I'll give you a typical lawyer answer... it depends. Depends on who the Examining Attorney is at the USPTO that looks over your application. Depends on whether there is overlap in trade channels, etc. per the DuPont case. Depends how aggressive other party is in enforcing their rights.

Yes. You can't use the (R) symbol, but you can use a TM after you are satisfied that your mark is clear for use and registration
