This is a normal practice for most companies and those whose run them whether guilty or innocent. Accusations stick to companies. Doesn't matter if the accusations are proven false. With very public cases like this, there is potential for keyboard warriors to harass and drive down a company's rep with spiteful negative reviews. Anonymity isn't the defendant's problem. In this instance, she caused a lot of the annoyance herself by lying to him regarding returning his deposit. Had she just returned what she promised, he would’ve been out of her life. Sounds like she felt some kind of way because he changed his mind about buying the car and thought she would get her little “lick back” by giving him the runaround.

I'm glad he got his deposit back from this shady lady. If possible, always take someone who is familiar with cars or the car buying process with you when shopping for cars. It can be very overwhelming and you can easily get taken advantage of by salesmen when they see you don't know any better.

Once they get you there the car you wanted was conveniently _"sold this weekend, but I have something else for you on the lot."_ Yeah and the alternate cars are always more expensive. That car was probably never there to begin and if it was a courtesy call to him would have been nice before he came there.

Deposit is generally non-refundable. And he knew that employment had to be verified. She is a businessperson and knows about the non-refundable deposits, part of the course and the plaintiff had remorse.
I had a dealership sell the suv I put a deposit down on. They told me they were buffing out a dent and then it would be ready then I called them a week later they told me they sold my car and refused to give me my deposit I threatened to call a lawyer and I got a call that day with I can go pick up my check for my deposit dealer's do this all the time take peoples money and that money is for the intended car not for another car or one u chose to give someone.
I guarantee that initial SUV hadn't been on the lot in ages. But, I also feel that the Plaintiff was a bit flaky and had buyer's remorse after putting down the deposit. The Defendant's problem is that she agreed to refund the deposit in the first place. Had she not, the Plaintiff would have been out of luck.

If plaintiff had a credit union, which he stated. He should have gone through them for financing not the dealer. Lesson learned.

It's always hilarious when plaintiffs ask for "pain and suffering" for what is obviously a contracts case. Even if the plaintiff has a good case it makes me less sympathetic, because it just smacks of grifting.

The problem is people don't actually know what this means or what is covered under it. It's very much an "armchair lawyer" kind of term.

Why is Harvey always saying the default is that the deposit IS refundable and Judge Milan always saying the deposit IS NOT refundable. My understanding is that the default position is that the deposit is not refundable.

So that’s two cases in a row that were based on a deposit and said deposit was going to be partially refunded. In one case judge ruled for defendant and the other for plaintiff. Way to go with consistency there Judge Milan ?

By law contract law says there is X amount of time to cancel a contract
Deposit is generally non-refundable. And he knew that employment had to be verified. She is a businessperson and knows about the non-refundable deposits, part of the course and the plaintiff had remorse.

I had a dealership sell the suv I put a deposit down on. They told me they were buffing out a dent and then it would be ready then I called them a week later they told me they sold my car and refused to give me my deposit I threatened to call a lawyer and I got a call that day with I can go pick up my check for my deposit dealer's do this all the time take peoples money and that money is for the intended car not for another car or one u chose to give someone.
She is shady as a tree and he isn't smart enough to make up a story like this .

I guarantee that initial SUV hadn't been on the lot in ages. But, I also feel that the Plaintiff was a bit flaky and had buyer's remorse after putting down the deposit. The Defendant's problem is that she agreed to refund the deposit in the first place. Had she not, the Plaintiff would have been out of luck.
Thats why I use a credit card for car deposits.
Why the hell would they be asking for a check before the guy even “saw” the car????? Yeah, that was just some bullshit scam.. personally, that would have been enough for me; no way in hell would I even consider doing business with someone that started out shady as hell..
Plus, I would take one look at that woman and RUN in the other direction; she “looks” like she’s about to con someone…
