In 1948, Count Folke Bernadotte, a UN mediator in Palestine, and UN workers on a mission in Palestine, were assassinated by a terrorist group.
In the wake of Count Bernadotte’s assassination, the UN General Assembly requested an advisory opinion from the International Court of Justice, or ICJ, to answer whether the UN may bring an international claim against a country for damages caused to either the UN or a victim who is performing duties for the UN. The UN also requested that the court’s advisory opinion answer a conditional question, depending on the court’s finding: If the ICJ finds that the UN can bring an international claim, how should the rights of the UN and the home country of the victim be reconciled when a victim brings a claim for reparations?
