    Whats insane is if I hire you as an editor, you use adobe to edit my stuff, and then with the way they word their TOS, they now have the rights to my content that you were editing for me. The fact that adobe thinks they can just claim the rights to everyones IP with the simple click of a button is mind boggling to me.

    Piracy will always exist, and as long as companies continue attempting to enforce a shareholder-driven technocratic dictatorship, piracy will also always maintain an element of moralization.
    If corporations don't like that, maybe they should stop trying to find the overlapping segment on the venn diagram between Animal Farm, 1984, Fahrenheit 451, and Neuromancer.

    Piracy has always existed because of service issues. Companies are ALWAYS trying to push the boundry of what they can get away with. Its only recently that consumer rights/protection laws have been updated and reinforced, at least in Europe, against these types of shady practices.

      @@filipvadas7602 I'm curious how far arbitration agreements are going to go. And, if they're super prelevant in the US as I feel they are becoming, if that's going to lead to piracy to retain the right to file class action lawsuits.

    Yes, DOTA was made do in part thanks to Warcraft 3, which then of course spawned League of Legends and the sequel to the mod, DOTA 2; as well as the ironic HOTS which was made by Blizzard to try and be competition to both DOTA 2 and League of Legends, only for it to now sit in "baby jail" where nothing new will ever be added to the game, but it is still playable.

    • @decilence6184

      HOTS was cool, they could have made it the fortnite of mobas.
      Sadly the random game modes with reduced personal impact on the game is just boring.

    Piracy is only malicious if you do it just because you want to. But piracy to avoid shady, predatory, and legally dubious practices is what I call justice. The age of information and technology is at a point where every single bit of content and software is out there for free if you look hard enough for it. Companies are afforded the courtesy of the masses for not wanting to deal with the time and effort required to get what they offer for free. It may be a courtesy of convenience but it is a courtesy nonetheless. And every time a company like EA, Blizzard, Adobe, Apple, etc, wants to fuck around, I will side with anyone who chooses to make them find out. I support retaliatory piracy.

      I was playing Pokemon Emerald recently and it was weird to me to not see some sort of ad or connectivity issue. It's a game from the early 2000s that I had played before, so I know it doesn't have them. It was just weird to engage with something that wasn't trying to sell me something.

    The worst part is that any security leak from adobe could get really bad, private user info would already be bad enough but if adobe want to use it's userbase works in anyway they'd have to store them or have access to them in some shape or form. Ergo you could end up with copyrighted and/or confidential content from all around the world floating around the interweb alongside your average Joe's personal creations.

    • @KipReacts
      @KipReacts  Месяц назад +1

      @Blood_M4ster More and more, I'm a fan that big companies should be paying massive fines if they are caught in a leak. Especially if it's anything like recent leaks like Disney where it's 100% avoidable. Give them inventive to pay their security people very well.

    Kip. you can just remove files for game. takes 5s. don't even try to compare that. what Adobe had done was lock you. you can no longer access your projects. you can move files IF you have them locally and changed extension (very small % does dual backup). if your using adobe you often hold some files on their cloud (specially mac users as they have no storage.) and your digital file signature is there and many projects are split so you need that network part to access (or save as offline but amount of people doing that is low). to work in different software isn't an issue IF you save them in open source or non adobe extension to remove some adobe fuckery. specially vector files. as long you export them off adobe you can work on them without losing any effects. if they are in adobe extension when you open them they are fucked. missing crap ton of effects.
    and Kip. they know that they have fuck ton of confidential clients: you clicking yes allowed them to check all files. so who is to say that when they are hacked someone won't release ur whole medical record, taxes, bank records? no. it should be either opt in (as it was before that and almost no one used as you don't wanna them accessing your personal projects) or information that it be mandatory starting at.... and give us at least 2 weeks heads-up as that's most common deadline for large tos changes so we can move our work.
    Adobe changed that later but for short time it was hell.
    I work as graphic designer and often move between corel and adobe. it's easy if you just learn how to operate between them. but to do that i must get to that file and something we noticed during that time when you needed to agree if you moved your file to other pc that you didn't updated for some time (or used seas version) and you done it in offline mode those files were unreadable. adobe made them unusable but after you agreed they were back to working just fine.
    You worked at bank. imagine them changing TOS and you overnight can't get your money from them unless you agree to put all of your details in the open for all to see. you can't also close it unless you agree for that. and they won't even talk to you unless you agree as support req you login and to log in you must agree how many laws that would break?
    Edit: companies that give you time to move and not lock you when they are changing tos: patreon, subscribestar, pixiv, Black magic davinci, and Cinema4d (2 months headsup was a thing when i still used it) Corel (if your in sub plan you have 1m month to agree to any mayor tos change or your moved to cancelation you will have access to all functions for 1month since that day or option to buy perpetual license to that version before changes.) clip paint as well (up to 2022. last time i used it. i'm no longer tracking them)

      Oh, fair points. The Blizzard game file argument was far less severe.
      I can say that during my time working in finance there was an upgrade to a system and hard credit pulls were effectively thrown out. As an institution we were supposed to have credit pulls retained and on-file for 60 days or so. One day the system just got upgraded and we were told that the data was just gone, and when I asked they confirmed people would have to have their credit pulled again. It was infuriating to be locked out of something like that.
      I honestly hope Adobe comes around, because from everything I've heard they've been going downhill for a while. I don't envy graphic designers that have to use the entire Adobe Suite, and are forced to use it and agree to such policy changes because Adobe knows where they stand in the market.
      I appreciate you writing all of that and clarifying some points!

    • @czarnynight
      @czarnynight Месяц назад

      @@KipReacts no problem. i was on stream but shut my mouth as sending that on twitch....ik i be having chance on YT.
      they reverted that in 48h as they broke so many laws. now it's opt in (no longer mandatory) to send and you can select on publish if you wanna allow them to train AI on your end project. still current TOS is bad but at least you can safely move to other system.
      problem is that not many people know how far other softwares are and they don't wanna give them a chance. adobe now more resembles cult. adobe is one of worse systems to work in for vector and video editing (would argue raster as well but not working in it) if you weren't forced by school to use adobe as whole plan is based on it you would use other programs. Davinci is more useful and feature complete and in terms of operating is more stable (not pre rendering after every change like adobe) and faster (can utilize your whole cpu and gpu. not just single core like adobe) and capable of using slowmotion and can work with Tricaster (if you worked in video production with multiple mics and cameras uk what it is) adobe constantly corrupts projects from Tricaster and you need start from scratch
      other issue was that if you clicked yes during initial change as you really needed to see that pdf or access your work files..... you couldn't opt out of it. was given after another backlash. but that was scummy. but they never specified if you opt out later, would they remove your files from their training data or keep them.
      also Adobe is sued for their subscription practices. not clarifying that price is for 12m contract and that new sit in company license is in reality a new 12 contract and not "new sit to your existing license" like small print said. only in tos was that every new sit is not extension of your current but new license that will just show on ur monthly invoice as part of existing. so tracking them is hard and it be cheaper just pay cancelation fee

    This is almost as bad as the Unity game engine updating its TOS to fee developers per download of a game. That new not clearly thought out plan would have bankrupt game devs because they are now getting charged by Unity per install of a game. Meanwhile some angry consumers could destroy companies by downloading, deleting / uninstalling, and then redownloading the same game an indefinite amount of times. It’s an infinite loop where Unity could nickel and dime companies into the red.
