She typically does not make a huge deal out of it, just that their testimony has changed. What I think set her off is the defendant said "right" to agree with her right after she pointed out the perjury. He did it earlier too and she said "that is not something that works for you, I am saying it is so outlandish to be made up so it must have a ring of truth to it, which does not look good for you."

It doesn't matter what the reason was for the defendant not attending an engagement that he was contracted to do, he must return the money that was paid to him for the sole purpose of performing at the event that he missed. Even if this defendant had died, Lord forbids, the plaintiff would still be entitled to a repayment from his estate for the broken contract.

That is a justifiable excuse. But he COULD HAVE asked the nurse to use their landline phone (since he claims his cell phone wasn't working) and CALLED THE CLIENT and explained to them what was happening and not left them in the lurch. The second weekend, it was DRIZZLING and he DOES NOT communicate with his client (who he has already stood up the previous weekend) until AFTER the weekend had already passed. He ASSUMED that because it was raining, they would not be holding the art show and he waited for THEM to call. That is NOT a justifiable excuse, nor is it professional. I think he thought that because they weren't going to actually PAY him until September, he didn't want to do it and used this as an excuse.

There are no "unwritten rules" in contracts. The point of a contract is to clearly define the rules and promises made by two or more parties who are engaged in a common transaction. If something is not specified in writing in the contract, it's not legally enforceable.
