  • The trend of Malaysian politicians evading corruption charges has raised concerns about transparency and accountability within the country's legal and judicial systems. Several prominent cases involving senior politicians accused of corruption have followed a similar pattern, where they secure discharges and acquittals. Here are some notable examples:
    1. Dato Seri Bung Moktar Radin:
    Bung Moktar Radin, a former MP from Sabah, was charged with accepting bribes related to FELCRA, a rural development statutory body.
    He and his wife faced multiple charges, but on September 7, 2023, they were discharged and acquitted from all charges.
    2. Zahid's Two Prosecutions and Discharge:
    Zahid Hamidi, a former Deputy Prime Minister and Home Affairs Minister, faced charges related to a charity called 'Yayasan Akal Budi' and the 'Foreign Visa case.'
    The first set of charges was dropped by the prosecution on September 4, with the court discharging Zahid but not acquitting him.
    In the second case, Zahid was acquitted by the trial judge on September 23, 2022, but the acquittal is under appeal.
    3. Tan Sri Muhyiddin Yassin:
    Muhyiddin, a former Prime Minister, faced charges of abuse of power and money laundering.
    On August 15, 2023, he was acquitted, with the court ruling that the charges were defective and lacked details on how the offenses were committed.
    4. Tan Sri Mohd Isa Abdul Samad:
    Isa, a former chief minister and chairman of FELDA, faced charges of corruption and criminal breach of trust.
    He was acquitted of the criminal breach of trust charge in June 2020, partly due to the absence of set procedures for approving investments above RM100 million. He is appealing his corruption conviction.
    5. Tan Sri Musa Aman:
    Musa, a former Chief Minister of Sabah, faced corruption and money laundering charges.
    The prosecution withdrew all charges against him in June 2020, citing a lack of documents from Hong Kong banks and unavailable witnesses.
    6. Datuk Seri Tengku Adnan Mansor:
    Tengku Adnan, a former Minister of Federal Territories, faced bribery charges.
    He was initially ordered to enter his defense but was later acquitted by the Court of Appeal in July 2021 due to a new development in the case.
    7. Datuk Seri Ahmad Maslan:
    Ahmad Maslan, a deputy Finance Minister, faced charges related to not declaring received funds and giving false statements.
    He was acquitted in September 2021 after paying a compound fee.
    8. Datuk Seri Abdul Azeez Abdul Rahim:
    Azeez, a UMNO MP, faced bribery and money laundering charges.
    Some money laundering charges were struck out, and he was granted a discharge not amounting to an acquittal in September 2022.
    9. Lim Guan Eng:
    Lim Guan Eng, a former Penang Chief Minister and Finance Minister, faced corruption charges.
    He was acquitted in September 2018 regarding a property purchase case but faced ongoing charges related to a Penang undersea tunnel project.
    These cases highlight a concerning trend where charges against prominent politicians are dropped or result in acquittals. The reasons behind these outcomes often lack clarity, with explanations such as defective charges and missing documents. This trend raises questions about the transparency and accountability of the legal and judicial systems in Malaysia. Citizens and observers call for greater transparency from the Public Prosecutor, who also serves as the Attorney General, and the need for detailed explanations regarding dropped or defective charges.

    in Malaysia there are 2 sets of justice One set is to serve the elites or you can call them the "untouchables" The other set are for the ordinary citizens The latter which is very quick to punish wrongdoers with the slightest of proof The punishment meted out are often very harsh with little or no room for compassion This is the true picture of justice On the contrary believe justice does not exist in Malaysia

    Corruption is an ingrained culture in our society. Some get caught but that's their luck. There's no end to it.

      This is true. But the questions are two: what system can we use that will make how our leaders truthful, accountable and responsible? Second, how can our leaders be, as individuals, deeply honourable? There are no perfect answers. It does not mean we should stop demanding that our leaders live up to an objective code of honour and responsibility. In Japan, leaders resign as a matter of course. And they bow and apologize for the errors of their cabinet. So also Korea. Have you ever heard a single leader in Malaysia apologizing? That tells its own sad story.

    Very well researched and presented GK. We will not get anywhere by asking the culprits to explain because honesty is not known to them. BUT we can get somewhere if on recognition of the dishonest part played by those entrusted with the law we can drag these so called acquitted and discharged persons right back to court. A law has to be set in place with retrospective effect in order to defeat and to stop this blatant dishonesty from spreading like a cancer. INASMUCH as I enjoyed your presentation I also felt nauseated. Thanks.

    In Malaysia, the practice and reality of corruptions have never been a serious offence. Corruption is already in the blood of all of their politicians. Every government that came into power would only provide lip service and empty promises to eradicate corruptions.

      So don't blame others when their own leaders are extremely corrupted and the citizens keep asking why , why and why the exchange rate to Singapore is such a big gap. Best of all some citizens can make RUclips videos recommending how to solve the corruption problem. The question is that in Malaysia, no one so far can really stop the corruption as effectively as they recommended.
      Most of the cases are acquitted. How can the economy be good and strong? It can be effective only in the Dreamland. That's why many leave the country in drove. Just look at Mahathir himself. Anyone can take him on? Not even Anwar who said that he will weed out all this corruption. Like one of the guys said, they only give lips service. That's all.
      In my view, Malaysia is really tah boleh. What happens to Mahathir's 2020 dream of developed status. It's all nuts. Just look at his children, all are billionaire!!!!!

      Tun Mahadir ia no longer the PRIME MINISTER since 2003, yet his children are still millioners.

      If they depend totally on their father, by now all of them should have gone bankruptcy because their fayher is no longer around to back them up.
      On February 2023 Mirzan Mahadir Betamek bagged rm123.5 million contract to supply electronic parts for Produa's new model. He is also the CEO to Crescent Capital Sdn bhd, an investment & financial advisory firm. He is a none executive director to Petron Corporation, an oil refiniry marketing, listed in Philipines stock exchange. And he serves as none executive chairman to a jewellary company, Aurora Italia International bhd. He is also an executive chairman to SBI Offshore Ltd, a company in Singapore involving in offshore drilling.
      His younger brother, Mokhzani is a well know corporate figure of his private company KENCANA Capital Sdn Bhd, investing in IT, property and other businesses.

    It is strange that the prosecution, paid by the tax payers, declined to pursue the charges...what are the justifications for the prosecution to decline to pursue the charges. Then , who will take the prosecutors to court for declining to pursue the charges?..or even rescinding on their responsibility.

    No matter how hard a person studied to become a lawyer and later judge successfuly his weakness finally rests in power of authority of government who can fill his account with so much more than he can swallow. So qualified personal is one is one thing but when he closes his eyes to prevent he didn't notice any criminal wrongs.. He makes sure no valid proofs are popping up. Justice has false eyes too

    Always a pleasure to listen to your analysis of these cases .
    On the withdrawal of some high profile cases by the AG , I wonder why he is granted unfettered powers to institute , prosecute , or withdraw any or all charges as and when he likes at any stage of the trial ,and he has done this on many cases as you highlighted
    now and in the past . Amazingly he does not have to answer to anyone why .
    I feel it is high time that this piwer is taken away from him . If he decides to withdraw charges he must justify to the presiding Judge /Judges
    and the Judge must have the sole power to accede or reject his request.
    Just imagine the amount of time and effort put in by all parties , for days and months and often years , then suddenly the AG waves a magic wand and everything comes crashing down
    making a mockery of the system of justice in this country .

    Because there is a lot of corruption going on everywhere. Most of the convicts have got a lot stolen money with them and they behave like a King. They are treated like a King and they don't respect the prison authority because of too much of corruption involved.

    The investigation bodies conduct shoddy jobs, while the prosecutors provides loopholes while the judges accept unreasonable evidences, thus the accused go free. In short, all the three bodies must become brave, unbiased and professional. Only then the culprit will be sentenced. Blaming any one separately is not fair.

      The prosecution team needs to be beefed up to be more successful on prosecution cases. If necessary get outside lawyers to handle prosecution for high profile cases.

    Whats the use of complaining and showing their (the defendants, namely Zahid and Bung with wife) cases, when the ruling party supported the decision made by the prosecuters. Its an open secret where the prosecuters have their hands tied and mouth shut. The allegations whether truth or false have been the bloodline of the ministers. Whoever wants to be rich fast, join the politics. Easily, the riches are from the lines of politicians families. Its useless to go upfront with evidences when in the end will be wasting of the rakyats' time and money. Malaysia has doomed and brought down by these politicians. 😢

    Sir, maybe there is a quality difference in the Documentation in court is prepared between the CLP (Defence/Private Firm) & Non-CLP (AGC/Public Prosecutors) lawyers giving rise on many “Technical” issues in document preparations. Similarly on how Govt contracts/Agreements are one sided to benefit Contractors, Concessionaires Vendors, etc. Just my opinion &’observations.
