    One of the biggest problems in law enforcement is- a judge will always say that you can’t expect an officer to know every law there is to know. Yet- a judge will tell a citizen that ignorance of the law is no excuse. One individual is a “law enforcement officer” the other individual is a “private citizen”. Which one of those two should the phrase “ignorance of the law is no excuse” pertain to?

      Every back the blue citizen I know says something like that. It’s a dumb piece of reasoning. We don’t let any other specialized field have that low of a bar. If you hire a framer to frame your house, you expect him to know every damn thing about framing including any local building codes. No profession is populated by so many that are so ignorant of the basic aspects of their job as the profession of law enforcement.

      Welcome to government. I received child support papers, and in order to fight for custody and Against Child Support, I had to first prove I was my childs father. Her mother and I weren't married, when I signed the birth certificate and the right of parentage at Birth it just meant that I was financially responsible for her until she was eighteen. It does not mean I'm her father!?!! Lol government

      If they’re to enforce a law, they should know it. They can’t enforce a law they’re ignorant of, so how are they so miserably enforcing laws in this way?!? Real embarrassment for Florida LE. These guys could’ve been off duty LE for all they knew. No reports of brandishing or threatening people. Their level of response took away any kind of rational actions at that point.

    I believe that this officer knew he was violating the rights and the law and that he should be held personally accountable. Even if he didn't know, ignorance of the law is not an excuse. This cop should be in prison.

    For the number of times they objected, someone could have looked up this law and found out that not only if open carry LEGAL while fishing/hunting/camping, its also legal while you're going to and from those activities.

      OFFICER SAFETY IS THEIR ONLY PRIORITY!! Supreme Court law has decided several times they(law enforcement), have no legal obligation to protect the public..
      And what happens if LEOs fail to 'protect and serve'? VERY LITTLE!!

    Any law enforcement who arrests a citizen who is then found not guilty or the charges dismissed should have it count against them. Also qualified immunity is the biggest bullshit ever.

      By "count against them" I hope you mean that after they get sued, they THEMSELVES, not tax payers must pay the victim of their crime for any damages they caused by their ignorance. Perhaps there should also be a "three strikes you're out" kind of thing or one strike you're out deal depending on the severity of rights broken. If a cop gets that many occurrences of rights violated due to ignorance of the law then immediate termination of that officer should occur.

    Qualified immunity prevents them from being held accountable for their actions. The city gets sued and the citizens pay the fines from taxes. Nobody learns a lesson and they continue doing whatever they wish under this BS Immunity.
    NOW THAT is a loophole that should be closed!!

      Qualified Immunity has been so abused that it isn't serving it's original purpose any more. It's now being used as a shield for bad and ignorant behavior by LEO. I'm inherently in support of the original purpose of Qualified Immunity but lately I'm opposed to it. If LEO even thinks they may be nearing the edge of violating someone's Civil Rights, they need to error on the side of not doing so even if it means a bad guy gets away.

      QI only protects an LEO from a CIVIL SUIT for violation of Constitutional Rights. The issue is, that MOST of our rights are actually decided based upon what the Courts have already ruled, as opposed to what is actually in the text of the Right. So the Supreme Court or a Circuit Court of Appeals decided 5, 10 20 years ago that a certain action WAS NOT a violation of say the Fourth Amendment, but a new case now makes it to the same or higher court based upon what an officer does today, and that court rules by a 5 to 4 or other slim majority that the same Officers conduct, is NOW a violation of the Constitution, that officer should be held personally liable???

    24 months of trade school at my cost as well as a year of verified field training before i was allowed to take a test that was 100 questions and 6 hours long then multiple hours of continueing education yearly on my dime to be allowed to draw contracts to work on airconditioners in georgia when i did it in 1989. Cops get about 6 weeks of training on the peoples dime and have power over our freedom as well as qualified immunity if they screw up and many times even if someone dies. If i screwed up it cost me out of pocket and the possibility of losing my licenses or even jail time was always hooveriing over my head even if it truly was an accident. Something isnt right here.

    No excuses, particularly in a time when every officer has readily available internet access. They could have simply looked the law up before taking action. It's understandable that an officer can't know every law but they can double check the laws applicable to the situation in question or atleast have dispatch do so and radio back. It literally takes 2 minutes. It's not like fishing is an extremely quick act where there's no time to spare. They could have easily taken 2 minutes to research and then made an educated action rather than just wing it like absolute morons endangering law abiding adults and themselves. Absolutely stupid.

Or why can’t they call someone that can help them because it seems like they need a lot of help when it comes to what the laws are.     Your lawyer needs to ask the officer during trial or further depositions "do you expect citizens to know each and every law pertinent to their activity at all times?' When he answers yes, then the lawyer should ask, 'should all officers know the law at all times, then?' He then has to acknowledge that officers sometimes improperly enforce laws, or acknowledge when they do so, that they sometimes violate rights based on opinion of law that is incorrect.

      @@Colgate64 An officer that does not know the law and has to admit it, greatly influences juries, you know the group made up of regular people aka, your peers. I gladly will take it as a compliment that I wouldn't make it as a lawyer, as most are scum sucking bottom feeders that chase ambulances. My lawyer is a good guy and he and I destroyed GMAC, now Ally financial in lawsuit. I say he and I because every time their witness or lawyer messed up I wrote him a note and he hammered them on cross based on those notes.

      @@ransompendragon623 They (Florida lawmakers) have had several opportunities to change their laws to be more Constitutionally friendly and have not done so. The most recent was the Florida Constitutional carry.
      A huge problem with Florida is the NorthEast liberal moving there. They leave the places in the NE where liberals have destroyed the place only to move to Florida and want the same laws and edicts from the leaders they elect.

      @@AliValentine143 There very often IS NOT clear case law, and that is what 2 attorneys do, is argue their point, based upon the case law that they think supports their decision. When Solo's Attorney tried to say that open carry is NOT an exception, If I was that officer, I would have shut him down, by reading him the actual FL statute that starts with the words "EXCEPT as otherwise", that pretty well makes it an exception.

      Not being of legal background, Government cannot abrogate a right. However, restrictions of Time, Place, & Manner may be imposed upon it.
      This officer had originally believed that the Manner of carry violated established laws. I do not know exactly what the laws of Florida are concerning concealed carry. Twenty-five states have passed constitutional carry. I do not believe this has happened in Florida nor would it have a bearing upon this case.
      Bottom line is officer mucked it up and may be protected by Qualified Immunity. "We got a 911 call and the caller was scared. You have to stop doing that."

    This Officer still does not know what/who is allowed to "open carry" in Florida. A uniformed armed private Security Officer(Class "G" license) can open carry while going to and from work. Additionally, A private Security Officer with the title of Field Supervisor can open carry in the course of their duties and while travelling from security site to security site.

      (g) Regularly enrolled members of any organization duly authorized to purchase or receive weapons from the United States or from this state, or regularly enrolled members of clubs organized for target, skeet, or trap shooting, while at or going to or from shooting practice; or regularly enrolled members of clubs organized for modern or antique firearms collecting, while such members are at or going to or from their collectors’ gun shows, conventions, or exhibits;
      (h) A person engaged in fishing, camping, or lawful hunting or going to or returning from a fishing, camping, or lawful hunting expedition;
      (i) A person engaged in the business of manufacturing, repairing, or dealing in firearms, or the agent or representative of any such person while engaged in the lawful course of such business;
      (j) A person firing weapons for testing or target practice under safe conditions and in a safe place not prohibited by law or going to or from such place;
      (k) A person firing weapons in a safe and secure indoor range for testing and target practice;
      (l) A person traveling by private conveyance when the weapon is securely encased or in a public conveyance when the weapon is securely encased and not in the person’s manual possession;

    The biggest problem with law enforcement across the country is that they have qualified immunity, essentially giving them the rights to do anything they want to.
    We have to get rid of qualified immunity and internal affairs. Cops investigating cops is ridiculous. Call or write your representative and demand legislation to get rid of qualified immunity.
    These tyrants are not going to respect your rights. Period.

    Whoever that was on the speakerphone was dead wrong, there are many cases in Florida where it was upheld that every citizen has the right to open carry going to, coming from and while camping, fishing or hunting.
    There are probably a hundred videos on YT alone about these cases.
    I'd never camp or fish in Florida without a gun because gators, boas, wild boar and Florida panthers just to name a few reasons.

      @@cryptofan6255 that's what lawyers do. In deposition all but the most straight forward of questions like, star your full name and is it spelled this way, will get an objection to form. It preserved that lawyers ability to argue against the statement later whether it was truly objectionable or not. If not objected to then the statement becomes an uncontested truth to the case before the court to a great degree.

    I am not from Florida but I have spent a considerable amount of time there and I know for a fact that the law on open carry while fishing hunting and what they're leaving out target shooting has been in place for decades. With the amount of reptiles in Florida fishing without a firearm could be hazardous to your health and/or life.

    This reminds me of when a Republican at a congressional hearing questions a democrat or democrat appointee and they don't know the law, or ignore the law and just do as they please, and of course the cops lawyer is making excuses for the cop violating the rights of the people who were open carrying which again is legal. The cop saying officer and public safety as en excuse to have guns drawn and come up on the people isn't a legal reason to violate people's rights.

    There is absolutely no excuse for a "law enforcement officer" to not know every law. They need far more training before they're released on the public to literally change people's lives and or take their life.... Their responsibility at the very least warrants further training and better understanding of the laws they're responsible for enforcing. Like a plumber doesn't know what pvc glue is, we would say you aren't a plumber. A law enforcement officer that doesn't know the laws is not a law enforcement officer. There is no excuse for their ignorance.

      The question was overbroad and a misstatement of the law. Generally Florida permits open carrying while fishing. Fishing does not, however, authorize open carry by someone who is disqualified from possessing a firearm. The questioning attorney should have narrowed it. It doesn’t impact the issues in this litigation as the cops had no reason to believe he was disqualified from carrying, but the objections to the question were valid.

    Anyone who is under oath , in a trial of deposition, that refuses to answer the question that has actually been put to them, and instead answers a question/questions that they were obviously not asked, should face censure of some kind. Officers of the law , or of the court, who insist on doing so, should face more harsh penalties.
    This officer knew what he was actually being asked, and kept answering questions that he had not been asked.

    Just shows the whole thing is a game and the truth doesn't matter. Only thing that matters is how things are worded and your interpretation or knowledge. If a citizen is ignorant of the law their rights are violated and their freedom and ability to earn a living is violated. If an officer is ignorant of the law, theyre given paid leave, paid administrative duties, paid legal defence, and are immune to punishment.
    All this does is enable them to violate people with the knowledge there are no repercussions.

    Before they decided to approach with weapons drawn, and in a tactical formation, did any of the officers in question do just the slightest bit of research on the laws? I didn't think so.

      Here's what I think: one of them (sgt?) goes up to the fishing guys and does a little investigating. The others are backup if it goes south. Nope! They agree to make intimidating moves and then any pushback puts you in cuffs or worse. The cops could have possibly caused something much worse by not being cool headed. They went in looking for trouble, granted maybe subconsciously, but the fishermen were cool headed, which kept this from escalating. Isn't that what cops are supposed to do? More training needed here, even up the ladder.

    I don’t expect them to know all the laws but they let their ignorance be the basis for violating our 4th Amendment Right and Florida Statue 901.51

    If a normal person would have open carried while uninformed that it was illegal would he have been charged? The answer is absolutely. A cop violating the law because he is uninformed should carry the same weight. If one party is required to know law then it is common sense that people that enforce the law be held to the same if not higher standards.

    Here's the thing:
    There are Not that many laws and cases which a LEO needs to know pertaining to the rights of citizens. This is literally the 2nd amendment and the laws of his state which pertain to it. It is not a lot. He doesn't need to know books and books worth of laws; he needs to know like 5. Its not a lot to ask.

    The BIGGEST problem in law enforcement that I can identify is that, in the rush to hire only college-indoctrinated officers, communities are hiring more and more cops from outside the communities being policed; officers who are often not moored to or otherwise connected to the community. Often times these officers feel superior to the people in the communities being policed and have an absolute lack of empathy for them and have no commonly shared values.

What I am trying to express is comparable to a credit check. Meaning if enough people complain to his insurance or bonding company his score will go down and his premium will go up. It would not be financially responsible for a company to insure a bad officer. This is all about money.

    This is funny because I once heard a Judge say in open court “ ignorance of the law is not a defence”. So how is it we cant charge the police the for their ignorance?

    Dispatchers can't look up legalities prior to sending a swat team to dispatch the offenders that aren't offenders

    I love how you keep exposing all these political officers. This guy did not act in the capacity of a peace officer and instead along with his fellow officers acted out as political officers meaning they are enforcing something else but a law.

    I guess the first thing would be for the judge to determine if the law actual says that you can open cary when hunting , fishing or camping. Because the Defense lawyer will always object if the Judge allows him to.

    "It's like shooting fish in a barrel" made no sense to me until open carry while fishing became a thing.
