    The fact the defendant kept mentioning being under paid in a previous year, makes me think he already had a chip on his shoulder. I feel bad he lost his toe (Diabetics keep up with your meds and check-ups) however these grassroots organizations work within grant budgets generally, they have to keep on top of monies going in and out.

      A lot of defendants do perjure themselves in this courtroom. Judge Milian asks specific questions to see if they will tell the truth or lie because she knows the answer already from their written testimony. She typically does not make a huge deal out of it, just that their testimony has changed. What I think set her off is the defendant said "right" to agree with her right after she pointed out the perjury. He did it earlier too and she said "that is not something that works for you, I am saying it is so outlandish to be made up so it must have a ring of truth to it, which does not look good for you."

      I believe it's 1,500 for all 3 weekends. Which is 13 hours (Saturday 12-7 & 12-6 on Sunday) times 3 weekends which is 39 hours.

    It doesn't matter what the reason was for the defendant not attending an engagement that he was contracted to do, he must return the money that was paid to him for the sole purpose of performing at the event that he missed. Even if this defendant had died, Lord forbids, the plaintiff would still be entitled to a repayment from his estate for the broken contract.

      I’m so confused what made him think he could keep that money? The first excuse was a medical emergency, but that means he wasn’t there, so he shouldn’t get paid. The second excuse was he determined it was raining and just not show up, yet wants to get paid? What in the world???

    Gangrene can be so deadly. my grandpa had it in his big toe, they amputated but it was too late and he ended up having to have his lower leg amputated.
    he never got out of the hospital after that 🥺

    It sounds to me like it was the DJ that breached their contract. I can understand that he's a diabetic and had gangrene on the first weekend that he was scheduled to play for them and he had to have emergency surgery and amputate his toe. That is a justifiable excuse. But he COULD HAVE asked the nurse to use their landline phone (since he claims his cell phone wasn't working) and CALLED THE CLIENT and explained to them what was happening and not left them in the lurch. The second weekend, it was DRIZZLING and he DOES NOT communicate with his client (who he has already stood up the previous weekend) until AFTER the weekend had already passed. He ASSUMED that because it was raining, they would not be holding the art show and he waited for THEM to call. That is NOT a justifiable excuse, nor is it professional. I think he thought that because they weren't going to actually PAY him until September, he didn't want to do it and used this as an excuse.

      There are no "unwritten rules" in contracts. The point of a contract is to clearly define the rules and promises made by two or more parties who are engaged in a common transaction. If something is not specified in writing in the contract, it's not legally enforceable.

You can't go into court with a signed contract that covers point a and b and then argue that, oh, by the way, I have an unwritten agreement with the other person that covers points c and d. What if the other person doesn't agree? If I had a contract with you, I certainly wouldn't permit you to renege on an agreement because you had a medical emergency. Without a written clause permitting that, what is your recourse?
      I don't need some toeless dummy who obviously doesn't know the first thing about contracts to shake his head at me. Especially when he doesn't appear capable of proper capitalization or punctuation.

    I had extensive foot surgery in 1989 (4 bunions total & both feet also had neuromas but no toe amputated) and I was in a wheelchair for 6 weeks. A toe removed??
    He'd be in no shape to perform the following week!
