    I was sued by LVNV and went to court. Presented all the laws they had violated and the case was dismissed and removed from credit reports. LVNV then sold/gave/transferred the debt to another collection company.

    I fought with LVNV for about three years after proving that the account was a case of identity theft, they still tried to sue me. One day out of the blue I got a letter saying I was free and clear and the debt was not mine, I have held onto that letter like it was a golden ticket.

      If you proved it was ID theft and they kept hunting you down, that's a violation of federal law You could have sued them for it, and put some money in your pocket.
      If it's been less than a year, you still can.

    I have been binge watching your videos for the past two days! Thank you so much for posting such clear, detailed, essential information! Having papers served from LVNV scared me to death - they found me mere weeks after opening a line of credit (secured), after years of avoiding credit like the plague, just so I could teach my 18 year old son how to do it the RIGHT way and learn from my mistakes. I'm 52 years old and they are chasing me down for credit mistakes I made in my 20's!!! I responded promptly and requested validation of the debt, but I did not include the statement disputing the debt in my initial letter. (Not sure if I should even bother to dispute - it does appear to be valid.) I am concerned, however, because even though I will be able to get legal benefits through my job, that does not start until January 2025 and I need to respond to their validation within the next two weeks. How can I hold them off until January when I can get professional help? Can I ask them to communicate with my lawyer when I don't have contact information for a lawyer yet?

    They're garnishing my wages I didn't even know they were garnishing my wages until it came out of my paycheck. I had to go to my HR lady and ask her what was going on. She found out for me. Apparently they took me to court in July 12th of this year. I never received any documentations about going to court so of course I didn't show up because I did not know that I had to go to court so they garnished over $2,000 out of my paycheck. When I called the company and told them that I never received a letter stating that I had to go to court. The demeanor of the lady that I talked to changed really quick and she gave me the lawyers phone number which was different than on my paperwork and I called both numbers and never got a hold of any lawyers at all so I ended up stuck paying over $2,000. Almost lost my car because of the garnishment of 25% of my paycheck every pay

    What about just telling the court that I don’t have a signed contract with LVNV? That is what I put on my answer to them.

      We've never seen that strategy work, no matter how much certain online influencers push that idea.

    LVNV tried to garnish my wages a couple years ago. But because I’m head of household and my income is under a certain amount, the judge granted me exemption. Recently, the company contacted me ordering for me to fill a paper form giving a lot of personal information about me and my kids. I wasn’t comfortable with that, so I called instead to get more information. The company went back to court again in attempt to garnish my wages. I turned in a form asking for exemption again. What can I do to get rid of this situation for good ? The old credit card dept they are suing me for is almost 20 years old

    This also works in british columbia with solicitors and barristers that email you for credit card debt and tell you that they will go to court?

    This video is very informative & educating. Know your rights & know the laws of your state . The statue of limitations in the state of Ohio is 6 years regardless of what type of debt it is. I had a Sears cc I was making payments on it & one day I got a letter in the from midland credit . Which is a debt collector. After that I never heard anything after that . Your a 💯 % right about debt collectors.I do have a lawyer on my side. Just in case .

      LVNV is “plowing through” your lawyers? That’s extremely unusual.

    I received a lawsuit from LVNV for a debt about a month ago. I sent an answer form from the court disputing this and requesting proof that this debt is actually mine. Now I am getting emails from their attorney to settle this what do I do?

      If it's not your debt, we'd countersue the debt collector for violating federal law.
      You probably need to speak to a lawyer to do that successfully.

    LVNV just said in court they don’t need to provide original contract. They used my previous addresses as proof that debt belongs to me.

    I’m in Texas and I got a letter by a man at the door ( I’m being sued ) and it’s this company, they are saying I breached contract with one of the companies for $7,132 dollars and I have 14 days to contact the court before it defaults basically. I am very concerned …. Not sure what to do. I’m on the courts website where it was submitted and I click claims & I can do a defendants answer but I wanna ask you what u think I should do first. This is very new to me. I want to DENY these allegations. On the paper it does have a few dates of “when the account was opened” and when the last payment was. Which was all in 2022. I want to deny all of this.

    I’ve been getting letters from Law Offices saying that I was being sued by LVNV and just the other day had a police officer come to my house. They are not on my credit report and the company they say they bought the debt from says I owe zero dollars on my credit report.

    Just got a summons for pretrial....can't do.zoom calls...nor take the time off work because the date is too close to get off. Last time, I never responded and then they garnished my wages

      Failing to show up is a complete loser of a strategy. If you're in Florida, you can call us and we'll handle it for you. If you're in some other state, a lawyer there can probably handle the appearance for you.
      If you can't afford to take the day off work, you REALLY can't afford to get your wages garnished again. Treat this like an emergency.

    I filed a motion to arbitration they requested I initiate. Had court, judge gave us 30 days to initiate. I asked who would pay for that and she shrugged, so we got 30 days to initiate or she hears summary judgment.

      This is one of many reasons we don’t normally recommend arbitration.
      I know there are a lot of people who think it’s a silver bullet, but I’ve seen it backfire more often than it helps.

    Are they legally allowed to say you are on a pre legal track? Isn't that in violation of FDCPA since they can't sue?

    I am being sued by Midland. They sent a summons with credit card statement attached, statement of claim, bill of sale and assignment, exhibit A to bill of sale, affidavit of sale of accounts and certificate of conformity. Can i still defend myself in court? Or is it a losing situation for me since since they produce all these documents?

    If your are sued by an original creditor . how do determine if they have the proper Docs to make it a valid case against you? If so, what docs gives them leverage? statements? T&C?

      Original creditors usually have the documents they need, because they're the ones that created the account.
      Which documents they need depends on the specific claims they've sued you for. Usually they would need a copy of a contract, account records, and any other correspondence. Again, it depends on the specific claim.

      You’re allowed to dispute any credit report entry that’s inaccurate, incomplete, obsolete, or unverifiable. So first you have to identify how the collection fits into one of those categories.

    What if the lawyer that lvnv doesn't show up to court what can i say or do to stop this in the future it was wrote off in 2020 i had a protection plan to pay off the debt if my income was stopped due to not working covid hit and hours were cut way down to nothing and care credit didn't use the insurance i pai for on the loan to take care of it and im from Texas

    I'm out of the country but being sued in NY by this company. All the lawyers I've spoken to said their retainer fee costs more than what I'm being sued for and I'm not eligible for pro bono representation since I'm no longer a resident. And getting all of these documents internationally notarized and shipped is nearly the same as paying smh

    I’m being garnished by LVNV. They take from every single check. I make $240. 00 per week but with the garnishment I get $180.00 per week. My boss asked to settle for me and they said no way she needs to pay all of it. I don’t make much, my husband barely keeps us afloat and my checks help keep food on the table or gas in the car. What should I say to them? Also I never received anything to apply to stop the garnishment

      Once you’re in garnishment, it means you’ve already lost the court case. Either look for an exemption, settle, or talk to a lawyer and see if you can reopen the judgment.

    I got a letter from LVNV and it says at the bottom:
    “ the law limits how long you can be sued on a debt. Because of the age of your debt, LVNV funding LLC cannot sue you for it, and LVNV funding LLC cannot report it to any credit reporting agency.”
    So should I just send the form and check off that I dispute this debt because it’s not my debt? Or should I also ask for them to send me the name and address of the original creditor?

    I got sued by lvnv for 1k. I go for first pre trial and now im scheduled for second pre trial. The judge just pretty much told me to mesage the lvnv representative. The lawyer of lvnv send me an email I have to pay $900 lump sum or $75 a month. I want to dispute it because the last time I talked to costumer service they said my account is closed and my balance is 0. What should I respond to the lvnv lawyer?

      if you've been sued, and the other side has a lawyer, you're in for a very bad time unless you have a lawyer in your corner.

      Under federal law, you may be able to sue them to stop whatever they're doing to you.
      You'll want to find a lawyer in your state who handles FDCPA claims.

      @@RWlawFL I spoke to resurgent that is the account administrator not even to lvnv and they say that they can’t even send an email sayin that if I pay they will take it off…. I don’t know how to go about it … in their page it says if it’s paid in full they will take it off but I don’t know if a receipt is enough plus that statement in their website.

    I just got served papers yesterday in Washington state from LVNV. I have 3 separate ones on my credit but only one showed up so far with papers. They did change the date from which I last paid in their document and the page they sent of my transactions but I’m pretty sure that it incorrect along with the amount they are claiming. These are Also all opened in Maryland I now live in Washington state now for 5 years not sure if that matters.

    I wish I had seen this video last week before I paid them a settlement! I’ve been watching your videos and searching “LVNV” and never came across this video! That’s horrible RUclips.
    Anyway I paid 269 of a 671 balance and they said it would be deleted from my credit report but I will need to call back in roughly 3 wks.
    I don’t have that time so I disputed it as “paid”… Experian updated the dispute in 3 days saying the balance is now 492 past due… not settled, not paid. So it seems like they may still pursue me for the residual balance?

    I have checked most of the forms on my lawsuit and my name has an incorrect middle initial . Can I use that as a defense?

      Is that because the debt belongs to someone else? Or is it your debt and someone messed up your middle initial? If it's someone else's debt, that's a defense. If it's your debt, probably not.

      That’s why it’s such a good idea to have a lawyer if you were ever taken to court.
      Don’t agree to anything, unless you completely understand all of the ramifications of it.
      If they make you an offer, you can always take it to a lawyer first and decide later, if you want to agree to it.

      Every state is going to be different. I don't recommend you do a trial by zoom unless you have a lot of courtroom experience.

    LVNV is Suing me for 42,000! Their "Bill of Sale" shows 3 other companies but not the Creditor who ownes the debt on my credit report? I responded to their suit using a course i bought, but I dont know if it will work. I need to get this dismissed! Can yall help?

    I just recently looked at my credit report and saw LVNV I had not idea of a collection I Was able to dispute it on my trans union and they took it off as far as the other two credit bureaus it does not come off. Once I disputed it I got a text from a halsted financial (idk if it’s the same company) I’ve called to get more information but they give me nothing

    I got caught in the trap before I became aware of my rights and options. Is there a way out of paying these people? In a several months, it will be moot b/c I'm going to retire and they won't be able to get my retirement. But I'd sure like to get free of their financial death grip before then.

    I've just recently gotten a letter from a defense attorney from Chicago Consumer Law Center P.C. stating that LVNV FUNDING LLC is suing me for an unpaid debt, the original creditor was Credit One Bank and I tried to get in contact with them but they were unreachable also I signed up to a protection that just in case I couldn't pay they would dismiss it without charge but here I am with an open balance of 1043 only when I originally balance was 600 what should I do?

    What if LVNV hired a lawyer and the judge gave them the right to publish my name on the court view website as proof of being served. Then by the time I found out they filed a default of judgment and the judge granted it. Can I still file an answer or complaint??

      If a default judgment has been granted you'd better act quickly. A lawyer in your state can help you figure out how to respond.
      In Florida, the entry of a default or default judgment cuts off your right to defend. Many other states have the same rule.

      If you've been sued, talk to a lawyer ASAP about your case. They should be able to give you an exact cost that's far cheaper than losing your case.

      If so, you’re still saving money either way.

    Hi Michael, I'm not in the State of FL, but I've been getting letters and emails from LVNV for a credit card debt for a while. The last email I received from them was about 2 weeks ago, and they stated my account has moved onto a pre-legal track. Now, I've received a letter from an attorney debt collection office that's not in my State last week. They're giving me until April 1st to dispute all or part of the debt in writing or a phone call. If I dispute, they'll stop collection until they send info that shows it's my debt, but if I don't dispute, they'll consider it my debt. Do you have advice on how I should handle this? Would an option be to try to settle for less than the amount? I'm not sure what to do. Thanks for any advice.

      Under federal law-applicable all across the US-you have a right to dispute the debt. Usually, we would recommend you do just that.

    On my credit report it says it has been disputed and verified under the FCRA and it is a valid debt ( I requested validation) . It went to a lawyer and I got a letter that it has but that's all that's happened so far? It's been over a year since that letter.

      If your appendix ruptures, you see a doctor.

    LVNV or RESURGENT Capital shows that they will remove collections within 30 days of paying the debt. This is clear on their website. Is this a lie or just a trick tactic. Do I have a case if they don’t remove after payment since it’s clearly stated on their site.

    I've begun getting e-mails and a dunning letter from LVNV stating my account has been purchased from Navy Federal in the amount of ~$17k
    I'm convinced either my ex or someone made the majority of the purchases fraudulently but since the account was charged off 4 years ago and now sold I don't have access to what those charges are.

    Hello I'm being sued by LVNV LLC. I live in NYC. I've been to court with them on Jan. 30. Their lawyer spoke to me & asked me do I receive SSDI because I mentioned that on the ANSWER IN PERSON form. I also put down a GENERIAL DENIAL which may have been a mistake. They keep sending me these interrogation forms to answer which I didn't. Now they're compelling me to come to court on June 12 because I didn't answer those forms. I responded to the judge to ask for the case to be dismissed because I'm on disability & my income is exempt in debt collection. I consulted the free legal services here in NYC & was told they don't help people who are judgement proof so they sent me some information by email. I have to return to court on June 12 because they are compelling me & for a pretrial on July 10. I want this case dismissed. Can you offer some advice. Thank you.

      If I'm sending them mail, I just use the PO Box on the last communication I see from them.
      If I want to serve them with a summon or a subpoena, I send it to the registered agent listed in the corporate records of the state where we're suing.
      There's no other addresses I ever need.

I find that to be weird because they're not even sure if it's me as I havent responded to any of the texts/emails.       Resurgent is a subsidiary of LVNV.
      You can dispute any account on your credit report that is in accurate, incomplete, or obsolete. The credit bureaus have a duty to investigate and either remove or correct any errors.

      When you say "removed" I assume you're talking about your credit report.
      10-year-old debt should come off automatically. If it doesn't, dispute it with the CRA.

    Got served a summons at night with a guest here by a cop. I'm showing up in court and can try to negotiate when I get there. Would love any advice .. offer a small monthly payment. Or a reduced settlement amount because they're adding so much to the original debt? The one attorney I spoke to said to call the courts to confirm if there is actually a court date on the docket. The papers I was served by the (? Probably fake) Cop did not have a Case# or anything. It's all scare tactics. I will offer a payoff amount at 30 percent of the original debt. That's what the attorney told me to do.

      It sounds like they sued you back in 2013 and won. While it may be too late to stop this process, you should absolutely speak to a lawyer in Illinois who handles debt collection lawsuits.

      Appellate rights are different in every state. Most places have strict deadlines.
      Depending on the state you’re in, you may not be able to successfully appeal unless you had a court reporter present. (For example, that’s usually the case here in Florida.)

      @@RWlawFL the judge said I could appeal within 30 days. The witness couldn’t prove anything and I poked holes in all his evidence and he was stumbling on all his words. The judge cuts him off and then puts his judgement against me. And I don’t know why.

      This is why it's so dangerous for non-lawyers to go to court. Something went wrong, and you don't have the training to figure out what happened, or how to fix it.

They didn’t provide purchase agreement, didn’t verify with the original creditor that it was my debt, didn’t have any training with the original creditors, I asked about 6 questions and when I asked why no purchase agreement was submitted he started yelling and stuttering and saying it doesn’t make a difference and the judge interrupted him asked me if I had anything else I wasn’t to asked and I just closed out my statement with the fact that the evidence is hearsay and the witness has no knowledge or proof that I owe the debt or owe them. He still ruled in LVNV favor.
