owe ( before I started watching all of your videos). They responded to my email saying that they would send me debt verification. Does the original creditor have to give you a notice that they will send you to a debt collector?
No. Unless you have a contract that says otherwise.

Hi what if after you write the debt collector using the address provided on the credit report. The letter returned saying no one is at the address.
Either it’s a scam (not a real collector) or they’re a real collector lying to you.
In the second case, you can sue them but you’ll have to do some research and find them first.

I received a bill from a collections and I have never ever received the bill from them.
Now I have to deal with this cockroach calling me nonstop and sending me letters.

Bro what if a debt collector sent a disputed bill to my mother address and not my address, where the disputed debt..... like happened. Where I wasn't giving the chance to disputed the bill again and then turned around sometime later a sent my bill to my mother's house instead of my house.
Basically I been in my residence since 2016.
The dispute bill that I shouldn't have to pay accrued in 2018.
In beginning of 2023 they mailed my mother.
And on the day of this comment I have the bill.
There is no way that is legal.

Please respond to my comment. I paid the full debt to the company I owed ONE day before I recieved the letter and I have always only paid my bills with a debit card so I'm not sure how the debt got sent to collections given that I never "borrowed" money from a credit card company to pay the bill. Please help me understand that?
But also, I'd like for you to assess whether or not this is a good debt validation letter to send to the collection agency:
"To whom it may concern, I'm responding to the letter I recieved on Friday June 16, 2023. I dispute the validity of the debt. I respectfully request that you stop collection and remove this item from your records. Please Respond to this dispute by providing the following 1). Name and address of the original creditor 2). the amount owed to the original creditor as of the date you recieved this letter 3). legal documentation stating that I am contractually obligated to pay any debt recieved by (the name of the collection agency)."

You can do whatever you want, but I wouldn't give them a handwriting sample.

I sent Certified mail validation letter to Portfolio Recovery back in March 9 2024 today is March 21 2024 and didn’t received the green card that they have to sign. I have the little paper the post office provide with the tracking number for the return signed card I will check online to see what the status is of me getting the card back. Portfolio called today I did not say I was the person they asked for I just said who is this the lady from Portfolio said first I need to verify if I’m talking to and she said my name and I said who is this then she said Portfolio Recovery so I said what is your phone number she provided me with a 1 800# and the caller ID on my phone showed a local number and I just said let me call you back.
Definitely check it online.
