      Ugh! I swear this judge hears ONLY what she wants to!! The Defendant has told her TWICE NOW she did agree to return a partial refund of his deposit which JM HERSELF SAID JUST A MINUTE BEFORE she starts hounding the Defendant why hasn’t she returned Plaintiffs $ back!! MAKE-UP YOUR MIND JM!!

      I don't understand why the Judge didn't press the fact, that she said she called him and said he was approved and he said she never called him to say he was approved. The Judge just keeps laughing everything off, not sure why. It was annoying.

Unless there was proof the plaintiff received that call it really is he/she said, unlike the texts where the defendant told the plaintiff she "tried" refunding him.

      This is a normal practice for most companies and those whose run them whether guilty or innocent. Accusations stick to companies. Doesn't matter if the accusations are proven false. With very public cases like this, there is potential for keyboard warriors to harass and drive down a company's rep with spiteful negative reviews. Anonymity isn't the defendant's problem. Her behavior is.

    I wouldn't deal with them as soon as they told me the car they offered me was randomly sold. Especially if it takes awhile to get verified. They knew the original car was already being sold.

      That's not what happened. The car he originally saw in the magazine that he went to look at was sold prior to his arrival. He test drove and put deposit on a different vehicle

      Right, I totally think that this car dealership for "credit challenged" takes full advantage of people with the bait and switch and then assumes they will buy something else at their used car dealership. I learned a valuable lesson, I will never sign anything without a document stating I will not get my money back if the deal falls through. This lady is a person that preys on low income people with credit issues, that makes me mad in itself, credit issues can happen for many reasons , not just being late on a payment. I can relate.

      The bait-and-switch car was probably gone minutes after they took the pictures for the ad months before. If they ever even owned the vehicle. Would not be surprised to learn they snuck onto another lot somewhere and took a picture of a random nice SUV.
      The whole reason people talk about bad and shady car dealers summed in one bad and shady episode. They should say her name and the name of the "dealership" every time they addressed her!!!!!

      ... what are you talking about exactly? She told him how long it takes to get verified and explained the process to him. He was then verified within a day and she immediately called him and told him. What "dreams" is she selling? If anyone got their hopes up here then it's because they are unreasonable and don't pay attention when people explain things. It would not be her fault since she explains the process every time and then calls the customer as soon as they are verified. You sound like a Karen. You would just yell at the employee if the process took 2 days even after they tell you it could take up to a week and then if you aren't approved you would insist it was somehow their fault. You're not being rational. If ppl want to "dream/get their hopes up" that's their own fault and she cannot stop that nor is she responsible for the feelings and actions of a grown adult.

    In this instance, she caused a lot of the annoyance herself by lying to him regarding returning his deposit. Had she just returned what she promised, he would’ve been out of her life. Sounds like she felt some kind of way because he changed his mind about buying the car and thought she would get her little “lick back” by giving him the runaround.

    I'm glad he got his deposit back from this shady lady. If possible, always take someone who is familiar with cars or the car buying process with you when shopping for cars. It can be very overwhelming and you can easily get taken advantage of by salesmen when they see you don't know any better.

      She wasn't in the wrong however untill she told him shed give him the deposit back and then consistently lying about it being done. Without that the plaintiff would have lost. The actual car sale was done on the up and up, it was his choice to buy that specific car.

      Right. That isn’t what happened. The car that got him in the dealer got sold. They didn’t sell it from under him, it was sold before he ever got in the store. He made a deposit and then got cold feet about the car which is fine but he isn’t owed the full deposit. The fact he wants “pain and suffering” shows he probably was a pain to deal with…
      And it was his first car by himself!? He had no idea what he was doing.

    When the plaintiff made first contact with the defendant inquiring about the SUV I guarantee you that the SUV was already gone & the defendant just strung this guy along to get him to her dealership where she would try to sell him something totally different. The defendant clearly had some physical disfigurements & I wouldn't be surprised if they didn't arise from her trying to deceive a previous buyer with her same game & got knocked out.

    SHADY dealership. i was in the same situation where i went to look at a car 2hrs away and they never told me they sold it when i spoke to them before i left my home. get there and they tell me to see if i want anything on the lot. i was beyond pissed and did not trust them at that point. told them to kick rocks. these little dealerships are scams

    Stealerships do that all the time, advertise a specific car with very attractive numbers. Once they get you there the car you wanted was conveniently _"sold this weekend, but I have something else for you on the lot."_ Yeah and the alternate cars are always more expensive. That car was probably never there to begin and if it was a courtesy call to him would have been nice before he came there.

    I’ve heard Judge Millian multiple times say that non-refundable is the default if refundable isn’t written for a deposit. Harvey said the opposite at the end of this video.

    This case COMPLETELY contradicts what the judge said in the last case I watched. In the last case she said if the contract doesn't say the deposit is non-refundable, its assumed to be refundable... but in this case its different?... She just be pulling "laws" out of her a** with all that fast talking. She could never be a real judge

    So that’s two cases in a row that were based on a deposit and said deposit was going to be partially refunded. In one case judge ruled for defendant and the other for plaintiff. Way to go with consistency there Judge Milan ?

    Every dealership ive been to if i don't agree to the bank loan terms i have been able to get my deposit back for both big and little car dealerships

    By law contract law says there is X amount of time to cancel a contract

    Deposit is generally non-refundable. And he knew that employment had to be verified. She is a businessperson and knows about the non-refundable deposits, part of the course and the plaintiff had remorse.

    I had a dealership sell the suv I put a deposit down on. They told me they were buffing out a dent and then it would be ready then I called them a week later they told me they sold my car and refused to give me my deposit I threatened to call a lawyer and I got a call that day with I can go pick up my check for my deposit dealer's do this all the time take peoples money and that money is for the intended car not for another car or one u chose to give someone.

    I guarantee that initial SUV hadn't been on the lot in ages. But, I also feel that the Plaintiff was a bit flaky and had buyer's remorse after putting down the deposit. The Defendant's problem is that she agreed to refund the deposit in the first place. Had she not, the Plaintiff would have been out of luck.

    Why the hell would they be asking for a check before the guy even “saw” the car????? Yeah, that was just some bullshit scam.. personally, that would have been enough for me; no way in hell would I even consider doing business with someone that started out shady as hell..
    Plus, I would take one look at that woman and RUN in the other direction; she “looks” like she’s about to con someone…
