It doesn't necessarily hurt to ask for a warning, but the further courtesy was correctly declined due to the seriousness of the speed. The passenger's conduct is irrelevant for the driver; unless the driver clearly encourages it or participates in it.
I don’t ever expect to be let off with a warning but I always act pleasant and remorseful and it goes so far how I’m earth could you cuss an officer out and ask to be let off with a warning

About the first clip; In Sweden you would have your license recalled and if you have had your license less than 2 years you wouldn't get it back (+ tickets) and after those 2 years you would have to do all the tests again like you never had one. And you would not be allowed to drive the vehicle a single inch and it would be towed to the impound. If you repeatedly drive without no driving permit the vehicle you drive could get confiscated by the police no matter who the owner is.

This is why the state I grew up in does not allow local police to have radar and mandates that speed compliance cannot be enforced for 1/4 mile after the first speed sign on any roads and on limited access highways its 2 miles... No putting police cars behind a mound of dirt or a bridge right after the sign. For the rest of you, I suggest you invest in some REAL electronic countermeasures so that they cannot get a speed lock until you are VERY CLOSE. That is the easy way to deal with this BS problem.

People speed so you can keep up with traffic or get hit... but then you are at risk of photo radar and other speed devices. My response to the 2nd person pulled over asking to be given a warning: "Ma'am, letting you go with a warning or reducing the charge would be considered a courtesy. Courtesy is a two-way street. Since the beginning of the stop, the person in your passenger seat has been nothing but rude and discourteous, and--to use language that even HE could understand--an utter flaming asshole. You MAY want to have a discussion with him later on about manners, if you don't think that would be a waste of your breath. Here's your ticket."
The conduct of the passenger should have zero influence on the decision-making for the driver. They are two separate individuals. The driver was respectful and courteous and Deputy Sloup rightfully extended them the courtesy of not being charged criminally for their speed as a result. It is not outright illegal to express a dislike for the government. It's unpleasant, but it's protected speech nonetheless.

@@williamanderson6006 Unless the officer suspects them of a crime. In this particular case, the deputy didn't have a right to ID him (and thus didn't) but if there were suspicions of illegal activity, he is well within his right to ask the passenger for ID. It just needs to be plausible.

Yeap. Pennsylvania v. Mimms. "Step out of the vehicle and have a seat over there where I can see you." Become more unruly and it can become, "You're now going to be handcuffed and seated in the back of my vehicle and detained for the duration of the stop." However, Frank recognized it's not really worth the fight/paperwork and the driver helped make things easier by re-positioning the vehicle.

About the first clip; In Sweden you would have your license recalled and if you have had your license less than 2 years you wouldn't get it back (+ tickets) and after those 2 years you would have to do all the tests again like you never had one. And you would not be allowed to drive the vehicle a single inch and it would be towed to the impound. If you repeatedly drive without no driving permit the vehicle you drive could get confiscated by the police no matter who the owner is.

This is why the state I grew up in does not allow local police to have radar and mandates that speed compliance cannot be enforced for 1/4 mile after the first speed sign on any roads and on limited access highways its 2 miles... No putting police cars behind a mound of dirt or a bridge right after the sign. For the rest of you, I suggest you invest in some REAL electronic countermeasures so that they cannot get a speed lock until you are VERY CLOSE. That is the easy way to deal with this BS problem.

@@1packatak - Yes... they artificially set it low to write tickets... Some states love to set up the laws to be punitive and collect money and other states take a very dim view of that BS. Lucky for me I do not have a bag of nazi's to deal with... But there are places where I know its bad. Example Ohio and VA. Protecting ones self is challenging there. People speed so you can keep up with traffic or get hit... but then you are at risk of photo radar and other speed devices. Configuring things so that you "Stay Off Their Radar" so to say and their cameras too, is a good thing and has served many people well. If you want to be a boot licker or a do-gooder, be my guest. There is no happy medium in this mix. The traffic laws need revamped and people need left alone by government and nervous nelly karens like you :) Freedom is Scary. Deal With It.

My response to the 2nd person pulled over asking to be given a warning:
"Ma'am, letting you go with a warning or reducing the charge would be considered a courtesy. Courtesy is a two-way street. Since the beginning of the stop, the person in your passenger seat has been nothing but rude and discourteous, and--to use language that even HE could understand--an utter flaming asshole. You MAY want to have a discussion with him later on about manners, if you don't think that would be a waste of your breath. Here's your ticket."
The conduct of the passenger should have zero influence on the decision-making for the driver. They are two separate individuals. The driver was respectful and courteous and Deputy Sloup rightfully extended them the courtesy of not being charged criminally for their speed as a result. It is not outright illegal to express a dislike for the government. It's unpleasant, but it's protected speech nonetheless.

If he had been doing something to deserve it I guarantee, he would’ve gotten one. I don’t know who in the hell thinks that it’s OK to speak to an officer or deputy in that fashion. It doesn’t mean anything that you’re the passenger. The deputy had the right to identify him, and I bet he had warrants if he had. Once a vehicle is stopped inside of it is subject to Being checked deputy. Frank shows amazing restraint, and professionalism with people like this.

@@williamanderson6006 Unless the officer suspects them of a crime. In this particular case, the deputy didn't have a right to ID him (and thus didn't) but if there were suspicions of illegal activity, he is well within his right to ask the passenger for ID. It just needs to be plausible.

To be fair, she was getting a ticket regardless. 20 over is way too high to be giving warnings, especially if you are a traffic, deputy or officer. However, Deputy Frank is able to separate the people and he did not treat her any differently than he would have, had that idiot not been in the car with her. Yeap. Pennsylvania v. Mimms. "Step out of the vehicle and have a seat over there where I can see you." Become more unruly and it can become, "You're now going to be handcuffed and seated in the back of my vehicle and detained for the duration of the stop."
However, Frank recognized it's not really worth the fight/paperwork and the driver helped make things easier by re-positioning the vehicle.
