      Police want to figure out what's "going on" - rather than if a CRIME has happened.
      Thinking isn't their job, because they are lousy at it. Enforcing the law IS their job.

      The 4th Amendment has no provision for: Detention, Officer Safety, Failure to ID, Reasonable Articulable Suspicion, Exigent Circumstances, Pat-down, Pain Compliance, Taser, Deadly Force, Kidnapping, No Knock Warrant, Dogs, Wrong Address, Policing, Investigation, Inspection, Inventory, Immunity, Traffic Stops, Human Trafficking, Fascism, Trespass, etc. The only practice condoned in the 4A is seizure pursuant to a warrant, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (The word "upon" means "probable cause" comes before a "warrant", not after the search.) The SCOTUS is a Private Corporation (see D&B).

      Police are committing FELONY TREASON (Human Trafficking) by asking for Slave Documentation called "ID" and in violation of 5A.       We want to believe that enforcing law, stopping or apprehending criminals is the function of policing. Not True. They perform their function or they are fired.

      Yup. It could be a very simple process. The agency provides an allowance for insurance that is equal to the rate that an officer with a clean record would get. Any time they fsck up and their rate goes up, the amount above and beyond their allowance is their responsibility. Eventually their insurance will cost more than their salary and they'll find a different job.

    This is why all cops must be required to have their own liability Insurance so that when they do something wrong, it is their insurance that pays the compensation and not the City/County Tax payers that have to pay for the Cops violations of Rights.

      Most places they are required to have a surety bond. It's pretty easy to file against them for misconduct. It's a system that most don't realize exists so it's very rarely used.

      He knew he shouldn't have anything showing on his computer that should be confidential, and that is what he freaked out about. I gotta say, this cop could have ruined his own career, but he tiptoed the line and got himself out of trouble by contacting his supervisor and getting proper instruction to stop being a tyrant.

      Its due to the way cops are trained...They are trained to do only two things...how to arrest citizen and how to shoot citizens.... They are not trained on the law or citizens' rights...they are told that laws and rights are just things that get in the way of doing the two things they are trained on.

      It's not just plain view doctrine. People who handle confidential information have a legal duty to safeguard said information. Leaving it in plain view of the public in a public place is not safeguarding confidential information, regardless of whether or not someone is taking photos, and the burden is not upon the public to not look at confidential information that was left in view. But police are ALWAYS looking for someone else to blame. I just saw a video yesterday where a police officer pulled over a civilian for speeding and he asked how she knew he was speeding. She replied that she was doing something like 43 in a 35 and he was doing the same. But he's the one who gets accused of breaking the law when she literally confessed to knowingly breaking the law?

    Cops do NOT have a right to frisk anyone just because it is a terry stop. To frisk someone during a terry stop requires the cop to have a reasonable suspicion that the person is armed AND is presently dangerous.

      The information that attorneys have put up on YT indicates courts don't often side with the citizen who is abused by the police when they claim their actions occurred due to concerns over officer safety. It was wise for the auditor in this video to act as he did to avoid making Officer Go-hands-on escalate more than he already had.
      I don't think the whole Terry stop concept is Constitutionally defensible, but I am going more on common sense than a knowledge of legal precedent. The Hampton Law YT channel had a short video about how policing was done before that hideous Terry v. Ohio decision. It was saddening to see how our freedom to be left alone diminished because of that ruling.

    If Hawkinson did not want the computer screen to be seen by a member of the public, he could either close it down when he exits the vehicle, or, once the auditor was on scene, open the door and close it down in front of the auditor and then walk away without saying anything. Unfortunately, laziness, ignorance and ego prevented him doing any of those actions. He should be made to clean the car too!

      Some of them do, but supervisors often hire out of "necessity" bc of staffing shortages rather than merit or experience. These stopgap hires don't actually care about the law or putting the city/county on the hook for constitutional violations, especially since most of the people they abuse don't pursue legal actions.

      The problem is that there is no real consequence for these violations. Maybe what we should do is work at the local level to enact laws that explicitly provide the consequences for depriving citizens of their rights. Municipalities would not be easily convinced to provide monetary damages to be paid out of the tax coffers, and I don't think they would be willing to make the officers pay fines to their victims. Perhaps having officers serve suspension without pay would be acceptable to town councils. Is there a municipality that is very good about protecting the rights of citizens, even those who break laws, and provide a means of punishment for officers that violate them? (I know. Stupid question. Everybody knows it's the town with the unicorn ranch where the Tooth Fairy takes her riding lessons and the Leprechaun's pot of gold is stashed behind the stables and guarded by Bigfoot.)

    There's no such thing as a good enforcer. The whole "good/bad cop" question can be disposed of much more decisively. We need not enumerate what proportion of cops appears to be good or, listen to someone’s anecdote about his uncle Charlie, an allegedly good cop. We need only consider the following:
    1) Every cop has agreed as part of his job to enforce laws all of them.
    2)Many of the laws are manifestly unjust, and some are even cruel + wicked.
    3)Therefore, every cop has agreed to act as an enforcer of laws that are manifestly unjust, or even cruel + wicked.
    Thus, there are No Good Cops.

      It is because the departments teach it is a brotherhood and you must protect each other at all times. "at all times" forces any good cops to align and protect the bad cops, thus creating more bad cops. this is the definition of a systemic problem. An unwritten policy that is withheld and enforced by each other after hours should be illegal but since it is not, it creates an all bad cop scenario.

    False imprisonment carries a maximum penalty of 4.5 years prison so the officer should get 9 years. Cost if incarceration paid from police pension fund. The fact he was armed makes it an act of terrorism so two consecutive life sentences are in order.

    Although the three different branches of government were meant to be separate, they are not. The judicial department the courts very often work with and help cover up mistakes of law enforcement the executive branch. The judicial courts also fail when they uphold legislative laws that are unconstitutional.

    If I was the cop I would sit there and observe you until you broke a law, Simple observation is not in thier vocabulary but Its the first thing you do with any investigation, OBSERVE. Never expect a criminal to answer you with truth. If you observe no crime, why inject yourself into something that could potentially stop you from going home, Especially when you dont have a crime committed, Your trainers are sending you down a road you dont want to be in, unless you do, and your the one thats going to put yourself in a place uninvited for no reason, that could hurt...

    Being a sworn police officer is an on-going , never ending training module . Most departments cover updates in constitutional law EVERY day in briefing , so street cops , the ones on the front line that interact with the public , are well versed in order to protect the public , and to protect the department from unnecessary lawsuits . It appears that THIS agency has decided that the training at the academy level is all that's needed .
