    Alec Baldwins Lawyers strike back at prosecution in response to motion to dismiss indictment. They are claiming that the prosecution gave improper jury instructions and elicited improper testimony from witnesses and failed to provide Baldwin's witness and exhibits. We are now waiting for the judge to make a decision on the dismissal. If the dismissal is not granted, then the hearing will be some time in July 2024.

      It did rather start with the prosecution saying that he was arrogant which has nothing at all to do with whether he committed a crime or not. Arrogance is not against the law. That started things and kind of tainted everything the prosecution did after that. Made it seem personal rather than legal

      He's a defendant and his highly paid attorneys are doing their job. Of course he's fighting to keep his ass out of jail!
      That's what descendants do!
      Would YOU sit there like a passive dumbass schoolgirl getting a Girl Scout cookie for not rolling your eyes if you were the defendant?
      Hannah didn't pay for a good attorney and she got her money's worth. 18 months in penitentiary. And she rolled her eyes.

    I'm not surprised. Burying the prosecution with documents is a play. Alex's mouth is the reason this is being prosecuted. Sorry but he came out with all of that "I didn't pull the trigger and it's everyone's fault but mine" when he should have shut up and been humble. Sorry about your bad luck, but you get what you get when you pull a trigger while pointing a 🔫 at someone.

    The prosecution has seemed malicious to me since I watched the first time charges against Baldwin were announced. I heard the passion and the out of context emotional investment in her voice, it was so overt that I have been subsequently puzzled that more people had not been discussing it. I thought her to be very unprofessional. And that bogus coke story from the Craft services lady really showed the depths the prosecution is willing to sink to, imho.
    The actor had been passed an object he was told was a safe prop for the scene. The armourer was held accountable for that. In my opinion, it is a shame Seth and Sarah were not also held accountable for their involvement

      If somebody tells you jump off a cliff would you do it?
      Actors are continously told throughout their entire career to not point props, more specifically GUNS at anybody on set, regardless if the cameras are rolling or not.
      I think it's also very important to remember that the charges are less him pointing a gun he assumed was blank (after all Masse wasn't charged in death of Brandon Lee) but the conditions he allowed on the set as a producer.

      I believe the coke story to be true, but the charges can’t stick when the craft services lady helped her get rid of the stash. In that case I felt charges should never have been brought.

      @@annm9589 you believed that testimony!? I found her to be not at all credible. Neither the story itself nor her body language and demeanor seemed believable. It is highly unusual for criminal act accusations to be included by the prosecution without corroborating evidence. The judge even expressed disappointment with the prosecution doing that, commenting that it wasn't what she had expected; the judge had expected there was going to be evidence submitted to go along with that testimony. It should not have been included without it. The allegation was moot. It likely affected some members of the jury with prejudice when it should not have been brought into the proceedings at all. Personally, I think that the prosecution has been "playing dirty" and that was why she tricked the court into including that unsubstantiated story .

    I still can't get past 'gun safety 101' - a gun is to be checked by everyone who touches it to see if it's loaded. Alec handled it last and he didn't check it so ultimately he's at fault for Helena Hutchinson's death.

      The expert armourer for the prosecution literally testified that actors are not required to personally perform a safety check and such checks add nothing to safety. That destroys your entire argument. Your argument is invalid and can't be used as Bryan Carpenter the expert armourer testified to that effect.

      @@almac9203that armorer was correct that film industry standards don’t REQUIRE an actor to check their ammo. But there are several things the industry guidelines do require….including not aiming a weapon at a human being and not placing your finger on the trigger until your ready to fire. Baldwin broke those rules as well as several other required industry safety standards.
      But there’s one thing that’s of utmost importance in regards to all of the film industry safety rules. None of them overrule the law and there is nothing in the law that grants any exceptions for actors.
      We know the below facts for sure and they are more than enough to satisfy the criteria for negligent manslaughter.
      1. . Baldwin knew that his gun was a real firearm.
      2. Baldwin had no personal knowledge of how, or if, the gun was loaded
      3. Baldwin aimed the gun at Halyna
      4. Baldwin cocked the pistol.
      5. Baldwin was holding the gun when it fired and shot two people killing one of them.
      None of these facts are disputable and nothing other than these facts are relevant to the case against him.

      @@Mitch_Ryder Michael Massee pointed a gun at Brandon Lee and pulled the trigger and he didn't personally perform a safety check on the gun yet he wasn't even charged let alone convicted. If those facts are all you need for a conviction as you claimed then why was he never even charged let alone convicted? Baldwin won't be convicted. Yes he broke gun safety rules by his lack of muzzle discipline however that isn't an extraordinary departure from normal behaviour on a movie set. We know it isn't an extraordinary departure from normal behaviour because we saw numerous instances of other actors doing similar things on this movie set and numerous other movie sets and the armourer herself pointed the gun at her own face. What Baldwin did was ordinary negligence which is a civil liability not a criminal offence. Actors point guns at other actors all the time and they have only proved deadly only when the armourer has failed in their duties. It is the armourer that did something that constituted gross or criminal negligence because it was an extraordinary departure from normal behaviour and standards of armourers. Baldwin didn't do anything extraordinary whereas the armourer did. You can find thousands of actors that behave like Baldwin whereas you won't find other armourers that behave like Hannah and that is the crux of the issue.

      @@almac9203 if someone ‘breaks gun discipline’ and no one gets shot, they got lucky. And it probably means that the armorer and the first AD did their jobs correctly and the gun was safe. Thats exactly why there are redundant safety rules in place. And it proof that the film safety rules work when they are followed.
      You can’t charge someone for manslaughter if no one gets killed.
      The Brandon Lee incident is irrelevant to this case. We see crimes occur every day where a prosecutor for whatever reason decides not to charge it. That doesn’t create legal precedent or case law.
      Ordinary negligence involving a gun and a death is the very definition of negligent manslaughter in the law. Look it up.

      From watching previous videos, it seems that IF a team was doing that, it might be more about preventing the other side from having as much time to prepare a thorough case, not so much to “give in”.

    The fact is he fired the gun. He should have checked it. You never point a gun at someone unless you plan to use it. It was his hubris that pointed the gun in the first place. Should have a used a prop gun or nothing. He bears responsibility.

    If the Prosecution truly didn’t do their homework & Baldwin isn’t attached to those projects & that was any part of the reasoning for bringing this prosecution or pulling a prior deal well, Yah…in you nose with a rubber hose.       The plea deal was primarily pulled, because the defense broke confidentiality. They talked to the press about it. That is what the prosecution stated in their reply. They did their homework. This filing is just utter nonsense and a waste of time for the court.

    Most defense teams are likely not paid as much as Baldwin’s is probably being paid. I think they have to show they are earning their keep … and/or increase their billable hours as much as possible since their client has lots of money.

    I'm torn on this case. Many seem to want Baldwin punished because they don't like him. He was handling the weapon which caused the demise, IMO he thought it was cleared. We will see some legal wrangling. 😔

      He was negligent in his handling of the gun and somebody died. He's not going to face much prison time, if any, but that's the sort of thing that should be tried in court.

      That's part of where I am torn. All the movies made with all the guns and firing of weapons, seems hard to believe every actor actually does everything right. That's why the armor is so important. Also he was one of the producers. I know. 😏

    Alec is my favorite actor, he would never hurt someone on purpose, this was obviously an accident,
    What would be any motivation to neglect or accident. Praying for him and his beautiful family, that need him

      That’s exactly why he’s going on trial for negligent homicide rather than murder and he’s facing a max of 18 months instead of life. No one believes he did on purpose. ….BUT HE DID DO IT, and the fact that some people might like him or his family or his acting, is irrelevant.

      There is a common saying among gun guys: "There are no accidents with firearms." Firearms are inherently dangerous. The law considers them deadly weapons that require any person handling them to ensure that they do not act with a willful disregard for the safety of others. That's why any firearms safety class teaches at least these 4 basic firearms safety rules:
      1. Treat every weapon as if it were loaded.
      2. Keep your finger straight and off the trigger until you’re ready to fire.
      3. Never point a weapon at anything you do not intend to shoot.
      4. Be sure of your target and what is in front and behind it.
      Firearms safety is an individual legal responsibility that can not be passed off to someone else. Hannah Gutierrez-Reed, David Halls, and Alec Baldwin contributed to the death of Halyna Hutchins by being criminally negligent. They are all culpable. Hannah Gutierrez-Reed and David Hall already have been convicted. Alec Baldwin is next.
      The most uttered sentence after an unintentional shooting is: “I thought it was unloaded”. It never works in court. There is New Mexico case law on that as well. Being criminally negligent does not mean that the shooting was intentional. It means that he acted with a willful disregard for the safety of others and by doing so caused the death of a human being.
