Taking a photograph does not deprive a person of something, or impose something on a person; it's simply capturing the photons which are bouncing off them.
I thought Ian ws lovely. Calm and struck the right balance. Sensible chat. Not easy to satisfy the privacy the company wants which is often unrealistic. But he did his company credit. I hope his bosses appreciate it. .The other lads were hilarious. I'm surprised Paul Christopher didn't make it out to New Zealand the guys here would appreciate that northern humour. Less said about Mr Paranoia the better.
Really enjoyed the chat between you and the first set of Cazoo guys....loving all the different the Northern accents. The second guy sounded just like Robbie Coltrane, to my ears anyway. You guys are sweet!
"You've assaulted me" seems to be the go to claim these days when they're trying to stop someone doing something they don't like. I'd love to see their face when they call the police, make the claim, and the copper basically calls them a numpty!
In this case though, the bloke actually thinks that's the Law. I don't think he is smart enough to be using it as a reason to stop the filming in that respect. 😆
You don't have to touch him for assault but you have to at least threaten to do so. Common assault (section 39, Criminal Justice Act 1988) A person is guilty of common assault if they either inflict violence on another person - however slight this might be - or make that person think they are about to be attacked. They do not have to be physically violent - for example, threatening words or a raised fist could lead the victim to believe they are going to be attacked - and that is enough for the crime to have been committed. Other acts like spitting at someone may also classed as common assault.
0:15 Assault doesn't require touching or any physical contact. It's the threat of physical contact. Actual physical contact is battery. But he is totally and utterly wrong to say that filming him is assault - well not unless you were wielding the camera around as a weapon, but then the video would be extremely blurry. And without his implied consent? He gives implied consent by talking to you knowing that you are filming.
What a mixture in one place. Nearly all good blokes having a bit of a laugh to brighten up their day. And two NOB HEADS, one being assaulted by a camera. Good audit PJ
The only thing you assaulted was his ego. Your camera video went right through his vest and into his chest, up to his brain and reached out and grabbed part of his ego.
Hi-vizitis is a terrible affliction it can be contagious. It is usually occurs in both men and women with limited intelligence. It causes delusions of grandeur and an unshakeable belief that they have some authority and power over the public. Sadly the condition is terminal.
Rofl. That is a level of stupid I have not seen before. You could see the bruises forming and the blood squirting out as you filmed him. Much longer and it would have been a murder charge you faced.
He's wrong on the photography. It's not assault. However he's right on the question of touching making an assault. It's not part of the test. Illegal arrest by police officers, with the threat of handcuffs etc, is assault.
An assault is any act (and not mere omission to act) by which a person intentionally or recklessly causes another to suffer or apprehend immediate unlawful violence. So an illegal threat of arrest, because the arrest would involve or apprehend violence, is an assault
When he is feeling masochistic, he walks around his local shopping centre and gets assaulted by all the CCTV cameras. I was assaulted by a dash camera this morning. At one time you had to pay good money to have someone assault you.
When cameras first came out some people objected to being photographed because the picture would capture their soul which I guess is soul assault. Great argument; has me convinced.
Oh dear. Good luck trying to prove that one in court, mate. That's assuming the police can stop laughing long enough to perform an arrest and charge. 🤣 What he doesn't realise is there is no, 'implied consent', in a public place, if the subject matter of recording isn't primarily focused on them. If they so choose to put themselves into the frame of the camera view, then that's their choice. It's not as though the camera is being pushed into his face, with him trying to get away from it. This idea that it's, 'assault', is nonsensical. I was more interested in the young man doing tricks on the scooter. I assume that's part of his job description(!) The chats you had showed how open some people can be and the atmosphere overall is very amiable. But then, there's always one who has to spoil it. The rubbish he comes out with as a way of trying to stop you doing what you're doing is laughable. A typical case of minding everyone else's business but their own. There's no alternative but to laugh at these clowns. They think they can throw their weight around and exert authority where non exists. A true legend in his own lunchtime, that one.

They accept all vehicles and sell some off and scrap the others and sell them for parts and many defective vehicles get sold abroad where they are scrapped as the defective components are also sold to the reconditioners. There is no such thing as implied consent and why do these people assume they have the right to ask questions of the public and assume they have to be answered and you can see the ego's oozing from under their Hi Viz.
I used to go to B.C.A. Measham every week, looking for car and spent a lot of time looking for a decent smallish RV also. I would not buy a car from an online auction now, too much frigging hassle
